10-26-2021 Minutes CITY OF OCOEE • Code Enforcement Board October 26,2021 I. CALL TO ORDER Chair Odom called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Bandur initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Johnson led the Board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM:Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Chair Odom & Members: Lewis, Bandur, Mann,Johnson, & Brennan. Also present: Board Attorney Skip Fowler, Assistant Support Services Director Doug Gaines, Code Enforcement Officer Loeffler, and Code Enforcement Clerk Justin Mieras. ABSENT: Members Shropa & Mirza are excused absences. D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officers and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS CASE NO 2021-00581 LANDAVERDE JOSE LUIS OFFICER LOEFFLER 1514 LADY AVE GARCIA HORTENSIA GARCIA Violation Cited: §115-3.A.(3), §143-27.A., §165-3.A., &§168-6. B.(1) Summary: §115-3.A.(3)—No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. §143-27.A.—Except for pickup times,garbage carts shall not be placed in the front yard of the premises. §165-3.A.—No person shall keep any abandoned or junk vehicle on any public property or any private property. §168-6. B.(1)—No owner,private property,shall consent to the,parking or storing of vehicles on non-improved surfaces of the property. Observation: §115-3.A.(3)—Misc.Junk,Containers, Parts, Misc. Items Old Tires Stored Front And Side Of House Visible From Street §143-27.A.—Garbage Cans Stored In Prohibited Location During Non-Collection Time-Frames §165-3.A.—Expired Tag/No Tag/Non-Operational Vehicles On Property Weed/Grass Growth Underneath Parked On Grass §168-6. B.(1)—Vehicles Parked Upon Unsurfaced Unimproved Front Yard Officer Loeffler presented the case and gave its history. Officer Loeffler further explained that as of October 26,2021,the property is still in non-compliance.The City asked for an Order of Compliance by November 10, 2021, or thereafter to be fined $15.00 per day,per violation, until found in compliance. Member Bandur, seconded by Member Johnson, moved that in Case#2021-00581, the respondent be found in violation as cited as of August 15,2021, and be given until November 10,2021, to come into compliance or be fined$15.00 per day, per violation, until found in compliance. Motion carried unanimously. IV. CASE RESOLUTION CASE NO 2021-00454 OFFICER SIEGRIST 2415 KALCH CT LOPEZ VILLEDA MIGUEL ANGEI Violation Cited: §51-13. Summary: §51-13.—It shall be a violation to do work related to construction without first obtaining a permit. Observation: §51-13. — Work without permit. New gazebo (14' X 16') in back yard. City Permit #1240-2021 was rejected. Gazebo remains. Assistant Support Services Director Doug Gaines explained that as of October 26, 2021, the property is still in non- compliance. Respondent Keyly Lopez explained a new permit was applied for, but they need more time to finalize it.She asked for an extension of one to two months. Member Bandur, seconded by Member Mann, moved that in Case#2021-00454, the compliance date be extended until December 25,2021. Motion carried unanimously. CASE NO 2021-00579 OFFICER DIAZ 612 BANDERAS AVE STAPLER MILDRED ESTATE Violation Cited: §115-3.B. Summary: §115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. Observation: §115-3.B.—Tall overgrown grass/weeds front and back of property. Assistant Support Services Director Doug Gaines explained that as of October 25, 2021, the property is still in non- compliance.The City asked for an Order Imposing Fine. Member Bandur,seconded by Member Lewis, moved that in Case#2021-00579, the Board impose fines as of October 06, 2021, as previously set by this Board. Motion carried unanimously. CASE NO 2021-00643 OFFICER DIAZ 612 BANDERAS AVE STAPLER MILDRED ESTATE Violation Cited: §115-3.A.(3) Summary: §115-3.A.(3) —No person shall allow or allow to remain any Junk or Debris classified as nuisance and menace to public health,safety and welfare. Observation: §115-3.A.(3) —Miscellaneous Trash/Debris Throughout The Property Including Refrigerator, Cat Tower And Other Trash. Assistant Support Services Director Doug Gaines explained that as of October 26, 2021, the property is still in non- compliance.The City asked for an Order Imposing Fine. Member Bandur,seconded by Member Johnson, moved that in Case#2021-00643, the Board impose fines as of October 06,2021, as previously set by this Board. Motion carried unanimously. CASE NO 2021-00689 OFFICER LOEFFLER 1221 BLUE SPRING CT BUFORD J LIGHTSEY LISA A LIGHTSEY Violation Cited: §54-3.A. &§115-3.B. Summary: §54-3.A.—All buildings shall have the assigned building number properly displayed, whether or not mail is delivered to the building. §115-3.B.—No person shall allow or permit excessive growth,ten inches or more on property owned, of weeds,grass, undergrowth or other dead or living plant life. Observation: §54-3.A.—No Visible Contrasting Address Numbers §115-3.B.—Tall Weeds And Grass (Extreme) Officer Loeffler explained that as of October 26,2021,the property was found in compliance.
