Background Summary:
The property is generally located in the southeast corner of the intersection of Hempel Avenue and Old Winter
Garden Road, approximately 152 feet east of the intersection. The parcel ID number is 28-22-28-0000-00-
019. The property was annexed into the city and was approved a small-scale comprehensive plan
amendment and rezoning to PUD (3872 Old Winter Garden PUD) on February 19, 2019.
The applicant/new property owner, Siri Real Estate Holdings LLC, is requesting an amendment to the 3872
Old Winter Garden PUD to amend the PUD Land Use Plan to shift the driveway access location westward
approximately 100 feet in order to avoid impacts to a large electric transformer steel pole.
The proposed shift of the driveway will result in a redesign of the site to place the driveway under the building
and reduce the overall building square footage from 33,200 SF to 28,000 SF with a corresponding reduction
in parking from 166 spaces to 140 spaces. The vehicular interconnection between this site and the property
to the west that was required and approved in the original PUD will remain.
Staff supports the request based on the following findings.
1) Drainage. No impacts anticipated as the proposed change will not increase impervious surface area.
2) Consistency with Section 4-51D. Section 4-51D establishes criteria for determining whether an
amendment is considered substantial. To summarize,
(i) Intensity: The proposed Amendment will decrease intensity.
(ii) Permitted Uses and Phasing: The requested Amendment will not 1) change the list of permitted
uses, 2) change a use type adjacent to a property boundary, or 3) affect the phasing plan of the
PUD.
The table below references the future land uses, zoning classifications, and existing land uses of the
surrounding properties.

The proposed Non -substantial Amendment will not adversely impact the surrounding areas or public facilities
and services as it does not affect the total development square footage of the PUD.
Issue:
Should the Honorable Mayor and City Commission confirm the Development Review Committee's approval
of the Non -Substantial Amendment to the Siri Office PUD, fka 3872 Old Winter Garden PUD, to shift the
driveway access location westward approximately 100 feet and the corresponding redesign of the Land Use
Plan?
Development Review Committee Recommendation:
The Development Review Committee (DRC) met on Tuesday, June 7, 2022, to review the proposed
Amendment to the 3872 Old Winter Garden Planned Unit Development (PUD) and determined that the
Amendment is non -substantial and approved the amendment as a non -substantial amendment subject to the
following conditions:
1. The previously approved LUP and the proposed LUP both show a row of parking within the Market
Street right-of-way, which is owned by Orange County. Therefore, final approval of the medical office
building site plan shall continue to be subject to the County's vacation of the Market Street right-of-
way.
2. During site plan review, the applicant team shall provide architectural and construction plans which
ensure that the office building complies with all applicable Codes, including the Florida Building Code,
relative to vehicular height clearance of the driveway under the building.
Recommendations:
Based on the findings outlined in this staff report, staff recommends that the Honorable Mayor and City
Commission approve the Non -Substantial Amendment to the Siri Office PUD, fka 3872 Old Winter Garden
PUD, to shift the driveway access location westward approximately 100 feet and the corresponding redesign
of the Land Use Plan subject to the following conditons:
1. The previously approved LUP and the proposed LUP both show a row of parking within the Market
