07-26-2022 Minutes CITY OF OCOEE Code Enforcement Board July 26,2022 I.CALL TO ORDER Vice-Chair Bandur called the Code Enforcement Board regular meeting to order at 7:00 p.m. in the Commission Chambers of City Hall located at 150 North Lakeshore Drive, Ocoee, Florida. A. INVOCATION: Member Johnson initiated the moment of silence. B. PLEDGE OF ALLEGIANCE: Member Lewis led the Board in the Pledge of Allegiance to the U.S.flag. C. ROLL CALL AND DETERMINATION OF QUORUM:Code Enforcement Clerk Mieras performed roll call and declared a quorum (4) present. PRESENT: Vice-Chair Bandur and Members: Lewis, Mann,Johnson, & Brennan Also present: Board Attorney Skip Fowler, Assistant Support Services Director Doug Gaines, Code Enforcement Clerk Justin Mieras,and Code Enforcement Officer Loeffler. ABSENT: Chair Odom was an approved absence D. SWEARING OF OFFICERS / WITNESSES: Code Enforcement Clerk Mieras administered the oath to the Code Enforcement Officer and to anyone intending to speak regarding a case. II. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS • CASE NO 2022-00418 OFFICER LOEFFLER 1908 LAUREN BETH AVE SALCEDO, MIGUEL BEDOLLA,CYNTHIA Violation Cited: §150-20&§168-6.B.(1) §150-20—It shall be unlawful for any person to knowingly discharge or to cause or permit discharge of any organic or inorganic matter which causes or tends to cause pollution into any natural waters, receiving waters, outlets or storm water management systems within the City. §168-6.B.(1)—No owner, private property,shall consent to the parking or storing of vehicles on non-improved surfaces of the property. Observation: §150-20—(5' Of Dirt Was Blocking Storm System) Heavy Amount of Sediment Erosion (From Vehicle Egress) §168-6.B.(1)—Vehicle Parking on Grass; Heavy Amount of Sediment Erosion (From Vehicle Egress) Officer Loeffler presented the case and gave its history. He further explained that as of July 26, 2022,the property is still in non-compliance. The City asked for an Order of Compliance by August 10, 2022, or thereafter to be fined $25.00 per day, per violation, until found in compliance. Member Mann,seconded by Member Johnson, moved that in Case#2022-00418, the respondent be found in violation as cited as of July 06, 2022, and be given until August 10, 2022, to come into compliance or be fined$25.00 per day, per violation, until found in compliance. Motion carried unanimously. IV.CASE RESOLUTION CASE NO 2022-00328 OFFICER LOEFFLER 5025 WATER WHEEL CT ALTO ASSET COMPANY 2 LLC Violation Cited: §51-13. Summary: § 51-13.—It shall be a violation to do work related to construction without first obtaining a permit. Observation: §51-13.—Structure being built without required permits, plans, approval and inspections. Officer Loeffler explained that as of July 26,2022,the property is in compliance.
