This item was continued from the October 18, 2022, public hearing at the request of the applicant. The subject property is zoned PUD (Planned Unit Development) and is located on the east side of Lake Johio Road, the north side of East Silver Star Road, approximately 770 feet east of the intersection of North Clarke Road and East Silver Star Road. The subject site is located on Tract 4 of the PUD and is approximately 1.76 acres in size. The subject site is currently undeveloped and is the only remaining parcel in the Ocoee Landings PUD. The subject site parcel ID number is 16-22-28-4532-00-140. The 1s' floor includes 11,000 SF of retail with exercise and amenity space for the condos The 2nd, and 311 Floors would consist of 427 condominium units ranging from 1-3 Bedrooms. Access to the site is via a right -in / right -out on Silver Star Road via a shared driveway with Everest Rehab Hospital. An additional driveway is located on Lake Johio Road via internal circulation through Everest's site. A deceleration right turn lane will be provided on Silver Star Road, and a right turn lane on Lake Johio Road. Parking is being provided with 109 on -site parking spaces and 5 off -site parking spaces on the Everest site via an expected cross -parking agreement. The site is able to facilitate five (5) A.D.A.compliant parking spaces. Stormwater is provided via the master stormwater pond located within the PUD and adjacent to the east side of the project. In between the building and the east property line, a small linear walkway with benches is provided for passive use and dog walking. With regards to the location of the proposed site as a mixed -use building with multi -family type density, the proposed site is conveniently located within walking distance to three shopping centers, Citrus Elementary School, an Orange County Public Library, and within a mile of Coventry Park and Lake Florence Park in Orange County. Changes Made to the Plan after Two (2) Community Meetings and Direction from the PZ meeting: Please see below for our updates and voluntary conditions of approval: 1. 47 residential units reduced to 42 total 2. 11,000 SF neighborhood serving commercial on the first floor (we also added elements such as a fitness center, HOA office/working space, and storage for bikes/residents on the first floor) 3. Units will be condos, not apartments 4. No balconies on the rear of the building 5. Elevator added at P&Z request and to upgrade the building/for accessibility purposes 6. Mean roof height is capped at 40'6" (this is critical because higher price points come for condos with higher ceiling heights and because of the height for transition between commercial and residential uses) 7. We softened the outer look and added much more detail to the building. We mimicked the adjacent building Everest color scheme, so both buildings are cohesive. Please see our attached renderings. 8. Adding significant additional landscape behind the building- we added more landscaping than required by code, utilizing mature trees or utilizing grown bamboo or wax myrtle for extra privacy buffer against the already existing six feet brick wall. Please see attached landscape renderings. 9. We will provide a 10% discount off the condo price to any active military, officer or fireman 10. We will implement a parking decal system in governing documents/rules and regulations for the HOA to control resident parking on site 11. The HOA will have a required background check approval in the governing documents 12. Hours of operation restrictions- business can only be open to the public from 6am-11 pm, with no 24/7 operations 13. Additional restrictions on the commercial uses will prohibit the following tenants: i. Thrift stores ii. tattoo parlor iii. pawnshop + iv. hookah lounge v. laundromat vi. Night club vii. Dollar stores Issue: Should the Honorable Mayor and City Commission approve a proposed Substantial Amendment to the Ocoee Landings PUD Land Use Plan and a Preliminary/Final Large -Scale Site Plan for the Ocoee Landings Mixed Use Building located on the parcel assigned parcel ID number 16-22-28-4532-00-140? Development Review Recommendation: The Development Review Committee (DRC) met on August 23, 2022, and reviewed the proposed Substantial Amendment to the PUD and Preliminary/Final Large -Scale Site Plan. The DRC unanimously approved Staff's support of the proposed project and approved the Final Site plan. Planning & Zoning Commission: The Planning & Zoning Commission (PZC) met on August 30, 2022, to consider the proposed Substantial Amendment to the PUD and Preliminary/Final Large -Scale Site Plan. Following discussions and public concerns regarding traffic capacity and operations, as well as the location, density, and scale of the proposed building, the PZC recommended denial of the proposed PUD Substantial Amendment. Since the PUD Amendment was recommended for denial, the PZC did not take action on the Preliminary Large Scale Site Plan. Staff Recommendation: Staff concurs with the issues raised by the Planning & Zoning Commission and determined the applicant has mitigated the issues with the amended plan and conditions. Staff recommends that the Honorable Mayor and City Commission approve the proposed Substantial Amendment to the Ocoee Landings PUD Land Use Plan and the Preliminary/Final Large -Scale Site Plan for the Ocoee Landings Mixed Use Building proposed to be located on Lot 4, assigned parcel ID number 16-22-28-4532-00-140. Authori . The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VII1 of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION 2. Amendment to PUD/PSP. The Amended PUD/PSP, prepared by Mijax Manager, LLC, date stamped received by the City of Ocoee on May 24, 2022, with such additional revisions thereto, if any, as may be reflected in the minutes of the City Commission of the City of Ocoee meeting approving same, is hereby approved, subject to the Conditions of Approval as approved on October 20, 2015. The Amended PUD/PSP is attached hereto as Exhibit "A", and by this reference made a part hereof. As described therein, the Amended PUD/PSP amends the previously approved PUD/PSP for Ocoee Landings PUD/PSP.
