Howard Property, 8708 A D Mims Road - Annexation and Rezoning; Project No(s): AX-09-22-27 & RZ-22-09-44. (Advertised in the West Orange Times on Thursday, October 27, 2022) Zoning Manager Whitfield presented a brief overview of the proposed annexation and rezoning. The property is approximately 2.25 acres, currently vacant, and is located on the south side of A D Mims Road, beginning approximately 160 feet west of Prairie Lake Boulevard. The applicant is proposing to annex into the City and rezone the property to R-1AA (Single Family Dwelling District) in order to develop a 9-lot single-family subdivision. Water is provided by the City; Planning & Zoning Commission November 8, 2022 2 however, the development of the subdivision will be served by septic systems. The property has access from A D Mims Road. A traffic capacity analysis is not required. At the time of the PSP, an operations analysis may be required. The property is within the boundaries of the City of Ocoee and Orange County Joint Planning Area (JPA) and is designated Low Density Residential on the JPA Future Land Use Map. Zoning Manager Whitfield explained staff findings and recommendations of approval. The Board had no comments or questions. The applicant was present for questions. The Public hearing was opened. As no speaker forms were received, the public hearing was closed. B. Substantial Amendment to the Planned Unit Development (PUD) for Wawa at Ocoee Town Shops; Project No. RZ-22-07-42. (Advertised in the West Orange Times on Thursday, October 27, 2022) Development Services Director Rumer stated this parcel has been before this commission various times in the past. He presented a brief overview of this property, which is currently undeveloped, approximately 3.39 acres in size and is located on the northwest corner of Clarke Road and W. Colonial Drive (SR 50). The applicant is proposing to amend the PUD Land Use Plan by reducing the 27,750 SF of retail and restaurant to a 5,636 Wawa Gas Station and 4,600 SF future development for retail or restaurant. A retention pond is proposed on this site adjacent to State Road 50. Full access is being proposed off of Clarke Road and Jacob Nathan Boulevard. This amendment is not only to change the LUP, but to show that Wawa will be the primary use and not a retail/restaurant. Development Services Director Rumer advised this an amendment, and the Final Site Plan will be back before them at a later date. Planning & Zoning Commission November 8, 2022 3 Discussion: Member Mellen asked if traffic will be allowed to go north on Clarke Road from the Wawa, because traffic at times is very heavy in that vicinity. He further asked whether a traffic signal could be installed at the Clarke Road access. Development Services Director Rumer said that vicinity is too close to the traffic signal at Clarke Road and W. Colonial Drive (SR 50) to install another traffic signal. Chair Lomneck inquired if the full access off of Clarke Road could be moved to the northernmost portion of the site. Development Services Director Rumer answered in the negative indicating there is a wall there. Member Keller said during rush hour the traffic will be backed up all the way to the Clarke Road access where traffic will not be able to enter or leave. Chair Lomneck agreed with Member Keller indicating that it currently takes three light cycles to get through that intersection in the morning. Development Services Director Rumer said closing the access off of Clarke Road would be a taking, which is prohibited. Discussion ensued regarding traffic. Chair Lomneck opened the public hearing. Sean Fortier, P.E., KCG Engineering, Orlando, stated that most Wawas are developed at major intersections; and further, recommended placing FDOT approved block stops to stop traffic from stopping in the middle of the accessway. Member Keller stated he believes there will be a lot of cut-through traffic from Clarke Road through the Wawa to Jacob Nathan Boulevard to make a right onto SR 50. Member Forges recommended staff consider a different alternative for drivers wanting to go northbound on Clarke Road out of this parcel, because of the close proximity to the traffic signal and the traffic congestion. Vice-Chair Kennedy asked the applicant what they anticipate the future development adjacent to the Wawa may be and how it may affect traffic. Neil Coskun, Blue Castle Development, LLC, 1568 Lake Whitney Drive, Windermere, stated they are considering a carwash or a restaurant, but the decision has not yet been made. If it is a carwash, the entrance will be off of Clarke Road, and the exit will be off of Jacob Nathan Boulevard only. Chair Lomneck suggested they install the Wawa and carwash signs before the entrance like the RaceTrac is off of SR 50. Member Williams stated this is a wonderful development for that corner. She believes drivers can make adjustments, but if that is not possible, the City could look at different options to resolve traffic issues. Planning & Zoning Commission November 8, 2022 4 Vice-Chair Kennedy stated he likes Wawa’s concept, inside/outside layouts, and believes this is a good fit for this parcel. He further stated traffic is bad everywhere and has not seen anything out of the ordinary on this plan, and he likes it. Chair Lomneck closed the public hearing. Chair Lomneck asked for a motion with a condition and asked city staff how to word the condition. Development Services Director Rumer recommended to add a condition to ask that motorists not be able to block the accessway to Wawa off of Clarke Road by using a sign and road markings. C. Comprehensive Plan Text Amendment – Adoption of the Five-Year Schedule of Capital Improvements and Update of the Capital Improvement Element; Project No. CPA-2022- 004. (Advertised in the West Orange Times on Thursday, October 27, 2022) Zoning Manager Whitfield presented a brief overview of the Capital Improvement Element (CIE) of the City of Ocoee Comprehensive Plan, and explained it is a requirement of Chapter 163, Florida Statutes (FS), and enables the implementation of the Plan goals, objectives, and policies that need capital funding for a 5-20 year planning horizon. The CIE is required to include a Schedule of Capital Improvements which incorporates publicly and privately funded projects necessary to ensure that the adopted level of service standards are achieved and maintained. The Schedule shall cover at least a 5-year period. Section 163.3177(3)(b), F.S., requires that the City review, modify and update the Schedule and Capital Improvements Element on an annual basis. This annual update may be accomplished by ordinance, and may not be deemed to be an amendment to the local comprehensive plan under Section 163.3184, F.S. Discussion: Vice-Chair Kennedy stated he looked at the schedule, but did not see sidewalks, and asked whether the sidewalks are considered maintenance unless they are being added. Zoning Manager Whitfield answered sidewalks are imbedded in some projects. Development Services Director Rumer announced they are currently working on a 2043 Comprehensive Plan where pedestrian facilities will be introduced into the level of service. Once that is complete, sidewalks can be included into the schedule. Member Keller stated the Clarke Road widening shows it is unfunded, but it is to be started this year and asked for clarification. Development Services Director Rumer answered that money is already in escrow. Planning & Zoning Commission November 8, 2022 5 Member Williams asked if the budget for the projects has already been voted on. Zoning Manager Whitfield answered in the affirmative. V. MISCELLANEOUS - (7:12 pm) A. Project Status Report Development Services Director Rumer asked the Board if they have any questions and the following was discussed. • Chair Lomneck inquired whether the Wawa will go before the CRA. Development Services Director Rumer said projects only go before the CRA if funding is involved. • Chair Lomneck asked for an update on the Turnpike. Development Services Director Rumer stated the public hearing has not happened yet, but FDOT has revised the plan to not affect Alibi Apartments, but there will be some impact on The Regency. • Chair Lomneck inquired whether the roundabout at Ocoee Village is moving forward, and when the roads will be back open. Development Services Director Rumer stated they are currently working in that vicinity to bring utilities to the north side of that intersection. • Member Williams asked about the progress of the Starbucks off of Ocoee Apopka Road. Chair Lomneck stated they are almost done with construction. • Vice-Chair Kennedy asked if anything is happening with the vacant adjacent parcel of that Starbucks. Development Services Director Rumer answered he believes Orlando Health bought the parcel for an urgent care center. • Member Forges stated it was difficult to watch the VMG building at 101 West Silver Star Road be cut off next to the railroad tracks. • Member Keller asked how the Clarke Road widening is going. Development Services Director Rumer stated the silk fences are installed, and they have to get drainage permits and a final utility survey. • Chair Lomneck asked if any potential restaurants have been talking to the City. Development Services Director Rumer stated plans are being reviewed for Teatro Grill where Betty J’s Florist was located. • Member Forges asked who is responsible for the landscaping at Clarcona Ocoee Road. BACKGROUND: Owner: Ocoee Oaks United Methodist Church, Inc. Applicant: Mattaniah Jahn, P.A., representing Diamond Communications, LLC. Site Location: The subject property is located at 201 South Clarke Road, and the subject site is that 3,500 SF leased area located approximately 150 feet south of the church building adjacent to the Orange County water tower property line. Property Size: The subject property contains approximately 12.58 acres, and the lease site contains approximately 3,500 SF plus an access easement onto South Clarke Road. Existing Future Land Use: Low Density Residential (LDR) Existing Zoning: A-1 (General Agriculture District) Actual land use, proposed land use, and unique features of the subject property: The property is developed with a church use and associated ancillary facilities. Clarke Road Project Number: 06-22-SE-029 South City Low-Density Residential PUD-LD Single-family residential use West County Low-Density Residential County A-1 Vacant (west of Clarke Road) & Public Utilities (immediately south) Consistency with the Land Development Code: Section 5-8A of Article V establishes and implements Table 5-1, which lists the principal uses permitted on a parcel or lot in the various zoning districts. Table 5-1 refers to Article V, Section 5-19, and Map 5-19 for permitted use regulations and standards for Telecommunications Service Facilities. Per Map 5-19, the subject property is located in Telecommunications Facilities Area One, which, per Section 5-19E(4), requires that an Innovative Tower Facility receive final approval through the Special Exception process. In addition to the standards and requirements in Section 5-19E(4), the tower facility must meet the Special Exception requirements of Sections 5-19H, I and K. Based on staff review of the proposed tower facility submittal packet, the proposed Innovative Tower Facility meets the requirements of Sections 5-19E(4), H, I and K. Below is a summary of tower requirements and staff findings: 1. Requirements of Section 5-19E(4) Innovative Towers: a. Size & Height: Maximum height permitted for Innovative towers is 125 feet. However, through this Special Exception (SE) public hearing process, the applicant is requesting approval for a height of 135 feet. This is intended to come closer to replace the existing communications tower at the height of 145 feet and located atop the Orange County water tower. b. Location: Tower must be on either private or public property and may not be located on single- family or duplex residential property. The tower is proposed on private non-residential property. c. Siting: Siting for an innovative tower must be via Special Exception. d. Design: Architectural design must be included in the application and considered as part of the SE process. Design shall be innovative, aesthetically pleasing, compatible with the existing character of the developed area, and at the minimum necessary height, size, massing, and opacity. The applicant has provided two (2) design options: a pine tree and a bell tower where the communications apparatuses are hidden from view. e. Separation: Currently, the Code does not establish specific distance separation requirements for innovative towers in Area One. The distance separation is established as part of the SE review process. The proposed tower location is approximately 217 feet from the Clarke Road ROW, making it nearly the same distance from the existing residential on the east and allowing the tower to be accessed by the Church’s existing north/south drive aisle. Additionally, since the southern portion of the Church property has been rezoned from A-1 to R-1A for purposes of a single-family subdivision, the proposed location is as far northwest as possible from the future residential homes while ensuring that the tower lease area does not interfere with Church events and activities, i.e., the Pumpkin Patch. f. Co-location: According to the applicant, the current tower provides space for two (2) carriers. The proposed tower is designed for four (4) future co-locations. Staff Analysis: Staff supports the request for 135 feet in order to allow the Diamond Communications, the communications provider, the ability to provide adequate signal coverage and finds that the tower complies with the above standards. P&Z Meeting Date: December 13, 2022 Subject: Ocoee Oaks UMC Communication Tower Special Exception – 201 S. Clarke Road Project Number: 06-22-SE-029 2. Requirements of Section 5-19H Specific Use/Development Standards: These are requirements that supplement the general regulations in Section 5-19E. Those requirements that are relative to building and electrical codes, and structural certification will be evaluated at the time of permitting. In terms of the remaining requirements of this section, a. Public Facilities: The tower facility has been determined to be a public benefit in providing and ensuring the availability of telecommunications. b. Non-interference: The proposed tower is essentially a replacement tower as the existing tower is located on the County Water Tower, which will be decommissioned. Thus, the proposed location is not anticipated to create any new interference with public safety systems or facilities (for communication transmissions, radio, television, etc.). c. Subdivision of Property: No subdivision of property is required, and the area for the tower has been leased from the property owner and will be have the required security barrier. d. Osprey/Eagle Nesting, Security Barriers, Equipment Shelters/Storage, Parking, Landscaping, Warning Signs, Signs and Advertising, and Lighting/Markings: The proposed site plan for the tower includes drawings/plans, construction details, and site plan notes that comply with these requirements. Staff Analysis: Staff identified no issues, except that Planting Schedule in the Landscape Plan needs to be revised to replace the Crepe Myrtles with an evergreen canopy tree species. 3. Relevant Requirements of Section 5-19I Application Submittals: a. Leaseholds: The applicant has submitted a lease, and an amended lease to state that the Lessor (Ocoee Oaks UMC) shall be responsible for the removal of the structure at the sole cost and expense of the Lessee (Diamond Communications) in the event the tower is abandoned by Diamond Towers and that Diamond Communications will secure a tower removal bond to the benefit of the Ocoee Oaks UMC. b. Environmental Assessment: NEPA Report completed in June 2022. Based on this report, no further action needed. c. Public Notifications: Public notices have been sent out to listed tax parcel numbers within a 660- foot distance of the subject site. d. Visual Impacts and Line of Sight Analysis: Photosimulations and Line of Sight graphics have been submitted for two (2) tower design options. The photostimulation and graphics are attached to this staff report. Staff Analysis: The applicant has provided two (2) tower design options. Option 1 is a pine tree design, and Option 2 is a bell tower design. Staff supports and recommends approval of Option 2. 4. Requirements of Section 5-19K Special Exception Review: a. Compatibility and Appearance: The innovative design is compatible with the surrounding area, which consists of the religious use, single-family homes, public utilities, and vacant lands. The bell tower design is slimmer and shorter than the existing water tower facility. P&Z Meeting Date: December 13, 2022 Subject: Ocoee Oaks UMC Communication Tower Special Exception – 201 S. Clarke Road Project Number: 06-22-SE-029 b. Determination of whether Tower Communication needs can be met by means of a camouflaged or building-mounted facility: The proposed 135-foot height needed by the tower facility make it impractical or un to place the facility on a building as the current A-1 zoning district establishes a maximum height of 35 feet. Per Article II, Sections 2-4(47) and (164), camouflage towers and innovative towers in Area One have similar definitions and design expectations in that camouflage towers are expected to blend in and be unobtrusive, while innovative towers are expected to be aesthetically-pleasing, artistic, and have scenic or cultural value. However, camouflage towers are limited to 75 feet and innovative towers to 125 feet, and innovative towers are required to go through a Special Exception review process. Staff Analysis: Staff finds that the bell tower (Option 2) fits better into the religious use of the subject property than the pine tree design. Due to the height of the proposed bell tower, staff has designated the tower as an Innovative Tower and processed it as a Special Exception to ensure any needed mitigation is provided. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on Tuesday, December 6, 2022, to review the requested Special Exception for an Innovative Communications Tower Facility on a portion of the property located at 201 South Clarke Road, assigned parcel ID number 21-22-28-0000-00-027 and recommended approval subject to the below conditions of approval: • The tower will be designed as shown in Option 2, Bell Tower, and • The Planting Schedule in the Landscape Plan will be revised to replace the Crepe Myrtles with an evergreen canopy tree species. STAFF RECOMMENDATION: Based on the recommendations of the DRC, staff recommends that the Planning and Zoning Commission, acting as the Local Planning Agency (LPA), recommend approval of an application for a Special Exception for the use of a portion of certain property located at 201 South Clarke Road, assigned parcel ID number 21-22-28-0000-00-027, for an Innovative communications tower facility subject to the following conditions: • The tower will be designed as shown in Option 2, Bell Tower, and • The Planting Schedule in the Landscape Plan will be revised to replace the Crepe Myrtles with an evergreen canopy tree species.
