Subject: Change Order No. 1 with Southern Site Works for the Pioneer Key Regional Stormwater Pond
Project for a No-Cost Time Extension
Background Summary:
This project requires removal of more than 90,000 cubic yards of excess materials. When the contract
for this project was originally executed, the City was to utilize one-half of the excess fill material for
various planned City projects, and the contractor was to dispose of the other half. When the City
subsequently indicated that it had no application for any excess materials, the contractor accepted
responsibility for removal of all materials without a change in contract price. With the subsequent
reduction in construction activity, the volume of material to be removed became greater than what could
be absorbed by the local development community within the original contract time. Accordingly, the
contractor has requested a no-cost construction time extension of 60 days in order to find additional
consumers of the remaining fill material.
Issue:
The Engineering Department has proposed changes to the construction completion date and requests
that the City Commission approve Change Order No. 1 for this project.
Recommendations
The Engineering Department recommends that the City Commission approve Change Order No. 1 for
the additional contract time, with no adjustment to contract cost.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and
all parts of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS
apply to and govern all work under this change order.
II. REQUIRED CHANGES
Provide additional time for cost-effective disposal of excess fill materials.
III. JUSTIFICATION
The regional slowdown in construction has reduced the demand for fill materials. This no-cost
time extension allows additional time for material to be removed from the site, with no resulting
damages to the City.
IV. NARRATIVE OF NEGOTIATIONS
Change order is based on mutual agreement by the parties.

Acknowledgements:
The aforementioned change, and work affected thereby, is subject to all provisions ofthe original
contract not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on
the original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a
result of this Change Order. No other claim for increased costs of performance or modifications of
time will be granted by the OWNER for the Work covered by this Change Order. The
CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER
arising from or relating to the matters or Work set forth or contemplated by this Change Order.
