MINUTES OF THE PLANNING AND ZONING COMMISSION
ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, OCTOBER 13, 2009
CALL TO ORDER
Chairman Sills called the meeting to order at 7:02 p.m. Following a moment of
silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared
present.
PRESENT: Chairman Sills, Vice Chair Golden, Members Campbell, Dillard,
Rhodus, and West. Also present were Assistant City Attorney
Watson, Development Services Director Shadrix, Building Official
Washington, and Deputy City Clerk Sibbitt.
ABSENT: Members Conkling, McKey, and Morris were absent excused.
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Tuesday,
September 8,2009.

NEW BUSINESS
CHANGES TO THE OCOEE LAND DEVELOPMENT CODE - SECTION 7 -2A. 7 -4A. 7 -SA. 7-
GA. OF PART IA OF ARTICLE VII OF CHAPTER 180
Building Official Washington gave a brief overview of the changes to the LDC
relating to FEMA National Flood Insurance Program Requirements. He stated
that the City had received a notification from FEMA State advising the City that
they needed to review their ordinance and if it was not updated they would not
allow the City to participate in the National Flood Insurance Program. Upon
review of the ordinance, which was given a good review, they made minor
grammatical changes and updated some new laws that had been passed since
the adoption of the ordinance.
The new ordinance has been drafted by the City Attorney with the help of FEMA
to insure that the ordinance before them would be accepted as meeting their
criteria.

DISCUSSION
Vice Chair Golden stated he had a question regarding definition 27 on page 7 of
the LDC. It states that: IISubstantial Damage: Damage of any origin sustained
by a structure whereby the cost of restoring the structure to its before
damages condition would equal or exceed 50 percent of the market value of
the structure before the damage occurred." Building Official Washington
explained that once your home or property is damaged then the owner is
responsible to bring it up to current FEMA regulations. He further gave a scenario
of when the 50% would most likely apply. Vice Chair Golden stated there was
another section which addressed elevating mobile homes and was wondering if
that would have to be a building code change. Building Official Washington
stated it is not a building code change and there are situations where mobile
homes are found in flood plain areas; however, Ocoee only has three zonings
which allow mobile home placement so that section would not be an issue at any
time for the City.
The Public Hearing was opened for Changes to the LDC. As no one wished
to speak the Public Hearing was closed.
Member Campbell, seconded bv Member West, moved to recommend approval
of Ordinance No. 2009-028. Motion carried unanimous/v.
MISCELLANEOUS
Development Services Director Shadrix commended Building Official
Washington for his tremendous work with the redesign at the Building Department
counter and the changes in the way that they are operating. He further
announced they are in the testing mode of their on-line building permitting
computer system. He is planning to do a sneak preview briefing at the October
20th Commission Meeting. Development Services Director Shadrix stated this
program is being designed just for the Development Services Department at this
time but it is a methodology that can be easily applied on a City wide basis. He
further explained the user friendliness of the program.
Development Services Director Shadrix stated at their Founder's Day booth
they had over 100 residents fill out a survey regarding what they would like to see
in the CRA. On November 4th at 6 p.m. in the Community Center they are
planning a community workshop targeting businesses in the CRA. It will be a
really good meeting because it will follow-up on some of the workshops they have
had with the CRA Board and the citizen surveys they have at this point. They
received a lot of positive responses on the target of Area 1 properties which is the
corner of Maguire Road and State Road 50. Development Services Director
Shadrix stated the November Planning and Zoning Meeting will be a very

important meeting because they will likely have a special development plan that
will be executed under the activity center overlay of the code for that area. Also
there is a very strong likelihood that they will be bringing a draft of the E.A.R.
Chairman Sills inquired if the Hampton Inn had backed out because he heard
they were not building the hotel there. Development Services Director Shadrix
stated to his knowledge the issue holding up that development is that they are
trying to come up with the impact fees required. The applicant's representative
appeared at the City Commission meeting and made it known that they were
having a difficulty coming up with the funds. They may also possibly be hurt by a
change to the building code which may require them to go back and do a lot of
redesign.
