REGULAR CITY COMMISSION MEETING
A. CALL TO ORDER
Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission
Chambers of City Hall. Retired Pastor Berwyn Oltman gave the invocation, followed by the
Pledge of Allegiance to the Flag, and led by Commissioner Hood. City Clerk Eikenberry
called roll and declared a quorum present.
Roll Call: Commissioner Hood, Commissioner Wilsen, Mayor Vandergrift, Commissioner
Johnson and Commissioner Keller.
Also Present: City Attorney Rosenthal, City Manager Frank, City Clerk Eikenberry
B. PRESENTATIONS AND PROCLAMATIONS
The National Anthem was sung by Bethany Burnett, a 19 year old autistic girl who wanted
to help bring recognition to April being National Autism Awareness Month.
Presentation from State Representative Grayson by Debra Booth - Ms. Booth stated that
she recently worked with Commissioner Keller regarding issues with the flood zone areas at
Sawmill. She read a letter that Congressman Grayson sent to with regard to his concerns with
the way flood zone areas were defined and mapped and deadlines that were imposed.
Ms. Booth stated that the meeting regarding appropriation requests for Congressional District #8
for FY/2011 and Ocoee passed first round of funding in projects 1) $264,000 for Interoperable
Radios to ensure uninterrupted communications in emergencies. 2) Financial Services and
General government - $225,000 for the City of Ocoee for UCF Small Business Incubator
Program with hopes of bringing this program to the West Side of Town. 3) Interior
Environmental Related Agencies - $1,300,000 for the Ocoee/Orange County reclaimed
interconnection for the installation of the reclaimed water connection and the extension of
reclaimed water lines. This is a repeat of a project submitted last year 4) City of Ocoee and
Orange County, $2,000,000 for the Maguire Road Improvement Project. Last year they brought
home $13,000,000 to District #8 and they are hoping for $20,000,000 this year.
Commissioner Keller thanked them for the help on the Federal level with regard to the FEMA
issue and for these four appropriations. City Manager Frank thanked Debra and Congressman
Grayson for the assistance and for seeing them when they were in Washington.

Proclamation- Arbor Day - Apri130, 2010. (Mayor Vandergrift)
Mayor Vandergrift said Arbor Day is being celebrated at Citrus Elementary School and
Progress Energy is planting a tree on the premises. He presented the Proclamation to Debbie
Clemens from Progress Energy. He added that Brookstone Elementary is celebrating Earth Day
on Friday, Apri123, 2010.

D. STAFF REPORTS AND AGENDA REVIEW
Emergency Item
Prairie Lake Park funding from the Florida D~epartmenY of Environmental Protection
requires a permanent dedication to the public.
City Manager Frank 1) advised that we have an emergency item and explained that in order to
continue receiving the FRDAP funds of $200,000 the state requires a permanent dedication to
the public or we may have to pay the money back to the state.
Mayor Vandergrift declared the item an emergency.
Commissioner Hood seconded by Commissioner Keller moved to approve the
Prairie Lake Park funding from the FRDAP grant program. Motion carried 5-0.
2) said there was an ordinance distributed that goes with item #6.
3) gave suggested dates for upcoming workshops. May 18th, prior to Commission Meeting or
May 19th, additionally they could use June 1St prior to Commission Meeting or June 2°a
4) said the Health Center is operating at over 100% capacity, eight to ten Ocoee employees or
dependants are using the Apopka Clinic each week. We will be bringing back an item in the
next two meetings to consider opening the clinic for more hours.
5) announced Aquatic Center opening, hours and fees.
6) said the Big Orange Games will be held Saturday, May 1St at Ocoee Track and Field, opening
ceremonies begin at 9:15 a.m. Call Parks and Recreation for more information.
7) Clarke Road Landscaping has been completed and looks very good.
8) said the Vignetti Center reroofing project was completed.
9) said the surplus auction has been completed, we will have final dollar amounts at a later date.
10) said Clarke Road paving should be finished this week, with sign placement and signal repairs
next week; painting of permanent pavement markings will be done in 30 days.
11) gave update on Central Park- paving of Armstrong Alley in the parking lot is in progress, the
new floating dock has been completed; floating section will be installed this week.
12) advised that staff began installing portable backflow preventers for reclaimed water service
at the Wedgewood Commons subdivision, this process must be completed before the new
reclaimed service is available to the customers. This portion of the project should be completed
in the next 2-3 weeks
13) received a Notice from Aldi Supermarket announcing their Grand Opening on Monday, May
3, 2010, the ribbon cutting is at 9:00 am and everyone is invited.

E. COMMISSIONERS ANNOUNCEMENTS
Commissioner Hood reminded everyone that Pop Warner Football sign-ups were coming up
and that information can be found on their website.
Commissioner Wilsen announced the Gun Safety class would be held April 25, 2010, contact
the police department for more information.
Commission Johnson had nothing to announce.
Commissioner Feller 1) announced the OHS Theater Department is doing Susical on May 6-gth
at 7 p.m. and a matinee on the 8th at 2 p.m. 2) said the OHS Choral Department will be doing a
spring concert on May 28th at 7 p.m.
Mayor Vandergrift 1) emphasized the Big Orange Games coming up on May 1St and what a
great event it is to see; he added that they need volunteers to help. He visited former city
commissioner Sam Woodson who has been in the hospital. Mr. Woodson has been in good
spirits but will now be in Hospice care if anyone can visit him at home. Mayor Vandergrift
announced that Jimmy Hager is home now after surgery from bladder cancer and his prognosis is
excellent.

Commissioner Keller, seconded by Commissioner Keller, moved to approve
Consent Agenda Items #1 - #4 as presented by staff. Motion carried 5-0.
1. Approval of the Regular City Commission Minutes Held on April 6, 2010. (City Clerk
Eikenberry)
Approved on Consent. Motion Carried 5-0.
2. Reappointment to the Human Relations Diversity Board. (City Clerk Eikenberry)
The two-year term of Fay Alston will expire in May. The member has indicated she is willing to serve another
term, if reappointed. The current request for reappointment not withstanding, there is currently one vacancy on
the board and no pending applications.
Approved on Consent. Motion Carried 5-0.
3. Approval of Purchase of Police Portable Radios. (Police Chief Brown)
The FY 2009/2010 budget provided up to $11s,s88 for the purchase of digital portable radios and accessories.
The City of Ocoee was awarded reimbursement grants for the purchase of digital radios and earpieces for
radios. The American Recovery Act-JAG Countywide Grant # 2010-AARC-GRAN-27-W7-222 awarded the
purchase of 9 (nine) digital radios totaling $49,500 and 32 earpieces totaling $3,488. The Justice Assistance
Grant # 2010-JAGC-ORANG-1 S-4X-092 awarded the purchase of 3 (three) digital radios totaling $16,500 and
13 earpieces totaling $1,453. The above mentioned grants will reimburse the City for the purchase of 12 radios.
The police department will also purchase S (five) digital radios totaling $27,500 from the budgeted Capital
Outlay fund. In order to maintain compatibility and interoperability with Motorola radios currently utilized by
the Orange County radio users group, Motorola radios must be purchased. Motorola is a sole source provider
for these radios and offers only the Orange County contract pricing of $SS00 per radio. These radios will also
be compliant with pending Federal mandates.

4. Approval of Lakewood Manor -Non-Substantial Amendment to the PUD. (Principal
Planner Rumer)
The owner/builder of the site, Homes in Partnership (HIP), approached the City back in February about an issue
with the size of the building pad envelope of Lot 38. Homes in Partnership does not have a home plan that fits
within the building pad envelope and is requesting relief to the side yard setback. Homes in Partnership is
requesting anon-substantial amendment to the PUD to permit an eastern side yard setback reduction from 15
feet to 12.8 feet for lot 38.
Approved on Consent. Motion Carried 5-0.
5. Approval of Funding for the Employee Assistance Program. (Human Resources
Director Carnicella)
This Agreement is for mental and emotional healthcare claims, including psychiatric initial assessments,
individual and family counseling, group counseling, and training seminars for employees and their dependents.
The budgeted amount this fiscal year is $55,000 and the funds are available.
Approved on Consent. Motion Carried 5-0.
G. FIRST READING OF ORDINANCE
6. Proposed Code Amendment for Temporary Deferral of Road Impact Fee Payments.
(Second Reading and Public Hearing scheduled for May 4, 2010, Regular Commission
Meeting at 7:15 p.m. or soon thereafter). (Development Services Director Shadrix)
As an economic incentive for new development, City Staff is proposing a Code Amendment for Temporary
Deferral of Road Impact Fee Payments. In lieu of the payment of Road Impact Fees prior to the issuance of a
Building Permit as provided in Sections 87-3 and 87-11, an applicant for a Building Permit will be able to defer
the payment of applicable Road Impact Fees until the authorization of "Prepower" or issuance of a "Certificate
of Occupancy" (C.O.) with respect to the structure or building for which the deferral has been requested. The
provisions of this amended section shall not be applicable to single-family or multi-family housing projects with
less than four dwelling units. Furthermore, the road impact fee deferral set forth in this amended section shall
"sunset" on May 1, 2012, without further action by the City Commission.
City Attorney Rosenthal read the title of the ordinance.
Mayor Vandergrift announced that the second reading and public hearing will be scheduled for
May 4, 2010.
He urged the Commission to get with staff and make sure they understand this item before the
Public hearing; he said it is a bold move for our community to stimulate the economy.
H. SECOND READING OF ORDINANCE -PUBLIC HEARING
7. Proposed_Amendment toChapter 1 of the Code of Ordinances. By Adding Article III,
Entitled "Administrative Service Charges" and Section 1-14 Entitled "Lien Search
Fees". (Advertised in the Orlando Sentinel Legal Classified on .Sunday, April 11, .2010. Public Hearing
scheduled at 7:1 S p.m. or soon thereafter). (City Clerk Eikenberry)
The City of Ocoee receives numerous requests for lien searches which consume a significant amount of staff
time in four departments with no current form of reimbursement to the City. In recent months these lien search
inquiries have skyrocketed due to foreclosures, short sales, and investors "flipping" properties. During the first
three months of 2010, the City Clerk's office has coordinated and responded to 175 requests for lien searches,
which would average approximately 700 per year at that continued pace. In addition to collecting a fee for the
lien search, other cities have reported that including any delinquent utility fees as part of the lien report
procedure often assisted in collecting such outstanding fees at closing even if no lien existed. Fees from other
municipalities ranged from $10 - $100. Staff recommends that the standard Lien Search Fee be set at $25, with
a $75 fee for expedited searches requiring a response in less than two business days.

Mayor Vandergrift opened the Public Hearing.
There being no one wishing to speak, the Public Hearing was closed.
Commissioner Keller, seconded by Commissioner Wilsen, moved to adopt
_Ordinance No. 2010-004 adding Article III, entitled "Administrative Service
Charges" and Section 1-14 entitled "Lien Search Fees" per staff
recommendations. Motion carried 5-0.
The ordinance as adopted carries the following title:

K. COMMENTS FROM COMMISSIONERS
Commissioner Hood -asked if there would be resodding at Clarke Road and A.D. Mims.
Additionally, he complimented Director Krug on the work done thus far. The director replied
the sod will be replaced and that kudos should go to the Engineering Department staff.
Commissioner Wilsen - 1) brought to the commission's attention about unsafe activity going on
at Central Park. Commissioner Hood replied that Police Chief Brown is aware and taking care
of the matter by adding extra patrol, making warnings and arrests. Commissioner Wilsen said
that it needs to be beefed up a little bit. Commissioner Hood stated that Parks & Recreation
Director Jeff Hayes is also working on the matter. Commissioner Hood called Mr. Hayes
forward. Mr. Hayes explained that the manpower is being redistributed to expand staff presence
in the parks over the weekend. Parks maintenance staff will be checking facilities, removing
trash, and other assignments on Saturdays and Sundays. Park Rangers are scheduled to work
weekends. The ranger program is being supplemented with recreation staff having them make
rounds to troubled areas like Central Park. Park improvements will include improvement in
security lighting, particularly at Central Park. Commissioner Hood encouraged the public to
pick up the phone and call 911 if they see anything that does not look right. Commissioner
Wilsen said that can happen if it is well received. She said that not everyone will call 911; it's
also a matter the police can getting there in time. City Manager Frank added that there is a
new fifth squad whose duty it is to concentrate on problem areas. The issues in Central Park will
be addressed using marked and unmarked patrol. Central Park will be part of that focus.
Commissioner Hood added that once you deal with the folks participating in the activity,
improvement will be seen. He made compliments about how good Central Parks looks. The

mayor remarked about the sidewalk at the park. The mayor remarked about the 4 foot sidewalk
at the park.
Commissioner Johnson - 1) asked what happened to the fence at Tiger Minor Park. Director
Hayes responded that he has received proposals for the fence. He wanted to see where the tennis
courts come in first. He expects to move forward with the fencing within the next two weeks.
City Manager Frank said that the tennis courts need to be done first. Commissioner Johnson
said the fence matter needs to be addressed first. City Manager Frank replied that the fencing
was part of the improvement and not a separate project. 2) asked about the signs for Freedom
Park. Director Hayes answered that he had not forgotten that and that he has the order into
Public Works for the signs to be made they should be ready this week. 3) said there is still an
issue with the roadway maintenance going into the new elementary school. City Manager
Frank added that the city engineer had communications with the county and was told that it is
now on their landscape maintenance rotation. 4) asked about the movie in the park. Director
Hayes answered that the Princess and the Frog will be shown this Saturday 7:45 p.m. and the
park will be open at dusk.
Commissioner Keller thanked Parks and Recreation Director Hayes for the work being done on
Hackney Prairie Park
Mayor Vandergrift 1) said we had eight records broken on Starke Lake this weekend at the boat
races. 2) said the Apopka Polish Festival is this Saturday at 9:00 a.m.; they invite all the
dignitaries and those running for office are generally present.
3) gave well wishes to Sam Goodson and Jimmy Hagar.
