Background Summary:
The Cities of Ocoee and Winter Garden and Orange County were approached by the Orlando- Orange
County Expressway Authority (OOCEA) approximately two years ago about giving away surplus land
and /or non - expressway roads and associated retention ponds along the SR 429 corridor. The surplus
land, road and retention ponds that OOCEA wanted to go give to the City was excess right -of -way
along the east -west portion of Tomyn Boulevard and the road portion of Tomyn Boulevard that
parallels SR 429 and the associated retention ponds. See attached aerial photograph of the area.
OOCEA has been maintaining these areas since the construction of SR 429 although these roads,
retention ponds, and excess land are not directly associated with SR 429. The portion of Tomyn
Boulevard that parallels SR 429 was constructed to replace portions of Windermere Road north of
Roberson Road. The three retention ponds collect drainage from Tomyn Boulevard only and not from
SR 429. The excess right -of -way was from the old dirt portion of Tomyn Road from Maguire Road
west to Marshall Farms Road at the YMCA.
The maintenance of the road and retention ponds has been an issue for many years. Usually, right
before the start of the school year, staff would contact OOCEA and Orange County about cutting the
grass and cleaning the sidewalks throughout the school year. The City has ownership and
maintenance jurisdiction over the portion of Tomyn Boulevard from Maguire Road west to the area
that OOCEA is going to give Ocoee. The portion of Tomyn Boulevard (old Windermere Road) north of
Roberson Road has been contemplated to be give to the City by Orange County. All of the property
east of the Expressway is within the Ocoee Joint Planning Area and the Water and Sewer territorial
Boundary. Having ownership of the road and the associated retention ponds would give the City
complete jurisdiction in this area; therefore not requiring development to work with multiple agencies.
Originally, OOCEA had been contemplating giving some of the land to Orange County. However, staff
requested that all the parcels be given to Ocoee and not require a possible future dedication from
Orange County. OOCEA Quit Claim Deeded the road, retention ponds, and excess right -of -way to the
City in June of this year. It has taken them until earlier this month to maintenance the areas so that
City staff can assume the maintenance responsibility.
Issue:
The Orlando- Orange County Expressway Authority has requested that the City of Ocoee formally
acknowledge and agree to assume all maintenance for the three ponds collecting drainage from
Tomyn Boulevard.
Recommendations
Staff recommends that the City Commission acknowledge and agree to assume all maintenance for the
three ponds collecting drainage from Tomyn Boulevard and authorize the Mayor and City clerk to
execute the Maintenance Statement as provided by Broad & Cassel, attorneys for the Orlando-
Orange County Expressway Authority.

the state, under the laws of the State of Florida, whose mailing address is 4974 ORL Tower Road,
Orlando, Florida 32807, hereinafter referred to as "Grantor," to THE CITY OF OCOEE, a Florida
municipal corporation, whose mailing address is 150 N. Lakeshore Drive, Ocoee, Florida 34761,
hereinafter referred to as "Grantee ".
WITNESSETH:
THAT Grantor, for and in consideration of the sum of Ten Dollars ($10.00) and other valuable
consideration, the receipt and adequacy of which is hereby acknowledged, hereby grants, bargains, sells,
aliens, remises, releases, conveys and confirms unto Grantee in an "AS IS" and "WHERE IS" condition,
all of Grantor's right, title, and interest, if any, in and to certain real property situate in Orange County,
Florida, to wit:

providing drainage outfall for S.R. 429 only to the extent improvements in S.R. 429 are permitted and
existing or designed. Notwithstanding anything to the contrary contained herein, the easement granted
herein shall be appurtenant to and run with S.R. 429 right -of -way and may not be assigned, conveyed
or transferred by Grantor except as an appurtenance thereto.

Per my correspondence of June 11, 2010, I have recorded the Quit Claim Deed from the
Authority to the City of Ocoee, conveying various parcels, including four (4) ponds along S.R.
429. In order for the permits for these ponds to be transferred to the City, the City must assume
the maintenance thereof. Therefore, kindly arrange for the execution and return of the following
acknowledgement, agreeing to take over the maintenance of the ponds conveyed in Quit Claim
Deed dated May, 28, 2010, recorded in Official Records Book 10060, Page 3708. Public Records
of Orange County, Florida, a copy of which is enclosed herewith.
