PZ 05-25-1976 MINUTES OF THE MEETING OF THE PLANNING AND ZONING BOARD HELD MAY 25, 1976 arm PRESENT: Chairman Bowness, Peck, McRobert, Carter, Brooklyn, Turner, and Thomas. ABSENT: None. Meeting called to order at 7:40 P. M. by Chairman Bowness. I. Public Hearing - Petition 76 -3, Zoning Change. Charles Coffman, representative for Ralph Vaughn on Petition 76 -3 appeared before the Board. Said petition requests change of zoning for commercial use of a Cumberland Farms convenient store (property located on N. E. Corner of Silver Star and Ocoee Hills Road). Chairman Bowness opened session for comments from the audience. Many opposed request for change and indicated that there were already enough convenient stores in the area and that they were not in favor of said area becoming commercialized, especially since it is already zoned resi- dential. Several commented that their children's safety would be jeopar- dized and the value of their homes would also decrease due to the store being so close to their homes. Several citizens complained that they had not been notified of the hearing. They said they did not receive a letter and that a sign was not posted to `" notify those in the area that a hearing would be held. Following comments from the audience, Mr. Peck stated that according to the Zoning Ordinance a sign should have been posted and that he was in favor of recessing the hearing and starting it all over again, making it perfectly legal by proper notification and posting of signs. All members of the Board were in favor of recessing the hearing until June 17th. Hearing was recessed until June 17th. II. Merwin C. and Linda M. Brown request annexation of property on east side of Starke Lake per letter dated May 18, 1976. Said letter indicates that there are several semi - trailer trucks on the property in which the Browns work on and operate. Turner moved to recommend to Council annexation of the property located S 145 ft of N 375 ft of E 185 of NW4 of SE4 and rezone property A -I, providing that after attorney's assumption that it is legal to do so. Carter seconded. Vote unanimous. III. Set Date for Public Hearing on Pine St. Property. In the meeting of the Zoning Board held May 11, 1976 a date for hearing was set for June 8th. The Board at that time motioned to hold a hearing to consider zoning the property RIAA. Due to a Commission meeting held recently, there was discussion among commissioners wanting the property changed to RIA instead of RIAA. Peck moved to amend motion in the minutes of May 11, 1976 to state that the property zoned RIAAA, which includes Sanders Dr. and Pine St. be considered for rezoning from RIAAA to RIA in a Public Hearing on June 22nd and to send notices to property owners and surrounding owners in said area as per Zoning Ordinance, Section 6, Page 16, Item 2. Motion seconded by Turner. Vote unanimous. IV. Some discussion was brought up pertaining to a building permit that was granted May 17th to move a house to 703 Pine St. There was some doubt about whether or not the building met the zoning requirements in area in which the house was to be moved. Turner moved that the City Commission inform the Building Inspector to check out buildings before issuing permits. Vote unanimous. V. Peck moved to adjourn. Carter seconded.
