P & Z - 11/13/2001 THE MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, NOVEMBER 13, 2001 CALL TO ORDER Chairman Bond called the meeting to order at 7:05 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. Chairman Bond welcomed new board member Camille Patterson. Chairman Bond extended condolences to Member Rhodus, her son Shannon, and all their families in the loss Shannon's wife, Jane. PRESENT: Chairman Bond, Vice Chairman Landefeld, Members Golden, McKey, Miller (arrived 7:21 p.m.), Patterson and West. Also present were Planning Director Wagner, Principal Planner Lewis, Chief Assistant City Attorney Cookson, and Deputy City Clerk Green. ABSENT: Members Matthys and Rhodus. CONSENT AGENDA The consent agenda consisted of approval of Item A: A. Minutes of the Planning and Zoning Commission Regular Meeting held on Wednesday, September 19, 2001. NEW BUSINESS WEST END PROFESSIONAL PARK PUBLIC HEARING MODIFIED PRELIMINARY /FINAL SUBDIVISION PLAN - CASE No. LS -92 -004 Chief Assistant City Attorney Cookson said his firm represents the owner of this property which prevents the firm from representing the owner before the Board and prevents him from representing the City in this public hearing. Planning Director Wagner said the City has been represented on this case by Attorney Carole Barice. He said they believe all the legal issues have been resolved and for that reason they did not believe there was anything controversial to warrant her attending the Planning and Zoning Commission Regular Meeting November 13, 2001 meeting for this case. He said he thought Staff would be able to answer members' questions. If not, Staff could contact her and report back. Principal Planner Lewis presented the staff report for the proposed modification to an existing subdivision located on the south side of Professional Parkway just east of Maguire Road. The southern boundary of the site is the Florida Turnpike, the eastern boundary is Lake Lilly and the Oak Forest apartment complex. He said the previously approved Plan provided for 29 lots. The proposed modified plan will include a total of 14 commercial /industrial lots and will have three points of access, all from Professional Parkway (two short cul -de -sacs and one long cul -de -sac). Additional right -of -way for Professional Parkway will be dedicated to the City in order to accommodate the current road widening project for that road. This provision is covered in an existing Developer Agreement with the City which also provides for certain waivers from the Land Development Code. Mr. Lewis explained the six proposed waivers included in this Preliminary/Final Subdivision Plan. The first waiver is related to the maximum block length of 1,000 feet. The second, third and sixth waivers are related to providing sidewalks, relieving the Developer of these responsibilities. The fourth and fifth waivers are related to building setbacks and landscape buffers along Professional Parkway. He said Staff supports all of these waivers because they are consistent with the Developer's Agreement which has been negotiated. On October 10, 2001, the DRC reviewed the project, discussing at length a variety of outstanding issues which were identified in a DRC staff report. Staff explained their concerns and the Applicant agreed to comply with Staff recommendations. The Committee voted unanimously to recommend approval of the P /FSP, subject to making the revisions to the plans as discussed the meeting. All of the DRC requirements have now been satisfactorily addressed in the plans received November 5, 2001. Mr. Lewis concluded with Staff's recommendation for approval of the Modified Preliminary/Final Subdivision Plan for West End Professional Park, including all the proposed waivers, as date stamped received by the City on November 5, 2001. The public hearing was opened. As no one wished to speak, the public hearing was closed. Member McKey asked for details about the sidewalk waivers. Mr. Lewis explained that, as part of the negotiating for extra right -of -way to build the road widening project, the City agreed to build the sidewalks for them. Another waiver omits the sidewalk along the turnpike side of the road. A third sidewalk waiver relates to allowing a width 2 Planning and Zoning Commission Regular Meeting November 13, 2001 of five feet (as approved in the previous P /FSP) rather than six feet as required by newer codes. Member McKey said he would prefer the sidewalk width to be six feet. Member Patterson asked about the building setback waiver. Mr. Lewis said the normal requirements for what is now Professional Parkway would be 50 feet for the building. He said in many cases in the past setback waivers have been granted when there has been dedication of extra right -of -way. He said, in this case, they are asking for waivers on the building setback to 15 feet as well as the landscape buffer. Member Golden asked, with the reduced setbacks, if there would be any increase in landscaping along Professional Parkway. Planning Director Wagner said there will be additional landscaping and explained the requirements under the City's commercial and industrial development code. Mr. Wagner said each individual lot will have its own landscape package. Addressing the stormwater system, Member Golden expressed concern about direct discharge to the lake. Mr. Wagner confirmed that the erosion controls and stormwater systems have been approved by St. John's River Water Management District (SJRWMD). Mr. Wagner said the retention pond is not actually connected to Lake Lily but does overflow into it. There is now a drainwell in Lake Lily which was put in by the County but is maintained by the City. He said it is part of a fairly elaborate stormwater management system to control flooding in the area. He said it may have been a natural pond at one time, but under the original permitting it was deemed to be a retention area, and that is why direct drainage is allowed. Charlie True, of Donald W. McIntosh Associates, Inc. 2200 Park Avenue North, Winter Park, representing the developer, said the City had bought one piece of land for the retention pond. He said the existing lake or pond was an old borrow pit and was a part of the original retention pond for the total project. Member West asked about a time table for the widening of Professional Parkway. Mr. Wagner said he believed 60% of the design has been completed, and it was his guess that it would be about a year before the turning of dirt was begun. Mr. Lewis said it was his understanding that they were planning to move to the Professional Parkway project as soon as they complete the Maguire Road project. WELLINGTON PLACE PUBLIC HEARING PRELIMINARY SUBDIVISION PLAN - CASE NUMBER LS -00 -005 Principal Planner Lewis presented the staff report for the proposed Preliminary Subdivision Plan for Wellington Place. The project will include a total of 38 single family residential lots. The site is located at the southeast corner of the intersection of AD Mims Road and Johio Shores Road. The zoning is R -1AA which requires a minimum lot width of 75 feet and an area of 9,000 square feet. The Plan provides two points of access, one from AD Mims Road and a future connection to the east, anticipating future redevelopment of that property as another single family subdivision. On October 5, 2001, the DRC reviewed the project, discussing at length some outstanding issues which were identified in a DRC staff report. The most significant issues involved how construction activities will be coordinated to protect as many existing trees on the site as possible, given recent tree protection problems on another site. Staff explained their concerns and the Applicant agreed to comply with Staff recommendations. The Committee voted unanimously to recommend approval of the PSP, subject to making the revisions to the plans as discussed in the meeting. All of the DRC requirements have now been satisfactorily addressed in the plan received October 23, 2001. Mr. Lewis concluded with Staff's recommendation for approval of the Preliminary Subdivision Plan for Wellington Place, as date stamped received by the City on October 23, 2001. The public hearing was opened. Randy June, of June Engineering Consultants, Inc., 71 East Church Street, Orlando, 32801, was present to answer questions. As no one wished to speak, the public hearing was closed. Vice Chairman Landefeld asked about the second access. Mr. Lewis explained that it is shown on the plans in the southeast portion of the site. It would connect to the east to property that is currently occupied by single family homes in a large lot development. It is for a future connection when that property is likely to redevelop. 4 Planning and Zoning Commission Regular Meeting November 13, 2001 Member West asked if that property is in the City and Mr. Lewis confirmed it is not in the City at this time. Discussion ensued about the sites where there have been problems with tree protection. Mr. Wagner explained the difficulty and complexity of saving trees in developments. City Commission has given clear direction to save as many trees as possible on all sites, and Staff is putting developers on notice that the City is interested in saving the trees. Member McKey commended Staff, the developer, and the owner for larger lots. Member McKey asked about buffers for corner lots (maintaining 25 feet on each side). Mr. Wagner explained the Code requires that corner lots add a minimum of ten extra feet to their depth. He said in some cases they have decreased the buffer to 15 feet where the corner lots and the homes are back to back. Where homes are facing both streets they maintain the 25 feet. Randy June said on their project they have made corner lots 15 feet wider so they can have the same house pad throughout. Member Patterson asked how the setbacks were handled for flag lots. Mr. Lewis said they try to address any problem situations during the subdivision plan review process. In an extreme flag lot situation, at the time of permitting the building official makes an interpretation of how it should be oriented and where the front setback is, etc. Mr. Wagner said the Code allows for but discourages flag lots. Mr. Lewis said the flag lots have not presented a variance problem for the City in the five years he has been with the City. Member Golden asked Mr. June about notes on the plan concerning trees to be saved or removed and about protection barriers. Mr. June said they will have to consider the project lot by lot and tree by tree as part of their Final Subdivision Plan. He said the barriers will be shown on the Final Plan. Motion carried 7 -0. 5 Planning and Zoning Commission Regular Meeting November 13, 2001 WINDSTONE AT OCOEE - PHASE 1 (FKA CLARCONA CROSSINGS) FINAL SUBDIVISION PLAN - CASE NUMBER LS -99 -016 Principal Planner Lewis presented the Staff Report for the proposed Final Subdivision Plan for Windstone at Ocoee, Phase 1. The project will include a total of 122 single family residential lots, with 58 lots in Phase 1. Phase 2 will be postponed until some details on flood plain issues have been satisfactorily addressed. The subdivision is located on the south side of Clarcona Ocoee Road, between Clarke and Apopka Vineland Roads. The Plan for Phase 1 provides two points of access, one from Clarcona Ocoee Road and one to the existing Sawmill subdivision to the south. As the property has R -1AA zoning, lots will be a minimum width of 75' and a minimum size of 9,000 square feet. Mr. Lewis explained briefly unique issues to be addressed by this subdivision plan. One issue is the fact that the two portions of the subject property are not contiguous (southeastern area adjacent to the Sawmill retention pond). A road connecting the two portions will be provided across the corner of the retention pond tract (owned by the City) to connect the two portions of the subdivision. Another issue is providing access to a landlocked parcel of land adjacent to the southeast corner of the southern portion of the subdivision. That landlocked parcel currently is accessed by a dirt driveway along the eastern edge of the subject property, adjacent to the railroad tracks. In order to continue to provide access to that parcel, the subdivision plan provides a separate tract of land for a private driveway leading to that parcel, located between the rear of the adjacent lots and the railroad tracks. On November 1, 2001, the DRC reviewed the project, discussing at length several outstanding issues which were identified in a DRC staff report. The most significant issues involved how construction activities will be coordinated to protect as many existing trees on the site as possible, given recent tree protection problems on another site. Staff explained their concerns and the Applicant agreed to comply with Staff recommendations. The Committee voted unanimously to recommend approval of the FSP, subject to making several revisions to the plans as discussed in the meeting. Mr. Lewis concluded with Staff s recommendation for approval of the Final Subdivision Plan for Phase 1 of Windstone at Ocoee, as date stamped received by the City on November 5, 2001. 6 Planning and Zoning Commission Regular Meeting November 13, 2001 Chairman Bond said she takes exception to one thing in this Plan. She has real concerns about connecting all the subdivisions to allow cut - through traffic. She said she had observed an increase in traffic cutting through Sawmill to Prairie Lake to Clarke Road. Mr. Wagner said Sawmill was originally planned for four points of access. He said they are meant to disperse traffic out of the subdivision, not to promote traffic through the subdivision. He said they are purposefully circuitous to calm traffic and to keep down cut through traffic. He said the thinking now in transportation planning is that inter - connectivity and dispersion of traffic are good things. He said designing subdivisions which force all the traffic out on to major arterial and collector roads causes traffic tie ups. Mr. Wagner said he did not know why anyone would cut through Sawmill now that Hackney Prairie Road is paved through to Apopka Vineland Road. He said Clarcona Ocoee Road and Apopka Vineland are going to be four -laned shortly and Hackney Prairie Road is paved all the way through. He said when improvements are made to these roads there would be no reason to cut through. Chairman Bond said she thought Hackney Prairie Road was not attracting traffic because it has emulsification rather than paving, has no striping and has rough crossing at the railroad tracks. She said she does not agree with the theory of bringing the traffic into the subdivisions to get it off of the collector and arterial roads. In response to a question by Vice Chairman Landefeld, Mr. Wagner said it is expected that Clarcona Ocoee Road will be four laned in about a year and a half and that the road will have been under construction and will be completed shortly after this project is built out. He said by the time this project is built out, the road will have been under construction and will be completed shortly thereafter. Mr. Wagner agreed that the paving on Hackney Prairie Road is not up to full City standard. He said if the school goes in, it would have to be brought up to standard and over time it will be. He said Apopka Vineland is also scheduled for widening, ultimately, up to Clarcona Ocoee Road, and probably eventually up to Apopka. Chairman Bond said she thought connecting the subdivisions brought traffic in rather than helping to disperse it. Member Golden said he likes the tree protection barriers on this site, placement of the park, and the use of the existing pond. He said he did not have a big problem with the cut - throughs because he thinks the four -lanes will be in before the people will be 7 Planning and Zoning Commission Regular Meeting November 13, 2001 impacted by the short- cutting. He asked if there are things to deter traffic from going through subdivisions. Mr. Wagner pointed out the two parcels are actually unconnected and that is the reason for the connection across the retention pond. He said traffic calming measures include circuitous routes, round - abouts, stop signs, and short street lengths. Member Miller said she agrees with Chairman Bond's views about cut - through traffic. Member West asked why the subdivision name was changed from Clarcona Crossings to Windstone at Ocoee. Mr. June said an official was not pleased with the former name. Member Patterson said she is an advocate of inter - connectivity and commends staff for that approach. Member McKey commended the developer for the larger lots. He said he thought circuitous routing of traffic must work, and he likes inter - connectivity because it allows bikes and pathways in an operational pattern that will work for the majority of the City. Chairman Bond said she understands about inter - connectivity, but she feels it is her responsibility to protect people in the neighborhoods, and she knows how her clients feel. She said if we are going to do it, we need to be consistent in all areas of the City. She said just because it is the way that things are being done does not always make it the best thing for our City. Vice Chairman Landefeld said he agrees with Chairman Bond. In consideration of the effort to improve Clarcona Ocoee Road, Mr. Wagner asked Mr. June if it would be possible to dedicate, or turn over to the City early, the sliver of land in Phase 2 that he was planning to dedicate. Mr. June said he will not own it until they have Phase 2 approved. As had been recommended by Staff, Member West, seconded by Vice Chairman Landefeld, moved that Planning and Zoning Commission recommend approval of the Final Subdivision Plan for Phase 1 of Windstone at Ocoee, Project Number LS -99 -016, as date stamped received by the City on November 5, 2001. Motion carried 7 -0. OLD BUSINESS None. 8 Planning and Zoning Commission Regular Meeting November 13, 2001 OTHER BUSINESS None. COMMENTS Planning Director Wagner commented: • Board members had asked about shirts in the last meeting. He said all departments had cut back their budgets, and there is no money earmarked for that in the budget right now. Member West suggested they should hold off on the shirts for now. • New projects are continuing to come in. • There will be no second Planning and Zoning Commission meetings in November or December, but there will definitely be regular meetings in December and January. • Hope to have the Comprehensive Plan coming to the board in January. Member Golden asked how soon they might receive a draft of the Comprehensive Plan. Mr. Wagner said he will get it to them as soon as they have it, even if it is in a rough draft form.
