BACKGROUND SUMMARY: The ten (10) foot Drainage, Sidewalk, and Utility easement is located on Lots 3 & 4, Slone Landing, recorded in Plat Book 69, Pages 49 & 50. The applicants request the vacation and abandonment of the easement to accompany an application for a vacation of the Orlando Avenue right -of -way adjacent to their lots. One of the applicants, Lloyd Hollingsworth, has proposed to construct a detached accessory structure in the area of the existing Drainage, Sidewalk and Utility Easement. All affected utility companies were notified and staff received letters of no objection from said companies. STAFF RECOMMENDATION: Staff recommends that the Honorable Mayor and City Commissioners adopt a Resolution abandoning and vacating the ten (10) foot Drainage, Sidewalk, and Utility Easement located on Lots 3 & 4, Slone Landing, recorded in Plat Book 69, Pages 49 & 50; subject to the vacation of Orlando Avenue Right -of -Way adjacent to Lots 3 & 4 of Slone Landing. BACKGROUND SUMMARY: The specific area of the right -of -way runs in an East -West direction between Bluford Avenue and Kissimmee Avenue. The request is to vacate and abandon the northern 30 feet of the 60 feet right -of -way lying adjacent to Lots 3 & 4, Slone Landing and Lot 7, Map of Ocoee. Orlando Avenue is classified as a collector road in the Comprehensive Plan. Article 11, Section 153 -14 of the City Code, stipulates arterial or collector streets, or any portion thereof, be heard at a public hearing before the Planning and Zoning Commission for a recommendation to the City Commission. The Planning and Zoning Commission met on Tuesday, December 14, 2010, and voted to recommend the City Commission approve the vacate request. The subject right -of -way is programmed as a future two lane through lane from Bluford Avenue to Kissimmee Avenue on the map for roadways by the year 2020 (see Figure 11 b from Comprehensive Plan). All affected utility companies were notified and staff received letters of no objection from said companies. The subject intersection of Bluford Avenue and Orlando Avenue is defined as a future drainage project in the Wekiva Parkway and Protection Act Regional Master Stormwater Management Plan. A plan to use the area for drainage is in the design phase and can fit into the remaining right -of -way if vacated. The proposed Right -of -Way Vacation Agreement waives any future claims by the property owners to the remaining 30 foot right -of -way lying south of the vacated 30 foot. This will essentially keep the property owners from requesting an additional 15 foot portion at such time the remaining 30 feet is vacated.
