02-08-11 MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, FEBRUARY 8, 2011 CALL TO ORDER Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Campbell, Vice Chair Golden, Member McKey, Member Sills, Member De La Portilla, Member Morris and Member West. Also present were Assistant City Attorney Watson, City Planner Rumer, Principal Planner Fabre and Recording Clerk T. Williams. ABSENT: Member Dillard (AE). CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Wednesday, December 14, 2010. Member Mc Key, seconded by Member West, moved to accept the minutes of the December 14, 2010, Planning and Zoning Commission meeting, Motion carried unanimously. OLD BUSINESS - none NEW BUSINESS VILLAGES OF WESMERE Principal Planner Fabre stated the property location and gave a brief overview of the reason for the amended preliminary/final subdivision plan. City Commission approved the PUD and Future Land Use in November, 2010. The amendment affects the common area space of the existing townhome units and future construction of 178 single - family homes. There will be two construction designs for the single - family homes; rear loaded which will have the garage in the back and overlook a street or park and the front loaded homes will have the garage in the front. DISCUSSION Member McKey inquired if there was a minimum and maximum square footage of projected homes. Principal Planner Fabre stated it is estimated now to be at least 1200 square feet of living space. Vice -Chair Golden inquired as to the performance schedule dates. Principal Planner Fabre responded they are scheduled to start construction by June, 2011 with a certificate of completion no later than March, 2012. Vice -Chair Golden stated he is impressed with the consistent construction type, colors and designs used by the developer to compliment the existing townhomes. Planning and Zoning Commission Meeting February 8, 2011 Public Hearing Opened Chairman Campbell asked Kevin Kramer, representative from the developer to approach the podium for questions. Vice -Chair Golden asked if the developer had met with the existing townhome owners regarding the construction plans. Kevin Kramer advised no meeting has taken place since the PUD was approved but a meeting was held with the residents prior to the PUD approval. The plans have not changed since the approval of the PUD other than subtracting one lot from the construction plans. Member McKey inquired what happened to the parking spaces that have been eliminated from the new plans versus the old plans. Kevin Kramer responded the parking spaces still remain in the townhome area but have been eliminated from the area of the single - family homes to improve the look. The current parking spaces have been restricted to townhome use only. Member McKey inquired how restrictions will be enforced as it pertains to boats and other vehicles being in the front yards of the single family homes. Kevin Kramer responded the community is governed by deed restrictions. Member McKey inquired as to the fencing revisions. Kevin Kramer responded any fencing conditions that were revised more than likely is for the single - family homes, not the townhomes. City Planner Rumer explained canned conditions of approval that may not necessarily comply with single - family homes in a subdivision and that some conditions may be listed that do not apply. Vice -Chair Golden inquired if any marketing of the units have taken place. Kevin Kramer stated it is difficult to determine satisfaction without an operational model home available for viewing. They have built in other locations and have had great success with sales. City Planner Rumer stated they have rushed reviews so the developer can keep up their commitment to the residents and abide by the construction schedule. Public Hearing Closed Member McKey stated he thinks once built it is going to be a great community and welcomes the development in the area. Vice -Chair Golden, seconded by Member West, moved to recommend approval of the Amended Preliminary /Final Subdivision Plan based upon staff recommendation for approval. Motion carried unanimously. MISCELLANEOUS City Planner Rumer welcomed the five members that were reappointed to the Planning and Zoning Commission. He advised the board that they have received applications for two parcels included in the CRA. The preliminary subdivision plan has been received for what they are calling the Darren Center, the application and land use plan for the parcel across from Health Central. Staff will conduct a rush review for CRA projects and plan to have these items before the commission at the next meeting. City 2 Planning and Zoning Commission Meeting February 8, 2011 Planner Rumer further advised the board that Bobby Howell is no longer employed by the city due to economic restraints.
