05-01-12 MINUTES May 1, 2012, at 7:15 P.M. REGULAR CITY COMMISSION MEETING A. CALL TO ORDER Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission Chambers of City Hall. Commissioner Keller gave the invocation, followed by the Pledge of Allegiance to the Flag, led by Resident William Maxwell. Acting City Clerk Sibbitt called roll and declared a quorum present. Roll Call: Commissioner Hood, Commissioner Wilsen, Mayor Vandergrift, Commissioner Johnson, and Commissioner Keller. PRESENTATIONS AND PROCLAMATIONS Proclamation — Building Safety Month — May 2012 Commissioner Johnson, on Mayor Vandergrift's behalf, announced and proclaimed May 2012 as Building Safety Month. COMMENTS FROM CITIZENS/PUBLIC - None D. STAFF REPORTS AND AGENDA REVIEW City Manager Frank made the following reports: 1) The Ocoee Police Department will be sponsoring the Handgun Safety Class on Saturday, May 19, 2012, from 8:00a.m. to 1:OOp.m. This is a free handgun safety class taught by Ocoee Police Officers. 2) The Ocoee Police Department will also be sponsoring a free, one time, three -hour presentation on self - defense and safety awareness for women on Thursday June 14, 2012, from 6:OOpm to 9:OOpm. The class is taught by Ocoee police officers using the National Self- Defense Institutes' S.A.F.E. curriculum. If interested, contact Officer Teddy Levin at 407 - 905 -3160 ext. 3024. 3) The City of Ocoee Parks and Recreation Department will be hosting its annual Big Orange Games on Saturday, May 5 at the Ocoee High School Football Field. Opening ceremonies will be held at 9:15 a.m., and the games will begin at 9:30 a.m. 4) The Ocoee Family Aquatic Facility will open for the 2012 season on Saturday, May 5th starting at 11:00 a.m. 5) The Parks and Recreation Department is accepting registrations for its Summer Camp Program. Registration is open for all resident and non - resident children ages 5 to 14 City Commission Regular May 1, 2012 6) The Ocoee Fire Department will be providing a Heartsaver CPR/AED class. The cost of t the class is $25, and you will receive a nationally recognized American Heart Association CPR card which is good for two years. The class will be held at Ocoee Fire F Station 25 on May 9, 2012. The class starts at 1:00pm and will be approximately 3 hours 1 in length. Mayor Vandergrift briefly commented that he noticed the advertisement for the Big Orange Games is on the city's, but under the Parks and Recreation webpage. He inquired as to why it was not on the main page of the website. He further mentioned that he also noticed it was an invitational event and was not sure as to why. Mayor Vandergrift further invited everyone to please come out and support the games. E. COMMISSIONERS ANNOUNCEMENTS Commissioner Hood— None Commissioner Wilsen — None Commissioner Johnson- inquired if the Safety Gun Classes were still being offered. He was advised that the next class is scheduled for May 19 from Sam -lpm. Commissioner Johnson advised Police Chief Brown that he had three names he would like to give him to register for that , class. Commissioner Keller — None Mayor Vandergrift — None F. CONSENT AGENDA Commissioner Keller, seconded by Commissioner Wilsen, moved to approve the Consent Agenda Items #1 through #8. Motion carried 5 -0. 1. Approval of Minutes for the Regular Commission Meeting Held April 17, 2012. (City Clerk Eikenberryl Approved on Consent. Motion carried 5 - 0. 2. Appointments to the Board of Adjustment. (City Clerk Eikenberry) The three -year term of Bob Colburn and Robert Cadle ends May 2012. Mr. Cadle was recently moved from an alternate member position to a regular member position by the Commission on January 17, 2012. Both members have indicated their willingness to serve another term, if reappointed. There is also one regular member position and two alternate member positions currently open for the board. One application, from resident Edward Wrobel, was submitted for consideration of being appointed to serve the vacant regular member position. Approved on Consent. Motion carried 5 -0. — Page 2 City Commission Regular May 1, 2012 3. Approval of Edward Byrne Memorial Justice Assistance Grant (JAG) FY 2012 Application 2012- H1955- FL -DJ. (Police Chief Brown) Based on FBI Uniform Crime Reports, $12,628.00 has been made available for the City of Ocoee Police Department through the Edward Byrne Memorial Justice Assistance Grant (JAG). With this money, staff recommends the purchase of two (2) digital portable radios and fourteen (14) batteries to maintain compliance with an agreement made between all agencies in Orange County, Florida, as well as Federal mandates to be digitally ready by the year 2012. In order to maintain compatibility and interoperability with Motorola radios currently utilized by the Orange County radio users group, Motorola radios must be purchased. Motorola is a sole source provider for these radios and offers only the State of Florida contract pricing. Approved on Consent. Motion carried 5 -0. 4. Approval of Bulk FuelQils, and Lubricant Purchases. (Public Works Director Krug) The City has purchased bulk fuel, oil and lubricants via piggy - backing off of an Apopka contract since 2009. The Apopka contract has expired and is no longer an available option for the City's use. The City is a member of the Central Florida Purchasing Cooperative (CFPC) where Orange County is the lead agency in solicitations that can benefit multiple municipalities. The City has utilized this purchasing power in the past for petroleum products and requests Commission approval to utilize the following: • Petroleum Traders Co. for E -10 87 octane unleaded gasoline. Bulk transport loads delivered to the Public Works complex fuel depot (8,000+ gallons). • Mansfield Oil Co. for diesel fuel. Bulk transport loads delivered to the Public Works complex fuel depot (7,000+ gallons). • On -Site Fuel Service, Inc. for E -10 87 octane unleaded gasoline and diesel fuel. Tank wagon loads delivered to remote sites throughout the City (Under 8,000 gallons gasoline, Under 7,000 gallons diesel fuel). Orange County also secured contract Y12- 121 -JS for Bulk Petroleum Products with Lynch Oil. This contract was not solicited through the CFPC, but can be piggy- backed onto with Commission approval. Approved on Consent. Motion carried 5 -0. 5. Approval of Wastewater Treatment Plant Mixer Motor and Gear Box #1 and #31 Replacements. (Utilities Director Smith) - The City of Ocoee Wastewater Plant utilizes I. Kruger's BioDenitro process to remove BOD (biological oxygen demand) through two parallel oxidation ditches (concrete conical tanks), working in alternating oxic and anoxic phases. To accomplish the oxidation of the BOD, raw sewage is fed into the tanks and circulated around their perimeter. As treatment levels are reached, flows are discharged to another treatment process. To circulate the flow, each tank has two mixer units which include a motor, transmission and a turban screw. The Utilities Department has scheduled one mixer from each tank to be rehabilitated in this fiscal year within its "Wastewater Treatment Plant Ten Year Maintenance Schedule ". The existing, originally equipped mixer has a 9.0 HP motor, and operates at a degraded efficiency from when it was originally put into service (40.0 %). Kruger now has a newly designed mixer with improvements to its motor (5.6 H.P) and turban screw. The improved mixer operates at an efficiency of 56.0 %, 40% higher than original operating efficiency of the existing mixer. The redesigned turban screw produces a more balanced laminar flow regime, leading to higher treatment levels and more efficient scouring (cleaning) of the tank. The older mixer has limited parts availability. Based on a mixer being in operation 7 hours a day, replacing the mixers would lead to an annual savings of 8687 kilowatt- hours, and the new mixers' more even flow would lead to higher treatment levels. Approved on Consent. Motion carried 5 -0. Page 3 City Commission Regular May 1, 2012 6. Approval of Rehabilitation of Lift Station #16. (Utilities Director Smith) Included in the Utilities Department's "Lift Station Ten Year Maintenance Program" schedule is the rehabilitation of Lift Station #14 for Fiscal Year 2012. At issue with the rehab was the change out of two Pump -X brand pumps and their associated hardware. Pump -X is no longer in business and parts are no longer reliably available. Lift Station #16 also utilizes Pump -X pumps and is a more critical facility. Therefore, staff recommends switching the two stations in the maintenance program, by moving station #16 to Fiscal Year 2012, and station #14 to Fiscal Year 2019. The two Pump -X pumps from station #16 will be salvaged, cleaned and shelved, so as to be backups until Lift Station #14's rehab. In addition, utilizing the scheduled resources, staff is recommending the wet well for Lift Station #16 be recoated using GML (Green Monster Liner Coatings, LLC), a polyurea material which is the City's specified standard. Approved on Consent. Motion carried 5 -0. 7. Approval of Sanitary Sewer Collection System Inflow and Infiltration Study with Reiss Engineers Inc. in the amount of $49,150.00. (Utilities Director Smith) The City of Ocoee Wastewater Treatment Plant has experienced increased influent flows during the wet weather season. Wet weather flows are usually prolonged and steady thorough out the system and are generally caused by a higher- than- normal water table, leading to the groundwater leaching into the system through pipe joints, sewer laterals and structures. Likewise, a high intensity/short duration rainfall event, especially exacerbated in wet weather season, can lead to localized flooding which results in sewer collection facilities being inundated with water. The inflow from the flooding is more intense, short in duration and can be problematic. To ensure the City's wastewater system is properly maintained and operated, Staff is recommending a systematic review of its sewer system by way of I &I (inflow and infiltration) studies. The first study staff recommends will cover the areas that contribute flows to lift stations #10 and #12. Lift station #10 includes the auto auction and industrial area along Enterprise Street. Staff will utilize the services of Reiss Engineering, Inc., the City's hydraulic modeling and engineering planning consultant to map, perform invasive -smoke testing, measure flows in inverts of structures, and determine baseline flows (dry weather) and wet weather flows. The consultant will recommend and attend the televising and recording of underground pipe and facilities. The deliverable for the study shall be a report of findings which identifies issues and recommended corrections, prioritized. Approved on Consent. Motion carried 5 -0. 8. St. Johns River Water Management District Water Conservation Cost -Share Grant. (Utilities Director Smith) a) Approval of Water Conservation Cost -Share Grant. The St. Johns River Water Management District would like to partner with the City of Ocoee to study, develop, implement and track innovative water conservation initiatives that are achievable by using the City's technologically advanced smart water metering system. SJRWMD will partner with the City by providing a matching grant in the sum of $66,184, with the City's matching portion being the replacement of the existing water meters with smart meters in the Admiral Pointe, Sleepy Harbor, Veronica Place, and Hidden Oaks neighborhoods (total of 388 homes). The grant also will call for staff to study, track and analyze, and work to implement conservation initiatives that will lead to water savings. Staff anticipates the utilization of the City's C.U.P. consultant in the study and tracking efforts. The grant will cover consulting professional services, tracking software including training, and dedicated computer hardware. The study will begin in June 2012 and should last eighteen months. Approved on Consent. Motion carried 5 -0. Page 4 City Commission Regular May 1, 2012 b) SMW GeoSciences, Inc. Assistance for St. Johns River Water Management District Water Conservation Cost -Share Grantmominnaha The City shall receive, if accepted by City Commission, a water conservation grant in the amount of $66,184 for the study, tracking, and eventual City-wide implementation of conservation initiatives utilizing the City's smart water metering system in the Admiral Pointe, Sleepy Harbor, Veronica Place, and Hidden Oaks neighborhoods (totaling 388 meters). Staff recommends utilizing the services of SMW GeoSciences, Inc. in the City's study efforts. Approved on Consent. Motion carried 5 -0. G. PUBLIC HEARINGS 9. Arden Park PUD — Variance to the Sign Code. (Advertised in the West Orange Tunes on April 19, 2012). (City Planner Rumer) The applicant, Standard Pacific Homes, is requesting a variance to permit twelve (12) temporary subdivision development signs on the Arden Park property as part of a marketing plan. The land development code permits two signs not to exceed 128 square feet. Standard Pacific is requesting the variance with the belief that the proposed signage and layout will complement their marketing plan. The Board of Adjustment met on April 19, 2012, and voted 4 -0 to recommend the City Commission approve the requested variance consistent with staffs recommendation for the following conditions: 1. Four (4) signs located on the North/South portion of Clarcona Ocoee Road. 2. Eight (8) signs located on the East/West portion of Clarcona Ocoee Road with four (4) on the Arden Park North property and four (4) on the Arden Park South property. 3. Signs must be separated a minimum of 300 linear feet. City Planner Rumer advised that the issue being presented tonight is should the commission approve the variance request by Standard Pacific Homes to Article VIII, 8 -6L, allowing the installation of twelve (12) subdivision signs instead of the two (2) permitted by code. He further advised that Standard Pacific Homes is requesting this variance to complement a marketing plan for a higher -end subdivision. City Planner Rumer said under the economic conditions, staff has relaxed some of their sign criteria but wanted this to go through the variance process since there are other active subdivisions, and the city didn't want to set a trend. If other subdivisions decide to come forward, staff can now make sure they require a more classy and non - cluttered signage. City Planner Rumer said in working with the applicant, they have committed to providing four (4) signs located on the north/south portion of Clarcona Ocoee Road and eight (8) signs located on the east/west portion of Clarcona Ocoee Road with four (4) on the Arden Park North property and four (4) on the Arden Park South property. The signs must be separated a minimum of 300 linear feet. Staff is in support of this variance request. Mayor Vandergrift inquired if they were temporary signs until they built out. City Planner Rumer advised they are temporary signs. He further advised the portion of the signs on the North/South section of Clarcona Ocoee Road should come out once they construct the alignment of Clarcona Ocoee. Mayor Vandergrift further inquired if all signs would be on their property. City Planner Rumer said all signs will be on their property and not on the right of way. Commissioner Hood advised that his only concern is around the curve coming from Ingram Road, if a person is travelling east or west that the sign is not in the sight view. Mayor Vandergrift opened the public hearing. As no one wished to speak, the public hearing was closed. Page 5 City Commission Regular May 1, 2012 Commissioner Keller inquired if there was any requirement that half the signs be on one side of the road and the other half across the street since the applicant has property on both sides of Clarcona Ocoee. City Planner Rumer confirmed by saying `yes'. He added that they will have four (4) signs on the south side along Arden Park South and four (4) signs on the East /West section. Commissioner Keller further inquired if a timeline should be made for the signs, or was there already a timeline indicating when the signs should be taken down. City Planner Rumer advised when they construct the subdivision wall and overstated landscaping, then the signs will be removed since they cannot be located in the right -of -way. Commissioner Keller inquired if that timeline was in the agreement. City Planner Rumer advised the code does not give a time limit, but staff can advise them. Commissioner Keller inquired from the City Attorney if the motion could state a time limit for the signage. City Attorney Cookson advised that they can require a time limit as a condition of approval. He further advised the Board of Adjustment set certain conditions as well, and the commission can add to that recommendation a timeline as part of their motion. Commissioner Johnson briefly commented that he feels some leeway should be given to the developers since they are putting so much money into this development. He further added that if complaints are made regarding the signage, then they can be addressed them as they occur. A brief discussion ensued on the time limit for the signage. Commissioner Keller, seconded by Commissioner Hood, moved to approve the Arden Park PUD variance request pursuant to staff's recommendation with the addition of a 24 -month timeline and automatic renewal of the timeline unless contacted by the City. Motion carried 5 -0. Steven Polocheck, representative of Standard Pacific Homes, thanked the City Commission, city staff, and city residents for the opportunity to engage in what they feel will be a significant marketing campaign. H. REGULAR AGENDA - None I. STAFF ACTION ITEMS J. COMMENTS FROM COMMISSIONERS Commissioner Hood— reminded everyone about the Ocoee Lion's Club Golf Tournament this Saturday, May 5 He advised he would not be able to make it due to a baseball game in Maitland. Mayor Vandergrift added that if you are not able to make it to the golf tournament, please go out to the Big Orange Games which are also on Saturday. Commissioner Wilsen — None Commissioner Johnson- None Commissioner Keller — 1) said he knows they have talked about this before, but he was wondering about the signs for the commissioner parking in the front of city hall. City Manager Frank said they are open to suggestions, but staff is trying to come up with something that will look nice. Mayor Vandergrift advised he did not need a sign because he gets in early enough -- Page 6 City Commission Regular May 1, 2012 ;Rq ,iftZ that he does not have to worry about finding a parking spot. 2) advised that Spring Lake Elementary School will be looking very nice. He attended the meeting yesterday with the school board. He further advised his only frustration with the school board was that they waited until the school was 30% completed to get feedback which makes it now too late for changes. Mayor Vandergrift 1) announced that the Garden Community Choir will have a concert on May 19 at 4:00 pm at First United Methodist Church in Downtown Orlando. The cost will be $10 and the theme is Songs of America. Tickets can be purchased at the door or on their website at gardencommunitychoir.org. 2) announced that he has requested for years to have City of Ocoee flags hung throughout the community, to the extent of the flag pole located outside city hall. Mayor Vandergrift said without objection he would like for staff to bring back an estimate for half a dozen City of Ocoee flags so they can hang up throughout the community on special days. City Manager Frank asked if it could also be requested that money be taken out of contingency to put three poles up instead of having the three flags on one pole in front of city hall. Mayor Vandergrift said that could be staff's recommendation when they come back to the commission with costs. City Attorney Cookson apologized for the false alarm on the special session that was called earlier today and advised that a closed session meeting will take place next Commission Meeting on May 15 at 6 p.m. The closed session is being called so they may get an update and direction on the lawsuit related to the red-light lawsuit.
