01-22-2013 Minutes CODE ENFORCEMENT BOARD MINUTES JANUARY 22, 2013 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:02 p.m. in the Commission Chambers at City Hall. Alt. MemberCarrington led the invocation and Member Blynder led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Members Blynder, Kelley, Osborne, and Alt. Member Carrington. Also present were Asst. Support Services Director / Code Enforcement Manager Doug Gaines, Code Enforcement Officers Edward Loeffler, Carmen Delgado and Robert Siegrist; Administrative Assistant Bridgett Ballard, Board Attorney Mary Sneed, and Recording Clerk Stella McLeod. ABSENT: Vice-Chairman Lowery andMember Amey were absent excused. GUESTS: None. Administrative Assistant Ballard administered the oath to the code enforcement officers and to anyone intending to speak regarding a case. Unsanitary conditions affecting the health, safety and welfare of the public and occupants. No electrical or water utilities required to meet sanitary and occupancy-related ordinances: No connection to legal, approved source of potable water and electrical service supply required for sanitary operation of waste system, hot and cold water supply, potable water supply, and mechanical perishable food storage. Wrecked, cut-up sport utility vehicle hulk, chassis and parts in the unfenced open access front yard, visible from street and from Ocoee Middle School. Vehicle hulk creating a danger and nuisance to the public health, safety and welfare. Misc. junk, debris littering the property. Officer Loeffler presented the case and gave its history. Photos were presented as exhibits. As of today the property is in compliance with 108-24D, 108-22, 108-19F(d), 115-3, 108-35. The property remains in violation of 108-19 A &C. Asst. Support Services Director / Code Enforcement Manager Doug Gaines stated that the finance department and the city manager’s office are requesting of a notarized letter from the property owner that declares that the occupants are authorized to occupy the property. The letter must be notarized. The board chairman called Mr. Benjamin Pope to give testimony about the case. Mr. Benjamin Pope , 6 E. Delaware Street, Ocoee, FL, addressed the board. He explained that he was Mr. Pope renting from Mr. Thomas Ison, Jr. A month later met Mr. Ison's mother, Ms. Patricia Breeze, Mr. Pope when Mr. Ison was hospitalized. Mr. Ison subsequently died. testified that he paid Ms. Breeze Page 2 Mr. Pope rent and received a receipt from her. He stated that he also has a lease signed by Mr. Ison. said that he does not understand why he cannot get the utilities turned on despite, in his view, having met the requirements. Alt. Member CarringtonMr. Pope asked when Mr. Pope paid Ms. Breeze. answered that he paid her in Alt. Member Carrington November [2012]. asked if there was electricity running to the property at that Mr. Pope time. answered 'Yes'. The chairman called Ms. Breeze to testify. Ms. Breeze , 817 Chicago Avenue, Ocoee, FL, testified that her son said that he took a substance that he got Ms. Breeze from Mr. Pope and became ill as a result. added that her son said they were smoking something really bad in the house. She said Mr. Pope took a notarized leased, signed by her son according to Mr. Pope, to the City. She presented a copy of the letter to the board. She requested that the board look at the signature. Ms. Breeze reported that Mr. Pope is now renting out Mr. Ison’s room. She testified that the signature on the lease does not look like her son’s signature, and that Mr. Ison was paranoid about signing anything for Ms. BreezeMs. Breeze that house. believes, therefore, that the signature on the lease is a forgery. added that Mr. Pope had been evicted from a place in Winter Garden prior to coming to Ocoee. She said that she does not want the water turned on; she wants him off of the Delaware Street property. Member Osborne explained that the code enforcement board can only deal with the code violation matter. Officer LoefflerBoard said that the City is requesting a reasonable time frame to get the water turned on. Attorney Sneed advised the board that their question is whether or not there a code violation. If they find that there is a violation, she continued, they must then determine what constitutes a reasonable time for compliance. Alt. Member Carrington clarified that the only issue of compliance would be the water being turned on. Officer Loeffler confirmed that the water being on would constitute compliance, but the water being off is non-compliance. Further discussion ensued. Alt. Member CarringtonMember Kelley , seconded by , moved that in Case #13-002 the respondents be found in violation of 108-19A & C as cited as of January 13, 2013 and be given until Friday, January 25, 2013, to come into compliance or be fined $150 per day, per violation for each day the violation remains in non-compliance. The motion carried unanimously. Mr. Pope asked to address the board. He said that he had already given the City $80 as a deposit for the Chairman Godek utilities; he wanted to know what else was needed. reminded him that the notarized th letter was needed by the 25 of January. Mr. PopeBoard Attorney Sneed asked if he had not already presented such a letter. responded that conflicting evidence had been presented to the board which included the decedent’s driver’s license and social security card which both offered signatures. She added that the board compared the documents to the Attorney SneedMember signature on the notarized letter. concluded that the board’s finished motion . . . Kelley interjected that the board attorney should not speak for the board. He added that the board members Page 3 Member Kelley are neither lawyers, nor handwriting experts. continued that the board voted on the code violation. The attorney responded that the letter was the respondent’s defense. If the member believed the Member Kelley letter to be valid, she questioned, why did he find the respondent in violation? answered that he did not find the respondent in violation. He found the property in violation because it is [in violation]. Mr. PopeChairman Godek asked what his next step would be. reiterated that he needs to get a notarized Member Osborne letter to the City. answered that the board could not help him with that matter and Officer Loeffler referred him to the water counter in City Hall. added that the board is not in a position to answer questions about the restoration of his water service; he continued that they [the board] have given th Mr. Pope until the 25 of the month to figure it out. Ms. Breeze declared that she took the Customer Service Supervisor Cathy Sills (at the water counter in City Hall) a letter of representation for the estate which gives Ms. Breeze authority as the tenant. Mr. Pope needs a letter from her, she added, but she will not give Mr. Pope the letter. Chairman Godek cautioned the respondent if she commits the violation again she will be a repeat violator which could subject her to fines up to $250 per violation, per day.
