07-23-2013 Minutes CODE ENFORCEMENT BOARD MINUTES JULY 23, 2013 CALL TO ORDER Chairman Robert Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Vice - Chairman Lowery gave the invocation, and Member Amey led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice - Chairman Lowery and Members Amey and Blynder. Also present were Asst. Support Services Director - Code Enforcement Manager Doug Gaines, Code Enforcement Officer Robert Siegrist; Administrative Assistant Bridgett Ballard, Board Attorney Mary Sneed, and Recording Clerk Stella McLeod. ABSENT: Members Carrington, Kelley, and Osborne were absent /excused. GUESTS: None. Administrative Assistant Ballard administered the oath to the code enforcement officers and to anyone intending to speak regarding a case. It is a repeat violation referencing the previous case, #12 -123, heard at the August 28, 2012 meeting. Exhibits (photos) were presented. As of this evening's meeting date, the property remained non - compliant. Chairman Godek asked if the same three names had appeared on the previous violation. The officer confirmed the same. Vice - Chairman Lowery asked about the `n/a' that appeared where compliance date should be. Officer Siegrist said that this was because it was a repeat violation. The officer's observation date of the repeat violation would be the date to use according to Board Attorney Sneed. Member Amey asked if someone lived in the house. Officer Siegrist answered `no'. Member Amey asked about the first violation. Officer Siegrist answered that it was brought into compliance, but the property has fallen back into disarray. Chairman Godek said that the board had a choice of giving a daily fine or one mass fine. Board Attorney Sneed advised that the board can impose a penalty from the date that the officer observed the repeat violation (June 17 Member Amey, seconded by Vice - Chairman Lowery, moved that in Case #13 -067, the respondent be found in repeat violation as cited as of June 17, 2013 and that the respondents come into immediate compliance and be fined $125 per day beginning June 17, 2013, and lasting until compliance is reached. Motion carried unanimously.
