The Downtown — Western Transmission Main Project scheduled for construction the summer of 2015, routes a 20" transmission main in the Wurst Road right -of -way under said improvements. Thus for mutual benefits to both parties, SB Ocoee FDS constructed the portion of the pipeline under said improvements and the City agreed to reimburse SB Ocoee FDS cost of the installation. City Commission approved the reimbursement at is August 5, 2014 meeting in the amount of $22,267.00 and the work was completed the fall of 2014. Stephens Barrios, LLC is the primary operating company, which oversees Barrios Engineering, LLC. SB Ocoee FDS, LLC. Barrios Engineering, LLC. is a design firm for civil engineering projects such as Family Dollar. Occasionally, Stephens Barrios, LLC. Creates limited liability corporations for specific purposes with limitation in life (less than 1 yr.) An example was the creation of SB Ocoee FDS, LLC used in the development of the Family Dollar Store. Due to the nature of these specific purpose entities (SPE's), liability insurances are limited in scope and magnitude, insuring individually for a specific project. Thus Stephens Barrios LLC. Is requesting the reassignment to the parent company, which maintains insurance levels consistent with City requirements. Issue: Should the City reassign the contracting of reimbursement of 200' of 20" Forcemain constructed with Dollar General Development from SB Ocoee FDS, LLC to Stephens Barrios, LLC. In the amount of $22,267.00? Recommendations: The Utilities Department recommends the reassignment of the reimbursement for the construction of 200' of 20" forcemain, which is a portion of the Downtown — Western Transmission Main Project from with SB Ocoee FDS, LLC. Department Director: � 4' 7 Contact Number: (407) 905 -3100, ext. 1504 City Manager: Subject: Contract with SB Ocoee FDS, LLC to install a portion of the Downtown Sew r System Project as a part of the Family Dollar project (District 1 — Commissioner John Grogan) Background Summary: SB Ocoee FDS, LLC is developing the Family Dollar Store on Wurst Road. As part of that development, they are constructing a right turn lane into a combined driveway to the Family Dollar and the adjacent Kangaroo Express service station. The engineer for the development was employed by the City to design the portion of the new Downtown Sewer System to be run from the Family Dollar Store east to the A.D. Mims Road Wastewater Treatment Facility (WWTF). The design of the force main shows the pipeline being planned to go along the southern side of the road right - of -way. That portion of the new force main in front of the Family Dollar Store could go under the planned turn lane to be constructed by Family Dollar. Family Dollar is responsible for the building of the turn lane, so the City looked at having SB Ocoee FDS, LLC install that short portion of the pipeline under the turn lane. The attached proposal is the cost associated with the installation of approximately 200 linear feet of 20 inch force main. The costs do not include any work associated with the construction of the turn lane and does not include any mark -up by the developer. While the costs per linear are slightly higher, it is because of the small amount of pipe being installed. Staff feels that these costs are representative of the nature of the project. The proposed cost for this portion of the force main is $22,267.00. The remainder of this portion of the project will be brought to the City Commission in the near future upon permitting of the railroad crossing. The larger portion of the Downtown Sewer System project is in the process of securing consulting engineering services at this time. That design proposal will be brought to the City Commission next fiscal year. Issue: Should the City contract with SB Ocoee FDS, LLC to install a portion of the Downtown Sewer System pipeline as a part of the Family Dollar project? Recommendations: The Engineering and Utilities Department recommends that the City Commission approve contracting with SB Ocoee FDS, LLC to install approximately 200 linear feet of 20 inch force main to be installed under the to be constructed turn lane for the Family Dollar Store and authorize staff to proceed through the Purchase Order process to complete the work.
