A tentative listing was given to all departments allowing an opportunity to request any items meeting their departmental needs; all requests for transfer were approved by the City Manager, and removed from the surplus list. Background Summary: Staff has successfully used Gideon Auctioneers for previous surplus sales. Staff requests the approval of the City Commission to contract George Gideon Auctioneers, Inc. for the public sale of the City's surplus property. These items are identified on the list as ID Code "G". With Gideon performing online and onsite auctions,this action will present the City with the opportunity of a larger coverage area and would alleviate the overtime costs incurred in conducting the auction in-house. The City has had good results in the past with Gideon, and found the dollar amount received for items sold by Gideon to be comparable to those sold by the City or EBay. The surplus items will be delivered to the Gideon property located at 2753 N. Hwy. 441, Zellwood, FL 32798. Gideon performs governmental auctions the third Saturday of each month; therefore,the next available auction will be held on September 19, 2015 at 9:00 a.m. The auction will be advertised in the Orlando Sentinel, the West Orange Times, and the City's Internet site. The City would be piggybacking on Osceola County's contract for Auctioneer Services, #RFP-11-2150-LM, which is good through August 20, 2016, but may be extended by the County. Gideon would receive 10% commission on all titled items (vehicles), and 12% on all non-titled items. Any items that do not sell would be listed on the next scheduled auction day. There are two (2) garbage trucks and one (1) recycling truck with reserve pricing on the surplus list; if the garbage trucks do not sell for the reserve amount, then other selling options will be explored by Staff and brought back to the City Commission for approval. A detailed report of all items sold and their respective amounts will be forwarded to the City along with payment within(10)ten business days of the auction. Recommendations: Staff requests that the City Commission: 1) Declare the items listed as surplus property; 2) Approve George Gideon Auctioneers Inc. for the public sale of the City's surplus property, and authorize staff to piggyback on Osceola County's contract with George Gideon Auctioneers, and authorize execution of the agreement between the City and George Gideon Auctioneers by the Mayor and City Clerk for the current term through August 20, 2016, plus any additional extensions as may be provided by the Osceola 1 County contract. 3) Approve the date of the City's auction with George Gideon Auctioneers Inc. as September 19, 2015 at 9:00 a.m. Attachments: 1. All records stored electronically must be provided to the COUNTY in a format that is compatible with the information technology systems of the county. e. If the CONTRACTOR does not comply with a public records request, the COUNTY shall enforce the contract provisions in accordance with the contract. 3. The Agreement is hereby amended to add the following: SECTION 31. EMPLOYMENT ELIGIBILITY VERIFICATION(E- VERIFY) In accordance with State of Florida, Office of the Governor, Executive Order 11-116 (superseding Executive Order 11-02; Verification of Employment Status), in the event performance of this Agreement is or will be funded using state or federal funds, the CONTRACTOR must comply with the Employment Eligibility Verification Program ("E-Verify Program") developed by the federal government to verify the eligibility of individuals to work in the United States and 48 CFR 52.222-54 (as amended) is incorporated herein by reference. Notwithstanding anything set forth in any section, article or paragraph of this Agreement to the contrary, nothing in this Agreement shall be deemed as a waiver of sovereign immunity or limits of liability which may have been adopted by the Florida Legislature or may be adopted by the Florida Legislature, and the cap on the amount and liability of COUNTY for damages, attorney fees and costs, regardless of the number or nature of claims in tort, equity or contract, shall not exceed the dollar amount set by the Florida Legislature for tort. 2 Rev 09/13 Nothing in this Agreement shall inure to the benefit of any third party for the purpose of allowing any claim against the COUNTY which would otherwise be barred under the Doctrine of Sovereign Immunity or operation of law. The person or individual identified by the CONTRACTOR to serve as its Project Manager for this Agreement, or any replacement thereof, is subject to prior written approval and acceptance of the COUNTY. If the COUNTY or CONTRACTOR replace their current Project Manager with another individual, an amendment to this agreement shall not be required. Scone of Services—General a) The AUCTIONEER shall provide for online and live auction services for the COUNTY's surplus properties identified by the Osceola County Property Control Section of the Comptroller's Office on an as-needed basis in accordance with the Florida Statute Chapter 274 and the Florida Administrative Code Chapter 69I requirements governing the disposition of property. b) Osceola County Property Control Section will coordinate the collection of all surplus items and identify each location where surplus items are stored for pickup by the AUCTIONEER. c) Osceola County Property Control Section shall email or fax the list of items for auction along with pertinent data. d) Osceola County Property Control Section shall assist the buyers in inspection and removal of items in coordination with the AUCTIONEER. 2. The AUCTIONEER shall provide the following services at minimum: a) Verify inventory and each property on list provided by the Osceola County Property Control Section; b) Market surplus property to prospective buyers; c) Photograph and catalog each surplus property for sale; d) Maintain a database of all bidders and buyers; e) Manage all communication with prospective bidders and buyers; f) Coordinate the removal of the property from designated locations within the Osceola County district of all sold properties with the buyer; g) Collect all proceeds generated from sale; and, h) Create and provide a detail report of sales, to include supporting documentation for audit. 3. Party of Interest to the AUCTIONEER's Agency a) The AUCTIONEER's family members, employees or any party of interest to the AUCTIONEER's agency shall not bid and buy any surplus property collected 6 Rev 09/13 from the COUNTY for auction. 4. Auction Schedule a) The AUCTIONEER shall conduct the COUNTY's auctions on the third (3rd) Saturday of each month. 5. Vehicle Titles a) The AUCTIONEER shall transfer all vehicle titles to the new owner to ensure the COUNTY is removed from the ownership of the vehicle as per Florida Department of Motor Vehicles(FLDMV)standards. b) The COUNTY shall mail the titles to the AUCTIONEER. 6. Advertisement of Auction a) The AUCTIONEER shall advertise COUNTY's auctions each month, through a brochure mailing, selected local and statewide newspaper advertising, and with national and regional advertising(when warranted). b) Auction Schedule and Sale Inventory: The Auctioneer shall list the COUNTY's auction schedule and sale inventory on the company's website and on internet bulletin boards for easy access to buyers and bidders. 7. Electronic Data Reports a) For every sale,the AUCTIONEER shall send an electronic data report to Osceola County's Property Control Section outlining COUNTY's auction sales information. The sales information shall be sent in a Microsoft file and downloaded into Microsoft Excel. b) One (1) week prior to the COUNTY's auction, the AUCTIONEER shall enter inventory information into a report and assign categories for each department. The AUCTIONEER shall code the COUNTY's items for applicable taxes, asset numbers and tracking numbers. c) The electronic data reports shall be provided to the COUNTY as scheduled in advanced and include the following: i. Buyer Catalog Report: This report is a short listing of each COUNTY's auction lot to be sold and listed in lot number order. ii. Clerk Sheets Report: This report is a record of lot sales price and buyer number. iii. Buyer Invoice Report: This report is for the Auction buyer and contains the following: 7 Rev 09/13 o Buyer's name; o Buyer's address; o Buyer's phone number; o Auction date; o Invoice number; o Auction lots purchased; o Lots purchased description; o Buyer's sale total; and, o Buyer's sales tax(if applicable). iv. Auction Sales Recap Report: This report captures the auction sales total, both taxable and non-taxable, along with State of Florida sales tax collected. v. Buyers/Bidders Report: This report includes all registered bidders to include the total purchases, their address, phone number, and e-mail address. vi. Sales Tax Report: This report is of the auction sales total,both taxable and non-taxable,along with State of Florida sales tax collected. vii. Lot Recap Report: This report includes each lot, who purchased it, and how much it sold for, with a description of the lot, and the COUNTY's tracking numbers. viii. Consignor Report: This report includes lots with sales price and buyer number broken down by each department(infinite number of departments) as requested by the COUNTY. This report will also include any transportation fees that are to be deducted from an auction Item. 8. Promotion and Advertising a) The AUCTIONEER shall print and distribute approximately 2,500 auction brochures each month for the COUNTY's live auctions, and combined with the COUNTY's on-line auctions. b) The AUCTIONEER shall advertise via the Internet through auction related "links"as well as from the AUCTIONEER's website,www.ggauctions.conn. c) The AUCTIONEER shall advertise the COUNTY's auction using the following methods. i. Auction Brochure: o 2,500 brochures; o Single color brochure; o Display a minimum of 8 pictures; o List all terms and conditions clearly; 8 Rev 09/13 o Include web-site and Internet Auctions; o Include all phone numbers for information; o Mail the brochure First Class Postage; and, o Post Auction brochure on the Internet. Mailing Advertisement Process: Approximately fourteen(14)days prior to the COUNTY's auction, the AUCTIONEER shall mail the COUNTY's auction brochures through first class,presort, and U.S.postage. ii. Vehicles and Equipment Advertisement: The AUCTIONEER shall advertise vehicle and equipment auctions in National Trade Journals, when warranted, such as,but not limited to: o Rock&Dirt,three(3)editions; o Contractors Hotline, one(1) edition; o Equipment Trader; o Truck Trader; and, o Auto Trader. iii. Newspaper Advertisement: The AUCTIONEER shall advertise the COUNTY's auctions for Osceola County in local newspapers, the Sunday prior to your Auction, in the classified section, under Auctions, in newspapers such as,but not limited to the following: o Florida Today(Brevard County); o Orlando Sentinel(Orange County); o Sanford Herald(Seminole County); o Leesburg Daily Commercial(Lake County); o Daytona News Journal(Volusia County); o Jacksonville Florida Times Union(Duval County); o Ocala Star Banner(Marion County); and, o Miami Herald(Dade County). iv. Internet Advertisement:The AUCTIONEER shall advertise the COUNTY's auctions for Osceola County on the Internet using the AUCTIONEER's website www.ggauctions.com. The AUCTIONEER shall maintain an e-mail listing and fax log of buyers that are automatically notified prior to each auction, along with posting the date and time of the auction on numerous web bulletin boards such as, but not limited to: o Auction Zip o Craig's List 9 Rev 09/13 Exhibit"B" Project Schedule 1.Project Timeline a) The AUCTIONEER shall conduct live auctions on the Third(3rd) Saturday of each month,with the exception of the month of December. i. The AUCTIONEER shall complete the following tasks three (3) weeks prior to the live auction: o Receive list of surplus items from Osceola County Property Control Section. o Prepare and print the COUNTY's auction advertisement. o Prepare regional and local newspaper advertisement. o Prepare national publication advertisements when warranted. o List and post the COUNTY's auction advertisement on www.ggauctions.com. ii. The AUCTIONEER shall complete the following tasks two (2)weeks prior to the auction: o Mail the auction brochures. o Fax advertising copy to regional and local newspapers. o Post the auction brochure on www.ggauctions.com and internet bulletin boards. o Set-up and photograph items for on-line auction. o Enter on-line auction sale inventory into a networked computer system and list www.ggauctions.con, iii. The AUCTIONEER shall complete the following tasks the week of the auction: o Ensure that the regional and local newspaper advertising begins. o Ensure that the auction sale is set-up. o Ensure that the inventory is entered into the computer. iv. The AUCTIONEER shall complete the following tasks one(1)day prior to the live auction: o The AUCTIONEER's staff shall visit with Buyers for the auction. o The AUCTIONEER's staff shall answer questions and assist with any special needs of the buyers. 10 Rev 09/13 2. Proiect Implementation a) The AUCTIONEER shall be responsible for handling the following process from beginning to end, starting with: i. Taking inventory and digital pictures of selected items for on-line auctions; ii. Collecting information and condition reports for selected items; iii. Placing the selected items on www.ggauctions.com, with a specific link, using Osceola County's Logo,to help guide local buyers; iv. In conjunction with on-line coverage, adding coverage of the COUNTY's on-line sale with the monthly live auction advertisement; v. Handling all prospective bidders' phone,fax,and e-mail inquiries on the COUNTY's items listed for auction; vi. Scheduling inspections; vii. Collecting funds from the buyer,including Florida sales tax; viii. Transferring titled items, as per Florida Department of Motor Vehicle (FLDMV)guidelines; ix. Scheduling the checkout and removal of the item to the buyer; x. Providing the COUNTY with a detailed accounting of the COUNTY's items sold with the COUNTY's sales check; xi. Providing payment to the COUNTY within 10 business days following the Auction; xii. Remitting auction proceeds less commission and or any transport fees to to the COUNTY; and, xiii.
