ITEM #04 SJRWM Mitigation Parcel Acq center of GOOd L . ~ AGENDA ITEM STAFF REPORT Meeting Date: October 17, 2006 Item # 4- We Contact Name: Contact Number: Bobby Howell f~\-\ 407 -905-3100/1044 Reviewed By: Department Director: City Manager: Subject: St. Johns River Water Management District Mitigation Parcel Acquisition Issue: Should the Honorable Mayor and City Commissioners authorize staff to issue City funds from the Park Impact Fee account to pay the disputed difference in price for the St. Johns River Water Management District Mitigation Parcel (a.k.a. Pine Street Parcel). Background Summary: The "Pine Street Parcel" is located on the north side of Pine Street and south of the Crown Point Woods Subdivision. It is approximately 13 acres in size. The City of Ocoee, on behalf of the St. John's River Water Management District, petitioned the Orlando-Orange County Expressway Authority for the purchase of the subject property to allow for the creation of a nature park and environmentally enhanced stormwater management system along the area known as the northwest ditch for the ultimate purpose of allowing the filtration of stormwater going into Lake Apopka. The agreed upon purchase price to be paid for the land was $390,000, with funds made available from the water management district. During the negotiations, the Orlando-Orange County Expressway Authority stipulated that the property would be sold as-is, and any future problems that arose would be the concern of the buyer. During the due diligence phase, a survey of the property indicated several encroachments from outside properties. These encroachments included a fence along the northern property line, an asphalt driveway along the eastern side of the property, and a creek flowing along the northwestern boundary of the property. These encroachments prevented the surveyor from staking the boundaries of the property correctly. Taking these issues into account, the water management district calculated a diminished value and area caused by these encroachments, and lowered the amount of available funds for the purchase price by $13,000 to $377,000. In order to prevent prolonging legal negotiations for several months, staff is proposing to utilize $13,000 of Park Impact Fees to account for the full purchase price of $390,000. Recommendations Staff respectfully recommends that the Mayor and City Commissioners approve the use of $13,000 in Park Impact Fees to assist in finalizing the purchase of the subject property, and to authorize the Finance Department to issue funds to the Orlando-Orange County Expressway Authority in that amount.
