Department Director: Steve us ; Contact Number: 407-905-3159 City Manager: Robert Fra • Subject: Change Order #4 to Bluford Avenue Stormwater and Utility Im• ovements Project (District 2 Commissioner Wilsen/District 3 - Commissioner Firstner) Background Summary: As part of the original Bluford Avenue Stormwater and Utility Improvements Project and approved Columbus Street forcemain work covered under Change Order #1, Change Order #4 is comprised primarily of water and wastewater utility additions including required water service connections, unforeseen utility conditions along the Bluford corridor, and repair of aged water utility infrastructure along Bluford Avenue. In addition, this change order covers unforeseen underground conditions at the new forcemain connection to the existing forcemain on Maguire Road. An existing multi-level Century Link duct bank created substantial conflicts at the connection point. In summary, the increase in cost for water and wastewater items is $27,186.13 and $32,798.50, respectively. Dewitt and City Representatives utilized the current bid item quantity costs to estimate the change order costs. In review of the original contract pay items, several items including Items 4.01, 4.04, 4.18 and 4.20 had contract deductions, which are shown in Change Order #4. The cost savings due to the deductions in water items is $32,614.00. The net increase to the original contact amount is $27,370.63. Staff is recommending the required additions and deductions be added to the original scope of work and contract amount as Change Order#4. Charles K. Smith, P.E., the Director of Utilities, will be available for any questions. Issue: Should the Mayor and City Commission approve Change Order#4 to authorize the additions and deductions of the Utility Infrastructure as part of the Bluford Avenue Stormwater and Utility Improvements Project? Recommendations: Motion for Mayor and Commission to approve Change Order #4 in the amount of $27,370.63, for a total project cost of $1,606,418.71, for the Bluford Avenue Stormwater and Utility Improvements Project. REQUIRED CHANGES Required utility changes include add 12" WM fitting and valves, add 8" WM fittings and valves, add new fire hydrant, add new water services, 12"FM fitting, valves and appurtenances. The point of connection at Maguire Road and Columbus Street required additional fittings and valves to avoid unforeseen underground utility conflicts. In addition, the City will receive deductions for Pay Item Nos. 4.01, 4.04, 4.18 and 4.20. II. JUSTIFICATION As stated above, the changes are warranted due to unforeseen underground utility conflicts along Maguire Road. A substantial Century Link duct bank exists within the roadway adjacent to the location where the new FM connects to the existing FM. III. NARRATIVE OF NEGOTIATIONS Dewitt and City Representatives utilized the current bid item quantity costs for the Bluford Avenue Improvements to estimate the change order costs. Additional contract time is warranted for described added work. IV. PAYMENT The net increase in contract cost for the additions is $27,370.63. V. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual, Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY's Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the CITY for the Work covered by this Change Order. The CONTRACTOR hereby waives and releases any further claims for cost or time against the CITY arising from or relating to the matters or Work set forth or contemplated by this Change Order.
