The overall parcel is 2.21 acres in size. The Parcel Identification Number is 19-22-28-0000-00-005. The site itself is currently undeveloped and sparsely covered with a small mixture of pine trees, oak trees and other varieties of trees scattered around the property. The adjacent land uses to the north and west are developed as a storage facility (Extra Space Storage) and large-scale parking areas (Auto Auction) with C-3 zoning. To the east is an auto salvage facility zoned C-2 (Ralph Johnson). Located on the south side of SR 50 is an Auto Service (Just Brakes) establishment zoned C-3. To the southeast is a 3-story storage facility (U-Haul) in unincorporated Orange County jurisdiction. The Future Land Use designation for the site is Commercial. The property is zoned General Commercial (C- 3), which permits development and construction of the proposed use. A Large Scale Preliminary/Final Site Plan was originally approved for a three-story indoor storage facility by the Ocoee City Commission at the City Commission Meeting held on November 7, 2006. ISSUE: Should the Honorable Mayor and City Commissioners approval the Revision to the Large Scale Preliminary Site Plan for West Orange Investments, a proposed 108,352 square foot indoor storage facility on 2.21 acres? DISCUSSION: As mentioned above, the original approval was for a three-story self -storage facility with a total building Floor area of 63,075 square feet. The building footprint was 21,025 square feet. The proposed revision to the Preliminary Site Plan is a change to a four-story 108,352 square foot indoor storage facility with a 27,088 square foot footprint. The Building has upgraded architectural features designed to look like a modern four-story office building rather than a traditional mini -warehousing facility. The applicant has agreed to an earth tone color scheme and will not use the predominant green color seen in other Extra Space storage facilities. The stormwater facility does not need modification and is permitted by SJRWMD. The plan provides for sidewalk connections to SR 50, underground onsite power lines on the east side, and landscape buffers along SR 50 and Marshall Farms Road. The West Orange Investment Indoor Storage Facility site plan that was approved in 2007 was vested by the Development Services Department Director several years ago. The vesting determination was made as the property owner over the years since 2007 has provided surveys and engineered plans to conned an adjacent property to sewer and also modified the proposed lift station designs for the City in order to accommodate sewer for the facility across Marshall Farms Rd. Also, the original approval required the applicant to receive Transportation Impact Fee Credits for dedicating additional road right-of-way to the City at a reduced cost for future improvements on Marshal Farm Road. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on April 3, 2017, and reviewed the revision to the Large Scale Site Plan. Discussion on the timing of the connection to sewer on the west side of the road was discussed as the City is repaving Marshall Farms Road later this year. When the discussion was finished, the DRC voted unanimously to recommend approval of the Revision to the Preliminary Site Plan for West Orange Investments. PLANNING AND ZONING RECOMMENDATION: The Planning and Zoning Commission met on April 11, 2017, and reviewed the proposed plan revision. After discussion on the proposed use and vesting background, the Planning and Zoning Commission unanimously recommended approval of the revised Large Scale Preliminary Site Plan. Staff recommends that the Honorable Mayor and City Commission approve the Revision to the Large Scale Preliminary Site Plan for West Orange Investments. CONDITIONS OF APPROVAL 1, The City of Ocoee is subject to the terms, provisions and restrictions of Florida Statutes, Chapter 163, concerning moratoria on the issuance of building permits under certain circumstances. The City has no lawful authority to exempt any private entity or itself from the application of such state legislation and nothing herein shall be construed as such an exemption. 2. This project shall be develop in one (1) phase. 3. Except as specifically noted on this plan, development of this property shall be consistent with the requirements of the City of Ocoee Code. 4. Nothing herein shall be construed to waive any provision of the Land Development Code except to the extent expressly set forth on a waiver table or explicity set out on the plan. 5. Any damage caused to any public road as result of the construction activities related to the project shall be promptly repaired by the Owner to the applicable governmental standarts at the Owner's sole cost and expense. 6. There shall be no access from the property to any public road except at the approved locations shown. 7. All commercial and industrial pod elevation will exceed the 100—year flood plain by a minimum of two (2) feet. 8. All existing structures (including buildings, power lines, existing aerial and utility facilities) will be removed and/or terminated prior to or during construction of the development replacing those uses. 9. All legal instrument, including but not limited to, declarations of covenants, easements and restrictions, articles of incorporation of the property owners association, and warranty deeds to the association shall be provided to the City for approval prior to platting all or a portion of the property. 10. All utilities including electrical, cable, TV, and telephone and including on —site existing overhead wires shall be placed underground. 11, A perpetual, non—exclusive access easement over all internal roadways and other paved areas is hereby granted in favor of the City of Ocoee and other applicable authorities for law enforcement, fire and other emergency services. The City may require that the owner execute an easement in recordable from with respect to the foregoing. 12. The Developer shall construct appropriate curb cuts to enable construction of ramps at all rights —of —way intersections (and other areas as reasonably required) in order to accommodate access to sidewalks and streets for persons who are in wheelchairs and other persons who are physically challenged, and otherwise comply with all Americans with Disabilities Act requirements. 13. Parking shall be provided in accordance with the City of Ocoee Land Development Code, 14• Each fire hydrant shall be painted OSHA yellow in color and a blue reflective marker shall be affixed to the street in the center of the lane closest to each hydrant. 15. Stormwater management shall be provided consistent with the requirements of the Ocoee Land Development Code and the St. John's River Water Management District. 16, Any future conveyance of less than all of the property is expressly prohibited until such time that a subdivision plan for the property is approved by the City and the property is platted. (a) Prior to this issuance of any building permits for the real property which is the subject of this Preliminary/Final Large Scale Site Plan (the "Plan"), the Owner shall dedicate and convey to the City. (1) an approximately twenty—five (25) foot —wide strip of the property lying adjacent and contiguous to, and along the property's western frontage on the existing right—of—way for Marshall Farms Road all as more particularly depicted on this Plan (the "Right —of —Way Land"). The Owner shall provide the City with a Sketch of Description and legal description of the Right —of —Way Land consistent with the Plan. The Right —of —Way Land shall be dedicated and conveyed by the Owner to the City by warranty deed free and clear of all liens and encumbrances except for those matters acceptable to the City. The form of the warranty deed shall be subject to the approval of the City. The Owner shall, contemporaneously with the dedication and conveyance of the Right —of —Way Land to the City, provide to the City, a current attorneys opinion of title, or a current title commitment, to be followed by a policy of title insurance, evidencing that fee simple title to the Right —of —Way Land is free and clear of all liens and encumbrances except for those matters acceptable to the City. The costs and expenses related to the conveyance and dedication of the Right —of —Way Land, including the cost of title work, shall be borne solely by the Owner. Real property taxes on the Right —of —Way Land shall be prorated as of the day before the City's acceptance of the dedication and conveyance of the some, and the prorated amount of such real property taxes attributable to the Owner shall be paid and escrowed by the Owner in accordance with the provisions of Section 196.295, Florida Statutes. (b) In consideration for the Citys advance acquisition of the Right —of —Way Land, City will provide to Owner road impact fee credits in the amount of $56,509.52, representing the current applicable City of Ocoee road impact fees for the development of a 63,075 square foot mini —warehouse pursuant to the Plan. Any road impact fee credits provided pursuant hereto may only be used in the connection with the development of the property, and for no other purpose. (c) The City acknowledges that the road impact fee credits set forth above represent less than the current fair market value of the Right —of —Way Land. By approval of the Plan and acceptance of the deed, the City agrees that the fair market value of the Right —of —Way Land in excess of the $56,509.52 constitutes a donation of land to the City and that the Owner would not agree to the conveyance of the Right —of —Way Land for said impact fees credits but for such agreement by the City. The City will sign the appropriate IRS forms needed to acknowledge such donation; provided, however, that the City makes no representation as to the fair market value of the Right —of —Way Land or as to the tax consequences or deductibility of any donation to the City. (d) Notwithstanding the conveyance of the Right —of —Way Land to the City, the Owner shall be solely responsible for maintaining the Right —of —Way Land until such time as improvements are made to Marshall Farms Road within the Right —of —Way Land. 18. Within 180 days of City sewer service becoming available to the property, the Owner will, at its sole cost and expense, design, permit, engineer and construct a sanitary sewer lift station in accordance with all requirements of the City of Ocoee and any other applicable governmental entities. The lift station will be constructed within the area labeled "Future Lift Station" on Sheet 6 of the Plan. At such time that the lift station becomes operational, the Owner will, at it sole cost and expense, disconnect and remove the septic system and drainfield for the property. 19. Any landscape improvements on the property that are disturbed, damaged or destroyed in connection with the installation or maintenance of any drainage improvements, septic tank and drainfield improvements, or lift station and related utility improvements by the Owner, FDOT or any other governmental entity shall be replaced or restored at the Owners sole cost and expense. 20. Prior to the issuance of any building permits for the subject property, the Owner will enter into a Sewer Line Extension Agreement with the City, which Agreement will provide that the Owner will pay its fair share of the costs of the design, engineering, permitting and installation of the sewer line extension needed to serve the subject property and other benefited properties identified by the City. The fair share allocation will be based on the sewer capacity to be utilized in connection with the development of the subject property. This Agreement will provide for an escrow of the Owner's designated fair share allocation with ❑ "tune—up" occuring at the completion of the project to reflect the actual costs incurred by the City. Such escrow payment will be paid to the City prior to issuance of any building permits related to the subject property. This Agreement will also include the provisions contained in Condition of Approval No. 18 requiring the construction of a lift station and removal of he septic tank. 21. Existing trees 8" or larger (other than citrus trees or "trash" trees) located along proposed locations of buffer walls or road right—of—way lines will be preserved if at all possible. The buffer walls and roads will be designed around those trees to incorporate them into required landscape buffers and as street trees. 22. In order to ensure that as many existing trees as possible will be presrved, all road right—of—ways and retention areas will be flagged for review by the City and the Engineer prior to any tree removal.
