Contact Number: 407-905-3159 City Manager: Robert Fra' %!''r' Subject: Acceptance of Change Order #1 for the Downtown & Western Sanitary Transmission Project (North of Silver Star Phase) Background Summary: The Downtown &Western Sanitary Transmission Project (North of Silver Star Phase) shall provide critical improvements needed to support the implementation of the City's new downtown and is consistent with Downtown master plan. The project's construction also provides the opportunity to correct deficiencies in public infrastructure; and staff is recommending a roadway repair and drainage improvement as described below. The roadway on N. Bluford Avenue, from the north side of the railroad tracks to 225 feet north of the Rewis Street/Lakewood Avenue intersection, is in very poor condition; and the area is subject to flooding during rainfall events. In addition, a portion of the existing sidewalk centered on the Rewis/Lakewood intersection (northwest corner) lies outside the right-of-way; and is substandard as it encroaches into the roadway's vehicular safety zone. The installation of the 20" forcemain has further exacerbated the area's poor condition. To correct the roadway deficiencies, the Public Works and Utilities Departments collaborated to propose corrections to existing pavement and pavement grading, the removal of the encroaching sidewalk (see attached plans), and also the addition of drainage improvements to the area. Drainage will be accomplished by the addition of curb and gutter on the north and west side of the pavement, as well as by the installation of four (4) inlets plus outfall piping to direct flows to the Lee Street ditch. The new pavement will be graded to slope to the curb. Pedestrians using the existing sidewalk will be redirected from the Rewis/Lakewood intersection to the sidewalks on Lee Street and Lyman Street. At the northeast end of the downtown sanitary project, the forcemain had to be routed out under pavement to avoid other utilities in the south parkway (grassy area) of the Wurst Road right-of-way. As a result, the pavement for one lane of traffic will have to be totally reconstructed. Following the sewer project, Public Works has scheduled the milling and resurfacing of Wurst Road, including the same area where pavement shall be reconstructed. To maximize resources, the reconstructed pavement will be resurfaced by Public Works and the resurfacing to be completed as a part of the Utilities project will be used as an "offset" to the Rewis Street and Lakewood Avenue Change Order improvements. Finally, the milling and resurfacing bid portion of the contract was based on patch work, leading to a higher unit cost of$20 per square yard for 2" milling plus $22 per square yard for the 2" resurfacing ($42 total). Due to the magnitude and continuous nature of the work on Rewis Street and Lakewood Avenue, the contractor was able to lower the total rehabilitation cost to $25 per square yard, a savings of$17 per square yard. Issue: Should the Mayor and City Commission accept Change Order #1 for the Downtown & West Sanitary Transmission Project (North of Silver Star Phase) to correct drainage issues and restore pavement along Rewis Street and Lakewood Avenue, including the Rewis/Lakewood intersection? Recommendations: Motion for Mayor and City Commission to accept Change Order #1 with SanPik, Inc. in the amount of $104,084.00 for drainage improvements, roadway stabilization, milling, and resurfacing at the Rewis Street and Lakewood Avenue intersection. Funding for the Public Works drainage work, plus associated prorated pavement expenses, is $77,768.83 and shall come from Stormwater Capital Improvements — Capital Improvements (103-538-20-6302). Utilities' funding portion of the restoration work ($43,915.17) will come from the 2016 Utilities Bond (Fund 417). The bond proceeds had programed $3,635,000 to the Downtown & West Sanitary Transmission Project (North of Silver Star Phase) with a contract awarded amount of $2,874,433. NARRATIVE OF NEGOTIATIONS The City Engineer, working with the Utilities Department, prepared plans for the Rewis and Lakewood intersection and provided a summary of quantities (attached C.O. #1 Road and Drainage Quantities Summary Table) for the work needed to complete the plans. Change order items C01.01 thru C0.03 were duplicate items from the base bid, but to the nature of the work not being broken up the contractor was able to reduce his price on these items. The unit cost was reviewed by both Public Work and Utilities, and found to be reasonable and within range of recent values. III. PAYMENT The total expenses for the additional work in conjunction with Change Order#1 are $121,684.00; but by way of the repaving "offset" ($17,600)discussed above,the actual financial impact resulting from Change Order#1 is $104,084.00. APPROVAL AND CHANGE AUTHORIZATION The original project and funding allocation was established by issuance of a CITY purchase order, subject to the terms and conditions contained in the CITY's solicitation, Project Manual, Downtown&West Sanitary Transmission Project (North of Silver Star Phase)Bid#16-06 Drawings, Specifications, and/or the CONTRACTOR's service and price proposal, which collectively form the terms of an agreement between the CITY and the CONTRACTOR for the performance of the Work. This proposed change to the agreement requires approval by the City Commission under the CITY's Purchasing Rules and Regulations and is consistent with any prior action by the City Commission to award the Work to the CONTRACTOR. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original agreement other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order,that the adjustments in contract price and time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a result of this Change Order. No other claim for increased costs of performance or modifications of time will be granted by the CITY for the Work covered by this Change Order.
