Background Summary: The Districting Commission was appointed by the City Commission and held several meetings between February —August, 2017, including an advertised Public Hearing on June 5, 2017. The Districting Commission presented a report to City Commission on July 18, 2017, advising of its preferred plan. After further discussion at the City Commission on July 18, 2017, the commission consensus was to have the Districting Commission reevaluate the preferred plan proposed boundary and consider all homes within Bay Street be incorporated within the same district. The Districting Commission met on August 7, 2017, and by unanimous vote moved to adopt Board Plan 4. On August 15, 2017, the Commission approved the recommended Board Plan 4, and directed staff to bring back an ordinance adopting the new boundaries set forth in this plan. Issue: Should the Honorable Mayor and City Commission adopt the Ordinance approving the new Commission District Boundaries for the City of Ocoee? Recommendations: The Districting Commission and City staff recommends that the Honorable Mayor and City Commissioners adopt the Ordinance approving the new Commission District Boundaries for the City of Ocoee as recommended by the Districting Commission in Board Plan 4. N/A Reviewed by 0 N/A ORDINANCE NO. 2017- AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA RELATING TO GEOGRAPHICAL BOUNDARIES FOR SINGLE-MEMBER CITY COMMISSION DISTRICTS; AMENDING SECTION 5-21 OF ARTICLE II OF CHAPTER 5 OF THE CODE OF ORDINANCES OF THE CITY OF OCOEE IN ORDER TO CHANGE THE GEOGRAPHIC BOUNDARIES OF THE SINGLE-MEMBER CITY COMMISSION DISTRICTS; PROVIDING FOR DELIVERY TO THE ORANGE COUNTY SUPERVISOR OF ELECTIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission has established a Districting Commission pursuant to the provisions of Article XI of the Charter of the City of Ocoee; and WHEREAS, the provisions of Section C-66.C(3) of Article XI of the Charter of the City of Ocoee requires that the Districting Commission be established to review the geographic boundaries of the single-member districts and prepare a report to the City Commission containing recommendations, if any, for adjustments of the district boundaries; and WHEREAS, the on December 6, 2016, the City Commission established a Districting Commission which held a total of six public meetings including an advertised public hearing on proposed redistricting plans; and WHEREAS, the Districting Commission presented this report at a regular Commission Meeting held on July 18, 2017, containing a recommendation for their preferred option for the adjustment of the geographic boundaries of Districts 2 and 3 only; and WHEREAS, the City Commission referred the report back to the Districting Commission for further consideration; and WHEREAS, on August 15, 2017 the City Commission received the modified plan presented by the Districting Commission known as "Board Plan 4"; and WHEREAS, for the purposes of carrying out the provisions of Article XI of the Charter of the City of Ocoee, the City Commission of the City of Ocoee desires to change the geographic boundaries of the single-member City Commission Districts as recommended by the Districting Commission. NOW, THEREFORE,BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA,AS FOLLOWS: SECTION 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, and Chapter 166, Florida Statutes, and Article XI of the Charter of the City of Ocoee. SECTION 2. Section 5-21 of Article II of Chapter 5 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended by deleting and replacing Exhibits B and C and republishing in its entirety the current provisions thereof: §5-21. Establishment of geographical boundaries for single-member City Commission districts. A. For the purposes of carrying out the provisions of Article XI of the City Charter, the City of Ocoee is hereby divided into four (4) single-member districts. The four (4) single- member districts are as follows: (1) District No. 1 shall consist of that part of the City of Ocoee located within the following geographical areas: See Exhibit "A" attached hereto and by this reference made a part hereof (2) District No. 2 shall consist of that part of the City of Ocoee located within the following geographical areas: See Exhibit "B" attached hereto and by this reference made a part hereof. (3) District No. 3 shall consist of that part of the City of Ocoee located within the following geographical areas: See Exhibit "C" attached hereto and by this reference made a part hereof. (4) District No. 4 shall consist of that part of the City of Ocoee located within the following geographical areas: See Exhibit "D" attached hereto and by this reference made a part hereof. B. The geographical areas described in this section include lands outside of the corporate limits of the City in order to address future annexations. Any lands which may hereafter be annexed into the City shall automatically be included within the applicable district at the time of annexation. SECTION 3. The geographical boundaries of District Nos. 1, 2, 3 and 4 as described in Exhibits "A", "B", "C" and "D" hereto, respectively, are depicted on the Map of the Ocoee Municipal Election Districts attached hereto as Exhibit "E" and by this reference made a part hereof Reference shall be made to the Map of the Ocoee Municipal Election Districts whenever it becomes necessary to interpret this Ordinance or resolve any ambiguities regarding the description of the single-member district boundaries established in Section 5-21 of Article II of Chapter 5 of the City Code. The City Clerk is hereby designated as the person responsible for making any such clarifications regarding district boundaries. SECTION 4. The City Clerk is hereby directed to provide the Orange County Supervisor of Elections a certified copy of this Ordinance within ten (10) days from the date of adoption. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. Codification. It is the intention of the City Commission of the City that the provisions of Section 2 of this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter," "section," "article," or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk. SECTION 7. Effective Date. This Ordinance shall become effective immediately upon passage and adoption. PASSED AND ADOPTED this day of , 2017.
