Background Summary: Back on September 6, 2015, City staff made a presentation to the City Commission relating to the development and redevelopment of parcels within the Special Overlay Areas. Topics of specific concern to staff and the City Commission is the redevelopment of parcels within the Overlay Areas, density and compatibility concerns with development and redevelopment, allowable uses in the overlay, and the development of zoning standards that will enhance economic development and redevelopment in the Overlay Areas with the following uses or intended uses: pharmaceutical dispensaries, fast food and other drive through restaurant establishments, check cashing stores, self- storage facilities, vehicle and tire service, sales, and repair facilities, and discount retail stores. A moratorium was put in place through March of 2017, to allow staff the time to evaluate the current Special Overlay Area standards and update the standards as necessary. Since the moratorium has expired, the City has adopted a zoning overlay over the SR 429 Corridor by establishing three (3) character areas and has a final ordinance on the agenda to prohibit medical marijuana dispensing facilities. As a final step in addressing the concerns stated in the moratorium, staff has proposed amendments to the Land Development Code (LDC) which addresses uses and provides for additional requirements in overlay areas (CRA Target Areas, SR 429 Overlay, and Downtown Overlay) for the following uses: Fast Food Restaurants with Drive-through, Self-Storage Facilities, and Automotive Tire and Repair facilities. Issue: Should the Honorable Mayor and City Commission approve an ordinance amending the Land Development Code Article II Definitions, Section 5-8 Prohibited Uses and Table 5-1 Permitted Use Regulations for certain uses in Overlay Districts? Discussion: With regards to Exhibit A, staff is proposing to better define self-storage facilities and prohibit the use unless it is integrated as part of a multi-use development. With regards to Exhibit B, staff is proposing to eliminate the drive-in restaurants like a Sonic Burger and to limit fast food restaurants with drive-through locations based on access to main roads like Hwy 50 or Plant Street. Lastly, in Exhibit C, staff is proposing to limit automobile service stations that change oil, tires and other minor work. All of these uses will be permitted in non-overlay areas just as they currently are by code. See attached exhibits for further information. Recommendation: Staff recommends the Honorable Mayor and City Commission approve an ordinance amending the Land Development Code Article II Definitions, Section 5-8 Prohibited Uses and Table 5-1 Permitted Use Regulations for certain uses in Overlay Districts. WHEREAS, as provided in Article VIII of the Constitution of the State of Florida and chapters 163 and 166, Florida Statutes, the City of Ocoee (the "City") enjoys all home rule authority, police power, land development and zoning authority, and governmental and proprietary powers necessary to conduct municipal government and perform municipal functions; and WHEREAS, the City may exercise any power for municipal purposes, except as expressly prohibited by law; and WHEREAS, Section 5-3.1 of the City of Ocoee Land Development Code ("Land Development Code") allows special overlay areas to be created by the Ocoee City Commission to facilitate unique development activities and to ensure coordinated and high quality development within the Special Overlay Areas; and WHEREAS, the Ocoee City Commission has established Special Overlay Areas in the City to allow for such coordinated and high quality development; and WHEREAS, on October 10, 2017, the City of Ocoee Planning and Zoning Commission held a public hearing on proposed amendments to the Land Development Code to provide for regulation of certain uses in Special Overlay Areas and recommended that the Ocoee City Commission approve said amendments; and WHEREAS, this Ordinance has been considered by the Ocoee City Commission in accordance with the procedures set forth in Section 166.041(3)(c), Florida Statutes; and WHEREAS, the Ocoee City Commission finds that the proposed amendments are consistent with the goals for development within Special Overlay Areas and are consistent with the Ocoee Comprehensive Plan; and WHEREAS, the City Commission in good faith determines that this Ordinance is in the best interest of the City and its residents and promotes the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby ratified and confirmed as true and correct and incorporated herein by this reference. Section 2. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, and Chapters 163 and 166, Florida Statutes. Section 3. Amendment to Section 2-4, Land Development Code. The term "Mini-warehouse" is revised and a new definition for the term, "Self-Storage Facility", is added to section 2-4, Article II, Chapter 180 of the City of Ocoee Land Development Code, to read as follows, with underline showing additions and strikethroughs showing deletions: Article II — Language and Definitions Section 2-4. — Definition of Terms. (197) Mini-warehouse: See Self-Storage Facility. A building or group of buildings in a or lockers of equal or varying sizes for the dead storage of a customer's goods or wares. (273) Self-Storage Facility: Self-storage uses provide separate storage areas for individual or business uses. The storage areas are designed to allow private access by the tenant for storing or removing personal property. Examples include but are not limited to, self-storage warehouses and mini-storage facilities. (Renumber subsequent subsections.) (All other provisions of section 2-4, City of Ocoee Land Development Code, remain unchanged by this amendment.) Section 4. Amendment to Table 5-1, Land Development Code. Table 5-1, Article V, Chapter 180 of the City of Ocoee Land Development Code, is hereby amended to read as follows with underline showing additions and strikethroughs showing deletions. See Exhibit "A" attached hereto and by this reference made a part hereof. 2 Section 5. Codification. This Ordinance shall be incorporated into the City of Ocoee Land Development Code. Any section, paragraph number, letter and/or any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical and similar or like errors may be corrected, and additions, alterations, and omissions not affecting the construction or meaning of this Ordinance or the City Code may be freely made. Section 6. Conflict. All Ordinances or Resolutions, or parts of Ordinances and Resolutions in conflict herewith are hereby made ineffective to the extent of such conflict as of the effective date of this Ordinance. Section 7. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereto.
