06-25-2002 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JUNE 25, 2002 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:35 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and Member Donenfeld led the Invocation. The roll was called and a quorum declared present. PRESENT: Chairman Linebarier, Vice-Chairman Lenko (arrived at 7:40 p.m.), Members Donenfeld, Godek, and Henderson. Also present were Code Enforcement Supervisor Simon, Code Enforcement Officer Loeffler, Building Clerk Ramos, Attorney Sneed, and Deputy City Clerk Whitford. ABSENT: Members Chancey, Konicek, Skiles and Solomon who were excused. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD,IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. HEARINGS ON STATEMENT OF VIOLATONS PURSUANT TO NOTICES OF HEARINGS Case No. 02-029—Russell R. & Patricia A. Grandgeorge 801 E. Silver Star Road Officer Loeffler Violation Cited: 119-2 06-04-02 NOCV Re-Inspection Date: 05-24-02 06-04-02 SOV 06-04-02 NOH Meeting Date: 06-25-02 06-04-02 POS Certified Mail Observation:Commercial Vehicles back at residence. No Commercial site for business. Code Enforcement Supervisor Simon, having been sworn, gave a detailed history of the case. She stated the Respondents are repeat violators and the property is not in compliance. Russell Grandgeorge, having been sworn, stated he only parked the vehicle in question at the residence on breaks and on weekends. He stated he was not conducting business from the residence. Member Donenfeld, seconded by member Godek, moved to table Case No. 02-029 until the July 23, 2002, meeting in order to resolve the vehicle size limit and give the Respondent time to apply for an occupational license. Motion carried 4-0. Vice Chairman Lenko abstained from voting as she was not present for the testimony. Case No. 02-030—Ignacio & Bertha Ibarra 75 Sand Dollar Key Drive Officer Loeffler Violation Cited: 115-5 06-05-02 NOCV Re-Inspection Date: 06-05-02 06-05-02 SOV 06-05-02 NOH Meeting Date: 06-25-02 06-0502 POS Certified Mail Observation: Overgrown grass/weeds. Code Enforcement Officer Loeffler, having been sworn, gave a detailed history of the case, stated the Respondents are repeat violators, and the property is in compliance. Vice-Chairman Lenko, seconded by Member Henderson, moved in Case No. 02-030 to find the Respondents in violation of Section 115-5 as of June 4, 2002, but in compliance as of June 25, 2002,and to impose a penalty of$50.00 per day effective June 4, 2002, thru June 25, 2002, totaling $1,050.00 and enter an order imposing fine and lien. Member Henderson, seconded, Vice-Chairman Lenko, moved in Case No. 02-031 to find the Respondents in violation of Sections 165-3 and 115-5 as of May23, 2002, but in compliance as of June 24, 2002. Code Enforcement Officer Loeffler, having been sworn, stated the property is in compliance. Member Godek, seconded by Member Donenfeld, moved in Case No. 02-032 to find the Respondents in violation of Section 165-3 as of June 5, 2002, but in compliance as of June 25, 2002, no fine or penalty imposed. L 4 Code Enforcement Board Minutes June 25,2002 Code Enforcement Clerk Ramos, after being sworn, stated Mr. Starnes had telephoned and made an appointment for Code Enforcement Officer Siegrist to do a re-inspection on June 6, 2002. The Respondents were in compliance as of June 6, 2002, and an affidavit of compliance was done. No action to be taken. Case closed. Chairman Linebarier inquired about Case No. 01-052 Equicredit Corp. of America and if they had paid the $2,000.00 in fines. Code Enforcement Supervisor Simon indicated that both fines had been paid. ELECTIONS Chairman Linebarier opened the floor for nominations for Chairman. Member Godek, seconded by Member Donenfeld, moved to retain the current Chairman and Vice-Chairman unless they wished to decline the office. Motion carried 5-0. Both Chairman Linebarier and Vice-Chairman Lenko were willing to continue to serve in their positions. COMMENTS Code Enforcement Officer Loeffler—None Building Clerk Ramos-None Chairman Linebarier—Asked Ms. Lenko if she was going to be present at the next monthly meeting as he would not be able to attend. He stated his wife was going to visit their granddaughters and he would have to pick her up at the airport on the next scheduled meeting date. Code Enforcement Supervisor Simon — Said due to the busy schedules the packet would be mailed out in the future as opposed to being hand delivered. She asked if the members would call or e-mail as to whether they were going to be present for the meeting. Chairman Linebarier asked that a letter be sent to all the members stating such and for the letter to include the phone number and e-mail address to be used. Vice-Chairman Lenko — Said she would lice to thank Commissioner Parker for the nomination and the Commission for reappointing her to the Code Enforcement Board. She asked if this was Mr. Solomon's last meeting. Chairman Linebarier stated it was and that he would like to have Member Henderson moved up to Mr. Solomon's position and a new alternate appointed.
