10-24-1995 Minutes lorw MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON October 24, 1995 CALL TO ORDER Chairman Sills called the regular meeting of the Ocoee Code Enforcement Board to order at 7:35 p.m. in the Commission Chambers of City Hall and led in the pledge of allegiance. Member Linebarier led in prayer. The roll was called and a quorum declared present. PRESENT: Chairman Sills, Vice Chairman Carlsson, Members Lenko, Linebarier, Santo, Shagner, and Alternate Member Holmes. Also present were Attorney Feeney, Building and Zoning Director Flippen, Electrical Inspector Hendrix, Code Enforcement Officers Braddy and Simon, Deputy Clerk Seaver and Clerk/Stenographer Lewis. ABSENT: Member Chestney and Alternate Member Skiles (both absences were excused). Chairman Sills welcomed Mr. Linebarier as a new Member, and introduced Alternate Member Bruce Holmes to the Board. APPROVALS This item consisted of the Minutes of the September 26, 1995 Code Enforcement Board meeting. Attorney Feeney explained that a clerical note on page 4, second paragraph, should read "It is not a defense for the buyer ..." rather than "It is not an offense to the buyer ..." Vice thw Chairman Carlsson , seconded by Member Shagner, moved to approve the Minutes of the September 26, 1995 Code Enforcement Board meeting, as amended. Motion carried 6-0. As Member Linebarier had been absent for the meeting, he abstained from voting. Code Enforcement Officer Simon testified that Case No. 95-116 referred to the property at 1515 Jemima Avenue. She had received complaints from the Police and Fire Departments that overgrown grass, chemicals, and left over chemicals, etc., were on the property which was vacant. Upon a past inspection, she had observed a large, free standing garage type building, and on September 8, 1995 found the structure to the rear had completely collapsed. On September 13, 1995, an NOCV was sent to the property owners as identified by Orange County Tax Record, Don M. Owens III &/or Connie R. Quinn, for violation of City Code, Chapter 108- 23 (Q.);Accessory Structures: "Garages, storage building and all other accessory structures shall be maintained and keep in good repair and sound structural condition." Officer Simon said that the collapsed state of the building was not in a sound structural condition, and the property owner was given until September 16, 1995 to bring the property into compliance. On September 16, 1995, a re- inspection of the property remained in non-compliance. The original NOCV had been mailed and returned to the City, and the property and City Hall were posted on October 4, 1995, pursuant to 7-110 of the City ordinance. A re-inspection of the property on October 24, 1995 produced a status of non-compliance. A video of the property in violation was presented for review by the Board. In response to Chairman Sills, Deputy Clerk Seaver said for the record that the respondent's name should read Don M. Owens, III. The Statement of Violation had Don M. Owens, II. Member Lenko, seconded by Member Shagner, moved that Don M. Owens III &/or Connie R. Quinn, Case No. 95-116, be found in non-compliance of City Code, Chapter 108-23 (Q); Accessory Structures, as of October 24, 1995 and that they be given until October 31, 1995 to bring the property into compliance or be fined $100 a day thereafter. Caw 2 Code Enforcement Board Meeting October 24, 1995 95-120, JEAN LEPAGE THOMAS C/O BOBBIE BOEH 9/13/95 NOCV - Re-inspection Date:9/14/95 9/18/95 NOH - Board Meeting Date:9/26/95 9/18/95 SOV 9/18/95 POS - Mail Cert#Z395-711-336 9/26/95 Order of Continuance 10/2/95 NOH - Board Meeting Date:10/24/95 10/4/95 POS - Mail Cert#P597-456-606 Code Enforcement Officer Simon testified that Case No. 95-120 referenced the property at 510 Hill Avenue. On September 11, 1995, the City had received a complaint about the accumulation of trash, wood, fence, lawnmowers, debris, and junk around the house located at that address. Upon an inspection on September 12, 1995, Officer Simon had observed piles of debris, rolls of a plastic material, refrigerators, appliances, etc. On September 13, 1995 an NOCV had been sent to the property owner as identified by the Orange County Tax Records, Jean LePage Thomas, for violation of Chapter 115-3. Prohibited Acts: "No person shall allow to be dumped,placed, accumulated or otherwise located on lands or premises owned by such person within the city any nuisance and menace to public health, safety and welfare, etc..." On September 14, 1995, a re-inspection by Officers Simon and Braddy found the property in non-compliance. On September 18, 1995 an SOV and NOH were sent via restricted delivery to Ms. Jean LePage Thomas, c/o Bobbie Boeh, her daughter. A re-inspection of the property had been made as of the last Code Enforcement Board meeting, September 25, 1995, and the property at that time was in non- compliance, and the Board had issued an Order of Continuance on this case for this Board meeting. Officer Simon said that she and Building Official Flippen had done an inspection on the property on October 2, 1995, advising Mr. Mulcahy of what was needed to bring the property into compliance. Several driveby inspections of the property found some improvement but there were still other things on the property. A re-inspection of the property on October 24, 1995 found it in non-compliance. A video taken on October 24, 1995 was presented for the Board's review. From the audience, Ed Mulcahy attempted to speak, and Chairman Sills pointed out that he was speaking out of order. In response to Vice Chairman Carlsson, Officer Simon said that the property had not been cleaned up as of 3:00 p.m. that day. Bobbie Boeh, 2253 Boy Scout Road, Apopka 32803, was sworn in by Deputy Clerk Seaver, and said that she had turned over "a batch of stuff" that the City had requested last month about what they were doing to proceed. They were trying to resolve something to the mutual satisfaction for everybody without going to more lawyer expense. She said that Ed was doing much more cleanup than he ever had before, and that he had counter sued them. Ms. Boeh said that her lawyer was wanting to know what went on by the Board at this meeting, and that they would proceed from there. In response to Vice Chairman Carlsson, Ms. Boeh said that both lawyers were to sign a dismissal last week regarding the eviction notice. She said that the attorney must begin again with the eviction for non-payment. (limy 3 Code Enforcement Board Meeting October 24, 1995 Vice Chairman Carlsson, seconded by Member Shagner, moved to find Case No. 95-120, Jean LePage Thomas, c/o Bobbie Boeh, 510 Hill Avenue, in non-compliance as of September 13, 1995 and be fined $100 a day thereafter until she comes into compliance. Attorney Feeney suggested that the Board consider that up until today, there had been no determination that this respondent is at fault, and they may want to say 15 days from today. Vice Chairman Carlsson, seconded by Member Shagner, moved to amend his motion, at the advise of counsel, to find her in violation, and give the respondent until November 3, 1995 to come into compliance or be fined $100 thereafter. Member Shagner said that she seconded that. Ms. Boeh objected and said that it takes at least three (3) weeks for an eviction from the start. Vice Chairman Carlsson said that he would make the compliance date, November 10, 1995. Discussion ensued on the number of days the respondent sould be given to come into compliance. In response to Member Linebarier, Vice Chairman Carlsson restated the motion. Member Lenko said that she would like to amend that motion to $250 a day. Motion died for a lack of a second. The amendment to the motion carried 6-1. Member Lenko voted "nay." fir, Attorney Feeney said that the Board now needed to vote on the motion as amended. The amended motion carried 6-1. Code Enforcement Officer Braddy testified that Case No. 95-128 referenced 1007 Arizona Court. On September 8, 1995, she had received an anonymous complaint about trash and debris in the rear yard, and that it was overgrown. After another inspection on September 13, 1995, she had received a second anonymous complaint. An inspection on September 9, 1995 found knee deep grass, and also, wood, various trash and debris in the rear yard. On September 15, 1995, an NOCV was sent to the property owner as of record, Brenda F. Asbury, for violation of City Code, Chapter 108 Minimum Standards Code;Article II Housin 2 Minimum Standards Code: 108-24 Sanitation Requirements: (A) Sanitation: (B) Cleanliness: (C) Garbage Disposal: (D) Care of Premises: Weeds: Trash: "Rear yard is overgrown. Remove any trash and debris in the yard." The respondent was given until September 25, 1995 to come into compliance. A re-inspection on September 26, 1995 found the property in non-compliance, and on September 29, 1995, an SOV and NOH were sent to Ms. Asbury, who signed for it, via restricted delivery, certified mail on October 4, 1995. Officer Braddy said that a re-inspection on October 24, 1995, found the yard had been mowed and the property was clean. Member Linebarier, seconded by Member Lenko, moved that Brenda F. Asbury, Case No. 95-128, be found in non-compliance of Chapter 108 Minimum (imp, 4 Code Enforcement Board Meeting October 24, 1995 Standards Article II; 108-24 (A) Sanitation. (B) Cleanliness; (C) Garbage Disposal; (D) Care of Premises, as of September 25, 1995 but in compliance as of October 24, 1995, and that no penalty be levied at this time. Motion carried 7-0. 95-129, ALISHA CAMP 8/31/95 NOCV - Re-inspection Date:9/26/95 9/29/95 NOH - Board Meeting Date:10/24/95 9/29/95 SOV 10/4/95 POS - Mail - Cert#P597-456-597 Alisha Camp was not present to represent her case. Code Enforcement Officer Braddy testified that on June 14, 1995 she had inspected 1601 Jemima Drive for a Minimum Standard Inspection of a water connection for Christina Dawson, the renter. The owner of record was Alisha Camp, 1535 Green Acre Point, Oviedo 32765, and a letter had been sent to Ms. Camp on June 15, 1995 giving her 60 days to correct the violations. A re-inspection was due as of August 15, 1995 but there had been no request. Ms. Camp's son called to request a re- inspection that found several items were still in non-compliance. On August 31, 1995, an NOCV was sent to Ms. Camp, giving her until September 10, 1995 to comply for violation of City Code, Chapter 108 Minimum Standards Code: Article II Housing Minimum Standards Code: 108-23 General Requirements for the exterior and interior of structures: M)Exterior Doors: Weatherstrip all exterior doors. N)Exterior Door Frames, 108-24 Sanitation Requirements: F)Operation Plumbing Fixture: "Plumbing fixtures in both bathrooms are not water-tight and operable;must be repaired." Standard Plumbing.Code 1204.1 Protection of Potable Water Supply Backflow: "Install backflow preventors on all exterior hose bibs." "Install backflow preventors on all exterior hose bibs." Officer Braddy said that a re-inspection on tkiw September 26, 1995 found three items remained in violation. In response to Member Lenko, Officer Braddy said that the plumbing fixtures pertain to the shower unit. Discussion had ensued earlier about whether someone other than the respondent had the authority to represent the case. Attorney Feeney explained that the Board could hear the testimony of Ms. Camp's son, and said that the Board could consider tabling the case and wait for a written and notarized statement that Mr. Camp could represent her case. The Board decided to hear the testimony of Keith Camp (but not as representative). Keith Burdett Camp, 1535 Green Acre Point, Oviedo 32765, was sworn in by Deputy Clerk Seaver, and said, to his knowledge, that everything in violation had already been taken care of, and requested a re-inspection. He said that he had started the house from scratch and everything had been replaced on the inside; although a drain valve in a bathroom needed a tap and dye. Mr. Camp requested that the Board give him until November 7, 1995 so that he could set a time with the tenant and Officer Braddy for a re-inspection. Member Lenko, seconded by Member Santo, moved that Alisha Camp, Case No. 95-129, be found in violation of Chapter 108 Minimum Standards Article II; 108-23: (M), (N); 108-24: (F); Standard Plumbing Code 1204.1 as of September 10, 1995 and be given until November 7, 1995 to come into compliance or be fined $50 a day thereafter. Motion carried 7-0. . 5 Code Enforcement Board Meeting October 24, 1995 95-130, ROBERT M. IMHOFF 8/26/95 NOCV - Re-inspection Date:9/26/95 9/29/95 NOH - Board Meeting Date:10/24/95 9/29/95 SOV 10/4/95 POS - Mail - Cert#P597-456-598 Code Enforcement Officer Braddy testified that on April 5, 1995 she had performed a Minimum Standard Inspection at 59 Periwinkle Key Drive, and found numerous items in violation at that time. A letter was mailed on April 27, 1995, giving the respondent 60 days to correct the violations. There had been no request for re-inspection, therefore, on August 26, 1995, an NOCV was sent to Robert M. Imhoff for violation of City Code, Chapter 108 Minimum Standards Code; Article II Housing Minimum Standards Code: 108-23 General Requirements for the exterior and interior of structures: D) "Repair wall between the room addition, the wood is severely rotted. (in bedroom, bathroom and closet). R) "Replace all rotted flooring, (Hole in floor in bathroom, hole in floor in rear bedroom). B) "Install skirting around the trailer." 0) "Install screens to all the windows." 108-24 Sanitation Requirements: "Repair sink in front bedroom." Officer Braddy said that the NOCV had given Mr. Imhoff until September 15, 1995 to comply, and as of that date there had been no response. On September 26, 1995, an SOV and NOH were sent to the respondent via certified mail, restricted delivery. The POS had been signed on October 5, 1995 and was received by the City. The property is in non-compliance as of October 24, 1995. Ms. Braddy said that Mr. Imhoff had made contact with her. Robert Michael hnhoff, 59 Perwinlde Key Drive, was sworn in by Deputy Clerk Seaver, and thily said that the trailer had been damaged by the storm. An insurance adjustor had been out last week to look at the damage, and Mr. hnhoff said that they were going to condemn the trailer. He said that he was just waiting for them to take the trailer, fix it, etc. He said that he had replaced the screens, flooring, several parts of the floor through the whole trailer, and cutoff the supply line from the bath of the front of the house so there is no longer a bathroom there, that is was now a closet. He also explained that his wife had recently given birth to triplets, and that they had three (3) other children. He had been in and out of work. Vice Chairman Carlsson went over the list of violations with Mr. Imhoff. In response to Member Lenko, Mr. Imhoff said that the insurance company had given him only a card, there had been nothing in writing but the company would be calling him back to inform him when they received the adjustment. He could not give the Board a date as to when he could bring the property into compliance. Member Shagner suggested that Mr. Imhoff get something in writing from the insurance agent. Member Lenko moved to give Mr. Imhoff a 30 day period of time. Member Linebarier said that he was going to make a motion that the Board continue the case until the November meeting, and at that time ... Vice Chairman Carlsson said that he disagreed with Mr. Linebarier, and that he believed that the respondent would have better leverage with his insurance company if they found him in violation. Member Lenko, seconded by Vice Chairman Carlsson, moved to find Richard M. Imhoff, Case No. 95-130, in non-compliance of Ci Codes 108-23 D R B and 0 108-24 Sanitation Re.uirements• Standard Ls, 6 Code Enforcement Board Meeting October 24, 1995 Plumbing Code 1204.1 as of September 15, 1995, and that he be given until November 21, 1995 to bring the property into compliance or be fined $100 a day thereafter. HEARNS (1606 Adair Street) 9/13/95 NOCV - Re-inspection Date:9/26/95 10/2/95 NOH - Board Meeting Date:10/24/95 10/2/95 SOV 10/4/95 POS - Mail - Cert#P597-456-602 Earlier in the meeting, the Board had tabled Case No. 95-134 to the November meeting. 95-135, NANCY TORRES AND PETRA TORRES 9/13/95 NOCV - Re-inspection Date:9/26/95 10/2/95 NOH - Board Meeting Date:10/24/95 10/2/95 SOV 10/4/95 POS - Mail- Cert#P597-456-603 Chairman Sills said for the record that there was no one present to represent the case. Code Enforcement Officer Braddy testified that Case No. 95-135, Nancy Tones and Peter Tones, referenced the property located at 479 New Meadows Court. She had first received a complaint on July 31, 1995. The property had not been inspected until August 25, 1995, at which time she had found the property to be in violation. The observation had been that of a white AMC Hornet and a blue Renault located in the front yard with grown up grass under it. At that time neither vehicle was tagged. On September 12, 1995, both vehicles were observed in the front yard. On September 13, 1995, an NOCV to the respondent for violation of City Code, Chapter 165-3 (A) Vehicles Abandoned and Junk: Prohibited Acts, and were given until September 19, 1995 to come into compliance. A re-inspection on September 26, 1995 found the property in non-compliance. An SOV and NOH were sent via certified mail, restricted delivery, on October 2, 1995, and Nancy Tones signed the POS on October 6, 1995. A re- inspection on October 24, 1995 found no blue Renault and the white AMC, with a current tag, was parked in the grass with no grass growing around it. The property was now in compliance. Code Enforcement Officer Braddy testified that Case No. 95-136 referenced the property located at 323 Ft. Collins Court. On July 31, 1995, she had received a complaint about a gray Chevrolet truck, full of trash, was parked by the side of the house. Two inspections, August 25, 1995 and September 12, 1995, found the truck on the property. It had been considered a junk vehicle due to the length of time that the vehicle had been sitting, therefore, on September 13, 1995, an NOCV was sent to the respondent for violation of City Code, Chapter 165-3 (A) Vehicles Abandoned and Junk: Prohibited Acts. The respondent was given until September 19, 1995 to comply. A re- 7 Code Enforcement Board Meeting October 24, 1995 inspection on September 26, 1995 found the property in non-compliance. On October 2, 1995, an SOV and NOH were sent to the property owner as identified by the Orange County Tax Records, Randall G. Enfmger & Daralyn H. Enfmger, via certified mail, restricted delivery. Daralyn Enfmger signed the POS on October 4, 1995. On October 24, 1995, the respondent called for a re-inspection that found the trash had been removed and a current tag was on the vehicle. Vice Chairman Carlsson, seconded by Member Santo, moved to find Randall G. Enfinger&Daralyn H. Enfmger, Case No. 95-136, in violation of Chapter 165-3 Prohibited acts (a) as of September 19, 1995, and find them in compliance as of October 24, 1995, and that no fine be imposed at this time. Code Enforcement Officer Braddy testified that Case No. 95-137 referenced the property located at 481 Northern Durango Avenue. On July 31, 1995, Officer Braddy had received a complaint of a blue Camaro with no tag parked in the front yard. An inspection on August 25, 1995 and September 12, 1995 found the vehicle parked on the property. On September 13, 1995, an NOCV had been sent to Barry Lee Parks, Jr. and Rebecca E. Parks citing them for violation of City Code, Chapter 165-3 A: Vehicles Abandoned and Junk; Prohibited Acts. The respondents were given until September 19, 1995 to come into compliance. On September 26, 1995, the blue Camaro remained in the front yard with no tag. On October 2, 1995, an SOV and NOH were sent via certified mail, restricted delivery, to the respondents to this Board meeting. Officer Braddy said that Rebecca Parks signed for the POS on October 5, 1995. A re-inspection on October 24, 1995 found the property had come into compliance. Motion carried 7-0. 95-138, LEE AND/OR JANE BEKEMEYER (1105 Oakwood Lane) 9/13/95 NOCV - Re-inspection Date:10/2/95 10/5/95 NOH - Board Meeting Date:10/24/95 10/5/95 SOV 10/5/95 POS - Mail- Cert#P597-456-609 Earlier in the meeting, the Board had tabled Case No. 95-138 until the November meeting. 95-139, JAMES HALFORD 10/6/95 NOCV - Re-inspection Date:10/16/95 10/18/95 NOH - Board Meeting Date:10/24/95 10/18/95 SOV 10/18/95 POS - Mail - Cert#P597-456-610 Chairman Sills said for the record that no one was present to represent the case. Code Enforcement Officer Simon testified that Case No. 95-139 referred to the property at 1204 Wurst Road. On October 6, 1995, the property owners as identified by Orange County Tax Record, James Halford, was sent an NOCV for violation of City Code, Chapter 115-2 Creation 8 Code Enforcement Board Meeting October 24, 1995 Prohibited: "No person shall dump or cause to be dumped or place or cause to be placed on any lands or premises within the city any nuisance and menace to public health." The observation had been the accumulation of a large amount of unused lawn mowers and lawn mower parts on this property. The respondent was given until October 16, 1995 to bring the property into compliance. A re- inspection on October 16, 1995 produced a status of non-compliance. On October 18, 1995, an SOV and NOH were sent to the respondent via restricted delivery by Deputy Clerk Seaver for this Board meeting. Ms. Braddy said that she had met with Mr. Halford on October 24, 1995 for a re-inspection, and the lawn mowers and parts had been removed from the side yard but there were numerous lawn mowers remaining at the rear of the property. She said that "Papa" Duquette had intervened frequently for Mr. Halford, and she had explained the paper work and Code Enforcement procedures to them. Officer Simon had video taped the property in violation but due to a problem with the equipment, the video was not shown. She explained that Mr. Duquette had contacted the City in reference to requesting a postponement for Mr. Halford. In response to Chairman Sills, Officer Braddy said that Mr. Halford had not told her when he could bring the property into compliance. Motion was made here but for clarity is shown later in the minutes. Discussion ensued about the length of time needed to comply. Several Members expressed the desire and the need for the respondent to appear before the Board to address the issue. Deputy Clerk Seaver was sworn in by Attorney Feeney, and explained that Mr. Halford might need additional time due to his physical condition. She said that Mr. Halford was dependant upon others to remove the lawn mowers, that he had been very upset, and had asked for time in which to comply. Mr. Halford had told her that he had plans to have them removed within a week but he could not give an exact time. Lakewood Avenue, and that she had received a complaint from a resident that the property owner had erected a fence which was on the complainants property. The fence had also been extended over an alley way. The complainant had advised her that no permit for a fence was posted. An inspection of the property on October 2, 1995 revealed that a fence had been erected at the address, and a research of the Building Department records showed that no permit had been issued for the job. On October 5, 1995, an NOCV was sent to the property owners as identified by Orange County Tax Records, William and/or Eriena Shelnutt, for violation of City Code, Chapter 51-21 Permit required: "It shall be a violation of this Article for any person to do any building construction, repair work, alteration or remodeling of any building or to demolish any building within the scope of this Article without first obtaining a permit therefore from the Building Department." The respondents were given until October 12, 1995 in which to pull a permit and to bring the property into compliance. The property owner and the tenant had contacted the Building Department on several occasions, and had attempted to pull a permit. They did not have the required surveys to access placement of the fence. The tenant, if they did not own the property, could not pull a permit without a power of attorney. The City had given them information, and an application that must be signed by the property owner, and must be notarized. On October 18, 1995, an SOV and NOH to this Board meeting had been sent to the property owner via restricted delivery by Deputy Clerk Seaver. A re-inspection on October 24, 1995 showed that no permit had yet been pulled for the work that had been done at that address. Also, the fence had been moved or altered but was still erected. People had been in and out of the property, and there were survey flags. A video of the property in violation was presented to the Board for review. Mr. Tucker had built a new home recently, and said that the fence looked shabby and it was an eye sore to him. The observation had been that of a white Ford truck on jacks without a tag and an inoperable vehicle without tag in rear yard. Chapter 115-3 Prohibited Acts: "No person shall allow to be dumped, placed, accumulated or otherwise located on lands or premises owned by such person within the city any nuisance and menace to public health, safety and welfare ..." The observation had been that of miscellaneous debris and trash including numerous gas cans, tires etc. in the front side and rear (1169 yard. Chapter 108-23(M): "Every exterior door shall be substantially weather-tight, water-tight and rodent proof and shall be kept in sound working condition and good repair." The observation had been that of a large hole in the front door with torn plastic over it. Chapter 158-8 Swimming Pools. Responsibilities of owners (A): "The owner or persons responsible for the pool operation shall keep in service all items designed for the purification of the water supply or its protection from pollution to perform adequately the function for which they were designed." The observation had been that of a swimming pool with green water, not kept in a sanitary but in an polluted condition. Officer Simon presented a letter dated August 31, 1995, to the respondent notifying them of the complaints against their property which included the above violations. The fences were shut upon her arrival at the property and she had been unable to inspect the pool, trash, etc., and a Doberman was in the back yard. She had also received a complaint from within the City that she was not addressing the complaints in the rear yard because the dog was always in the back yard on the three (3) occasions that she had gone to the property. On October 2, 1995, a re-inspection of the rear yard found the violations as presented. Officer Simon said that she had presented the letter to the Board so they could see how long the City had the complaints of these violations. There had been several attempts to inspect the property. The respondents were sent an NOCV on October 3, 1995. The property owners were given until October 16, 1995 in which to bring the property into compliance. On October 3, 1995, an NOCV was sent to the property owners as identified by Orange County Tax Records, Sabrina K. Fowler and/or Mary K. Donovan, for violation of City Code, Chapter 119-2 Eniaiini in business without license: "It shall be unlawful for any person to engage in any business, occupation or profession within the city without a license issued hereunder.." The observation had been that of a wrecker with the name "Wanted Dead or Alice" advertising the business phone number 877-0948. The business number is in the name of Sabrina Fowler at 1512 Jemima Avenue, however, City records did not reflect an occupational license for that address nor did they reflect a license for the business at any other address. The wrecker had been observed at the above address as well as numerous vehicles stored on the property which would coincide with aspects of a wrecker/towing business. Chapter 165-3 Prohibited Acts (A): "No person shall keep any abandoned or junk vehicle on any public or private property ..." The observation had been that of an orange Mitsubishi with no tag, a red maroon Monte Carlo with no tag, an older model green vehicle with an expired Colorado tag, an older model light colored vehicle on the side yard with no tag, and had the appearance of being inoperable. The property owner was given until October 16, 1995 to bring the property into compliance. On October 16, 1995, a re- inspection of the property produced a status of non-compliance. There had been no contact with the gentleman running the wrecker or the property owner for any applications for City licenses. On October 18, 1995, an SOV and NOH to this Board meeting were sent to the property owners via restricted delivery by Deputy Clerk Seaver. There had been several inspections and all of the vehicles have been removed from the property. She had spoken with a Mr. Ebbott Fowler who lives at that address and is related to Sabrina Fowler. Ms. Simon said that on October 19, 1995, Mr. Fowler said that he had removed the phone number from the vehicle and that he was no longer advertising the phone number at that residence as a business phone for the wrecker (service). Officer Simon had talked with the Building Official and at this point in time, Mr. Fowler is allowed to park one commercial vehicle (up to 1 1/2 ton rating) in a residential area. The tow truck did not exceed that rating. Mr. Fowler was not running a tow service, and as long as he keeps the storage of the junk vehicles off of this property they were not going to require him to have a license at this time. She did not have Proof of Service on Khemwattee Persaud, Case No. 95-146, but she did have the POS on the business signed by the property owner, and she was also present here. Officer Simon said with Ms. Persaud's permission that she would like to go ahead and hear the case on both 95-146 and 95-147. Khemwattee Persaud, 605 Wurst Road, was sworn in by Attorney Feeney who explained to Ms. Persaud that the City did not have POS on her, and asked if she had any problem having the hearing tonight, both with respect to her business and to herself personally, and that she waive lack of notice on herself individually. Ms. Persaud testified that she had no problem having the hearing tonight both with respect to the business and herself personally. In response to Member Linebarier, the respondent said that her first name was Khemwattee and that her last name was Persaud. Officer Simon testified that Case No. 95-146 referred to the location of the violation as 449 S. Bluford Avenue. On October 12, 1995, she had received a written complaint from the Fire Department that numerous violations existed at the above address, and that Code Enforcement action was being requested by the Fire Department. Based upon the report that she had received from the Fire Department Statement, she sent the owner as identified by the Orange County Tax Records, Khemwattee Persaud, an NOCV for violation of City Code, Chapter 108-22: Minimum Requirements for electrical systems: "Every electrical outlet and fixture, all wiring equipment shall be installed, maintained and connected to a source of electric power in accordance with the provisions of the Electrical Code of the authority having jurisdiction" The observation had been that of 1) Need disconnects on all apartments, 2) Each apartment must be separated from each other by wiring, 3) Panels cannot be located in the downstairs apartment in the bathroom, 4) Each apartment must have its own panel (disconnect), 5) The building located behind the apartments is not wired to the NEC, 6) The electrical service is overloaded, 7) Need smoke detectors in each apartment. . NFPA 101-CH5-2.3.14: "Need emergency lighting on interior stairs." CH 1-6.9 and 1-6.3: "Fire extinguisher must be of proper type and hung properly in accordance with NFPA 10." NFPA 101-CH 19-3.4.4.1 7-6.2.9: :Smoke detectors need to be installed to code etc..." NFPA 101-CH 19-2.1.1, 21-2.2.3 (c): "Upstairs apartments need secondary exit, remote from primary etc." The property owner was 13 Code Enforcement Board Meeting October 24, 1995 given to October 16, 1995 in which to bring the property into compliance. The property owner met with Ms. Simon at City Hall on October 16, 1995 verifying that these violations existed and that she was aware of these violations, and that she was in the process of making arrangements to have them corrected which included hiring an electrical contractor to take care of the electrical problems. Officer Simon said that she had explained Code Enforcement proceedings to her at that time and encouraged her to attend the meeting so that she could relay to the Board at which point she was in correcting the violations. On October 18, 1995, an SOV and NOH for this Board meeting were sent via restricted delivery by Deputy Clerk Seaver. Ms. Simon said that to date there had not been a final inspection by the Fire Department, Electrical Inspector or herself, deeming the property in compliance. The property was in non- compliance as of October 24, 1995. She presented a copy of the reports from the Fire Department initiating the Code Enforcement action, and expert testimony from the Fire Inspector, and the City Electrical Inspector. The Board reviewed all of the exhibits. Capt. James L. Coschignano, Fire Inspector for the Ocoee Fire Department, was sworn in by Deputy Clerk Seaver, and testified that the two reports date information about the smoke detectors. He said that the existing smoke detectors needed repositioning, and that the respondent should be keeping a log. He had no evidence of a log, and he did not know whether the detectors were working. Chairman Sills expressed concern that there was only one exit from the building from the upstairs, and Capt. Coschignano said that the upstairs apartments are dependant upon the interior stair. He said that the upstairs window in each bedroom or living space can be used as a secondary, according to the Code. The windows were jallousied, and would not satisfy as a secondary exit and means of escape from each area. He said that Ms. Persaud had since told him that the windows were on order but he had not seen anything as of October 24, 1995. Eddie Hendrix, Electrical Inspector for the City, was sworn in by Deputy Clerk Seaver, and said that the respondent had hired an electrical contractor whom he had met him at the property to discuss the violations. The contractor has been to the City for his permits and had explained 14 Code Enforcement Board Meeting October 24, 1995 that he would be on the job October 25, 1995, and that he planned to have the work completed in about a week. Discussion ensued about the number of apartments permitted at the location. Member Lenko asked if there was someone still living in the shed in the back (of the property), and Electrical Inspector Hendrix said that there was wiring going out to the building which will be disconnected. Khemwattee Persaud said that she had order four(4) windows that should arrive in about three (3) weeks, and had plans to order another five (5) windows. Ms. Persaud explained that her daughter was taking care of the property in November, 1994. In response to Vice Chairman Carlsson, Ms. Persaud said that she owned the property in November, 1994. Officer Simon said that she was still trying to work with the tenant but she did not really have any definite answers for the Board. She was kind of at a dead end with it. Ms. Howell had called her to say that Ms. Pedrick had given her a three (3) day notice (by October 25, 1995) to have the trailer off the property. Officer Simon said that the respondent had not made any contact with her regarding the property. Mayor Scott Vandergrift explained that efforts had been made to resolve the violations at 52 W. Circle Key but it had come to a dead end. The nature of the mobile homes bring them to zero at some time in their life as far as worth was concerned. There were other people looking at finding a solution to the problem. Mayor Vandergrift explained window methods used in the old days where they were propped open with a stick. He then suggested replacing the glass with wood. With that theory in mind he said that he had no solution for it. Chairman Sills thanked Mayor Vandergrift and the City staff for their time spent on this case. He said that a lot of people had worked in trying to find something to do in this situation. Ms. Seaver also said that she had not tallied the fine for the Board. Garfield Holmes had repossessed the trailer since that time, and he had called asking for a reduction in the fine. Mr. Holmes resides in Maine. A letter had been faxed to the City for presentation to this Board, that Mr. Holmes would like to sell the trailer, that had been gutted, to his grandson. Ms. Seaver said that Mr. Holmes was requesting a reduction in the fine. Code Enforcement Officer Simon testified that Case No. 95-58 referred to the property at 169 W. Silver Star Road, and the property had never been in compliance. The property had belonged to Barbra Ball when it had been cited, and had been posted to be mowed. She had posted it physically on the property and sent a certified letter that was returned to the City. Ms. Ball had called Ms. Simon to say that she had been given foreclosure notice, and would be moving out. Ms. Ball had not given any details who had foreclosed on her or who was taking possession of the trailer. The yard had been mowed, trash was cleaned, and only a little trash remained.
