03-22-1994 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD ON MARCH 22, 1994 ROLL CALL PRESENT: Chairman Jim Sills, Vice Chairman Frank Carlsson, Carolyn Alexander, Madeline Shagner, Denise Lenko, Mark Slaby, Scott Glass, Attorney Ike Cool, Code Enforcement Officer Teresa Braddy and Deputy Clerk Sherry Seaver. ABSENT: Eric Barnett, Larry Chestney, excused The meeting was called to order by Chairman Sills at 7:30 pm in the Ocoee Commission Chambers in the Ocoee Community Center. Chairman Sills led in the Pledge of Allegiance to the Flag and Mr. Carlsson led in prayer. Chairman Sills stated that there was a quorum present. APPROVALS Mr. Carlsson made a motion to table the approval of the minutes for the February 22, 1994 meeting until the April 26, 1994 meeting. Motion seconded by Ms. Shagner and approved unanimously. COMMENTS FROM CITIZENS 41er No Citizen's comments. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARING 93-46, Stella King Chairman Sills stated for the record that there was no one present to represent this case. Code Enforcement Officer Braddy was sworn in by Deputy Clerk Seaver. Ms. Braddy stated that this presentation was for a continuation and update of this case. Ms. Braddy stated that Ms. King was in a nursing home and unavailable to accept a Notice of Hearing. Ms. Braddy stated that a proposed ordinance was in motion to enable the City to take care of violations such as this case. Mr. Carlsson made a motion to table this case to the April 26, 1994 Code Enforcement Board Meeting. Motion seconded by Ms. Lenko and approved unanimously. 93-64, Donald Joseph Crawford Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that no one has been seen at the house to make delivery of the Notice of Hearing. Mr. Carlsson asked if there was a for-sale sign? Ms. Braddy responded no. Ms. Lenko made a motion to table this case to the April 26, 1994 Code Enforcement Board meeting. Motion seconded by Ms. Shagner and approved unanimously. Page 2 NW, Page Enforcement Board Meeting March 22, 1994 93-67, Ann Link Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that the Respondent was in a mental institution. Ms. Braddy stated that hopefully the proposed ordinance would be able to help this violation. Mr. Carlsson made a motion to table this case to the April 26, 1994 Code Enforcement Board meeting. Motion seconded by Ms. Shagner and approved unanimously. 93-72, Morris Jensen This case complied prior to the hearing and was dismissed. 93-73, James &/or Mazie Creech This case complied prior to the hearing and was dismissed. 93-74, Judy Mercer Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that Ms. Mercer was not able to be served. The Board discussed different means to verify and serve the Notice of Hearing to Ms. Mercer. Mr. Carlsson made a motion to table this case until the April 26, 1994 Code Enforcement Board meeting. Motion seconded by Ms. Alexander and approved unanimously. 94-01, Martha B. Shaner &/or Mildred Fay Lee Ms. Braddy stated the description of the violation and the dates of inspections for this case. Ms. Braddy stated that as of this date, the property had been almost completely cleaned. There remained a table in the yard. The Board requested to see pictures of the property. Chairman Sills recessed for a two (2 ) minute break at 7:53 pm. Chairman Sills called the meeting to order at 7 :56 pm. The pictures of the property in violation was distributed to the Board for review. Mr. Slaby asked Ms. Braddy if the table and sign was a part of the violation. Ms. Braddy stated no. Mr. Carlsson asked Ms. Braddy if the pictures were taken as of January 17, 1994. Ms. Braddy stated yes. Ms. Fay Lee of 87 Buck Key Court, Ocoee, Florida was sworn in by Deputy Clerk Seaver. Ms. Lee stated that the property in violation was sold without a contract and that they tried to evict them but couldn't. Chairman Sills asked Ms. Lee if the property was in compliance. Ms. Lee stated that the trailer was parked across the street. Ms. Braddy stated that the property owner Page 3 Code Enforcement Board Meeting March 22, 1994 had been notified about the trailer and the owner said they would have the trailer towed. Ms. Lee provided the Board with a letter from her attorney in reference to this situation. Attorney Cool read the letter out loud to the Board. Mr. Carlsson asked if Ms. Lee if they had a copy of the court papers. Ms. Lee stated no. Attorney Cool stated that there was no fine because they were in compliance. Ms. Braddy asked Attorney Cool how she should re-cite the tenants, can we request a copy of the court papers. Mr. Carlsson asked if these people can be cited as of January 17, 1994 . Chairman Sills asked for the date that the Respondent entered into the contract with the tenants. Ms. Lee stated October of 1992 . Ms. Lenko made a motion to find the property in non-compliance as of January 17, 1994 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Mr. Carlsson and approved unanimously. Mr. Slaby made a motion to hear Case 94-12 out of turn. Motion seconded by Mr. Glass and approved unanimously. 94-12, Special Effects for Hair Ms. Braddy stated that this occupational license expired September �r 30, 1993. Ms. Braddy stated the violation of doing business without a license. Pictures were presented to the Board for review. Mr. Sills asked how much the license fee was. Ms. Braddy stated for eight (8) chairs plus a 20% penalty. Catherine Lombardo of 1321 Maury Road Orlando, Florida 32804 was sworn in by Deputy Clerk Seaver. Ms. Lombardo stated that they had problems with the State and their address change but that she was ready to pay. Mr. Carlsson made a motion to find the Respondent in non-compliance and to give them until March 24, 1994 at noon to pay for the license or be fined $100.00 a day thereafter. Motion seconded by Ms. Lenko and approved unanimously. Mr. Carlsson made a motion to hear case 94-06 out of turn. Motion seconded by Mr. Slaby and approved unanimously. 94-06, Bernardino Ortiz Ms. Braddy described the violation and the inspections made for this property. Ms. Braddy stated that their had been a lot of work done but that there was a few things left to be done. Pictures were presented to the Board for review. Ms. Braddy stated that she had been in contact with Mr. Ortiz's son in reference to the violations but they were not completely complied. Lucis Swazo of 405 Apricot Drive Ocoee, Florida 34761 was sworn in by Deputy Clerk Seaver. Chairman Sills asked Mr. Swazo if he was responsible for the clean- (' Ms. Swazo stated yes. Chairman Sills asked how long it would take. Mr. Swazo stated two weeks. Mr. Carlsson asked Ms. Braddy Page 4 Code Enforcement Board Meeting March 22, 1994 what was left in the yard. Ms. Braddy stated that there was blocks and misc. stuff. Ms. Shagner asked Mr. Swazo how long he had lived there. Mr. Swazo responded with four years. Chairman Sills asked who signed the receipt card. Ms. Braddy stated the owner. Ms. Braddy stated that the Respondent was very sick and that Mr. Swazo was representing him. Mr. Carlsson asked how long Mr. Swazo had known about the mess. Mr. Swazo stated two weeks. Mr. Carlsson made a motion to find the Respondent in non-compliance and to give them until April 5, 1994 to come into compliance or be fined $75.00 a day thereafter. Motion seconded by Ms. Lenko and approved unanimously. At this time, the Board discussed the removal of junk. 94-02, Betty Pedrick Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy described the violation and the inspections done. She stated that Animal Control and the Humane Society had both responded to this property. Ms. Braddy stated that they were in compliance as of this date. Ms. Lenko asked Ms. Braddy if they got more dogs. Ms. Braddy stated that there were puppies all over the property. Ms. Shagner asked if they were running a kennel. Ms. Braddy responded no. Ms. Lenko asked did the property stink. Ms. Braddy responded no. Ms. Shagner asked if Ms. Pedrick had contacted the City. Ms. Braddy stated that she called this date. Mr. Carlsson made a motion to find the Respondent in non- compliance as of December 24, 1993 but in compliance as of March 22, 1994 therefore no fines assessed and the paperwork to be sent. Motion seconded by Ms. Lenko and approved unanimously. 94-03, Jack Dunlow Ms. Braddy stated that this case was not served. Ms. Lenko made a motion to table this case until the April 26, 1994 Code Enforcement Board meeting. Motion seconded by Mr. Slaby and approved unanimously. 94-05, Robert James Blakney This case complied prior to the hearing and was dismissed. 94-07, Sidney A. &/or Janet Rivard Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated the inspections and that Page 5 Code Enforcement Board Meeting March 22, 1994 the vehicle was on blocks and had no tag. However, at the time of re-inspection, it was in compliance. Mr. Carlsson made a motion to find the Respondent in non-compliance as of December 24, 1993 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Mr. Slaby and approved unanimously. 94-09, Domino's Pizza Ms. Braddy stated that the Respondent was doing business without a license but as of this date was in compliance. Ms. Shagner made a motion to find the Respondent in non-compliance as of February 28, 1994 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Mr. Slaby. Mr. Glass stated he thought that the cited Section 119-18 should not be included in the violation since it only referred to enforcement. Ms. Shagner amended her motion to read only Section 119-2 and that Section 119- 18 be deleted from the violation. Motion seconded by Mr. Slaby and approved unanimously. 94-10, Griner Auto Sales Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that the Respondent paid for the license after the compliance date. Mr. Carlsson made a motion to find the Respondent in non-compliance of Section 119-2 as of February 28, 1994 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Mr. Slaby and approved unanimously. 94-11, Rocs Discount Party Outlet Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that the Respondent paid for the license after the compliance date. Mr. Carlsson made a motion to find the Respondent in non-compliance of Section 119-2 as of February 28, 1994 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Ms. Alexander and approved unanimously. 94-13, W.O. Dialysis - Rens Center Chairman Sills stated for the record that there was no one present to represent this case. Ms. Braddy stated that the Respondent paid for the license after the compliance date. Ms. Lenko made a motion to find the Respondent in non-compliance of Section 119-2 as of February 28, 1994 but in compliance as of March 22, 1994 therefore no fines assessed. Motion seconded by Mr. Carlsson and approved unanimously. Page 6 Code Enforcement Board Meeting March 22, 1994 OTHER BUSINESS A. Memorandum from Attorney Ike Cool Attorney Cool recommended that the Board ask the City Commission to adopt an ordinance reference private process servers. Mr. Glass made a motion to forward the memorandum to the City Commission for suggestion. Motion seconded by Mr. Slaby and approved unanimously. COMMENTS City Manager - Not Present Code Enforcement Officer - Ms. Braddy stated that she was trying to give Mr. Ortiz the benefit of the doubt. Police Department - Not Present Board Attorney - No Comments Board Members - Mr. Carlsson spoke about getting a new Code Enforcement Officer. Mr. Slaby announced the birth of his baby and that he will be resigning from the Board soon. Ms. Shagner added congratulations. Ms. Alexander stated that this was interesting. ADJOURNMENT Ms. Lenko made a motion to adjourn. Motion seconded by Ms. Shagner and approved unanimously.
