09-25-1990 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD SEPTEMBER 25, 1990 ROLL CALL PRESENT: Chairman John Linebarier, Members Gary Carroll , Frank Carlsson, Phillip Rowe , Attorney Ike Cool , Code Enforcement Officers Steve Ross and Rod McDougal , Police Lieutenant Gailit, and Deputy Clerk Sherry Seaver. ABSENT: Vice Chairman Varnes , Members Robert Imes and Ray Wood. Chairman Linebarier called the meeting to order at 7 : 55 p.m. in the Ocoee Community Center . Chairman Linebarier led in prayer and in the Pledge of Allegiance to the Flag. He also stated for the record that there was a quorum present. APPROVAL OF MINUTES Mr. Rowe moved to approve the minutes of the August 28 , 1990 meeting as printed and distributed. Motion seconded by Mr. Carroll and approved unanimously. HEARINGS ON STATEMENTS OF VIOLATION PURSUANT TO NOTICES OF HEARINGS Case 90-94 , Richard T. &/or Betty A. Wimer This case complied before the hearing and was dismissed by the City. Case 90-102 , Deannie Nelson At this time, Code Enforcement Officers Ross and McDougal were sworn in by Deputy Clerk Seaver. Also sworn in were Bob and Deannie Nelson. Code Enforcement Officer McDougal stated the facts and inspections in this case. He stated that Deannie Nelson came into City Hall and questioned the violation because she had obtained a County license. He stated that he asked Ms . Nelson to bring her paperwork into City Hall and they would review it. He stated Ms . Nelson never came back. Code Enforcement Officer McDougal stated that Ms . Nelson brought in a paper that stated she was in compliance. He stated that she was not . He made many attempts to contact her by phone and by beeper. He only made contact with her daughter . Deannie Nelson began to speak on her behalf . She stated that she was unaware of how many companies were working in Ocoee but none of them were at the meeting. She stated that she went to Orange County and asked them where she is supposed to get a license. She stated that they told her Orange County first and then what City you are working in. Ms . Nelson stated that they are in the process of selling their trucks . She stated that they are only operating one or Page 2 Code Enforcement Board Meeting September 25, 1990 two of their trucks . She stated that they are in the process of leasing their trucks . Ms . Nelson wants to see all of the other buinesses brought to the Board. She stated that she gets her trucks repaired in Ocoee and therefor stores them in Ocoee. She stated that she doesn ' t feel that she is being treated fairly. Chairman Linebarier stated that the Board was not going to discuss any other business except Deannie ' s Catering. Chairman Linebarier asked Ms . Nelson if the trucks were in the City of Ocoee. She stated yes . Mr. Carlsson asked Ms . Nelson if she used her home address as her business address on her taxes . She stated yes . Mr. Carlsson asked her if she was selling or leasing her business. She stated that she was going to lease. Mr. Carlsson stated that she would still be the owner. Mr. Carlsson asked Code Enforcement Officer McDougal if she was under the occupational license for the City. Code Enforcement Officer McDougal stated she needed a license for each truck. Mr. Rowe asked to confirm that she is using an illegal address for the business. Chairman Linebarier stated that she was storing the trucks in the City of Ocoee and was using her home address for her business address . Ms. Nelson stated she had a Post Office in Gotha and that is where her mail used to go. Chairman Linebarier asked Ms . Nelson if she uses her home phone as part of her business advertising. She stated no. Code Enforcement Officer Ross asked Ms . Nelson if her license for the beauty shop was still current. She stated yes . Chairman Linebarier stated that it had no bearing on this case. Mr. Carlsson stated that the Board tried to be fair but to wait until November 3 , 1990 was too long. Mr. Carlsson made a motion to find the Respondent in non-compliance and to give her until October 9 , 1990 or to be fined $50 . 00 a day thereafter for two trucks; a total of $100 . 00 a day thereafter. Mr. Carlsson amended his motion to state to find the Respondent in non-compliance and to give her until October 9 , 1990 to comply or to be fined $50 .00 a day thereafter per operating vehicle. Motion seconded by Mr . Carroll . Ms . Nelson asked if she stored her trucks outside the City would she have to get a license. Code Enforcement Officer McDougal stated that she would have to register her vehicles at $5. 00 per truck operating in the City Limits . Code Enforcement Officer McDougal stated that the fire department had refused to do any inspection of her home property until she had an occupational license. Chairman Linebarier asked what was at 326 Maguire Road. Code Enforcement Officer McDougal stated that it was a storage area for her trucks . He stated that the storage area has an office. Chairman Linebarier asked Ms . Nelson where she was storing her trucks . She stated at 326 Maguire Road. Ms . Nelson stated she was going to change her business address from her home to her accountant ' s address . The Board voted on the motion and was approved unanimously. 90-105, General Repair Service Code Enforcement Officer Ross stated that he was asking for a ,,, Page 3 Code Enforcement Board Meeting September 25, 1990 continuance for this case. Chairman Linebarier asked Code Enforcement Officer Ross to explain why he was asking for a continuance . Code Enforcement Officer Ross stated there was a zoning question on this case because of the screening of the storage of the goods being stored outside of the business . Mr. Carroll stated that the code was not hard to interpret to him. Chairman Linebarier asked Code Enforcement Officer Ross what type of fence the business had. Code Enforcement Officer Ross stated chain link. He also stated that when the Respondent came in they asked for a continuance. Mr. Carlsson asked if the Respondent was told he would get a continuance and Code Enforcement Officer Ross stated yes . Chairman Linebarier asked Code Enforcement Officer Ross to bring the case before the Board and let them decide about a continuance. Mr. Carlsson made a motion for a continuance. The motion was seconded by Mr. Rowe and approved unanimously. 90-106 , Carol Seagraves C/O Raymond Taylor This case complied before the hearing and was dismissed by the City. 90-108 , Albert E. Dexter This case complied before the hearing and was dismissed by the City. 90-111 , United Motor Company This case complied before the hearing and was dismissed by the City. 90-112, Kevin C. Gilliam Tr. This case complied before the hearing and was dismissed by the City. 90-114 , Willie H. &/or Paulette G. Sloane Code Enforcement Officer Ross stated the inspections in this case. He stated that all violations on this case complied except the Plymouth Valiant. Code Enforcement Officer McDougal stated that he delivered the Statement of Violation to Mr. Sloane and discussed the violation with him. He also stated that Mr. Sloane had a problem with moving the vehicle. Code Enforcement Officer McDougal stated that he told Mr. Sloane if he wanted to appear before the Board and ask for an extension for his case he could; Mr. Sloane was not present. Chairman Linebarier asked if the vehicle was still there on todays date . Code Enforcement Officer McDougal stated as of 4 : 30 p.m. the vehicle was still in non- compliance . Mr. Carroll asked Code Enforcement Officer McDougal if he did not have means to move the car or just did not want to. Code Enforcement Officer McDougal stated that Mr. Sloane did not want to move the vehicle. He stated that Mr. Sloane said he was going to put up a fence to hide the car.
