12-12-1990 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING HELD DECEMBER 12. 1990 ROLL CALL Present: Chairman John Linebarier, Vice Chairman Pitt Varnes, Members Phillip Rowe, Gary Carroll, Frank Carlsson, Robert Imes, Code Enforcement Officers Steve Ross and Rod McDougal and Deputy Clerk Sherry Seaver. Absent: Member Ray Wood and Attorney Ike Cool APPROVAL OF MINUTES Mr. Imes made a motion to approve the minutes of the November 27, 1990 meeting as printed and distributed. Motion seconded by Mr. Carlsson and approved unanimously. OTHER BUSINESS Case 90-122, Ernest G. &/or Ivonna P. Hataway Chairman Linebarier stated for the record that both Respondents were present at the meeting. At this time, Code Enforcement Officers Ross and McDougal were sworn in by Deputy Clerk Seaver. cow Code Enforcement Officer Ross stated that since the last meeting in November there had been minor changes in the property. He presented pictures to the Board for review. Mr. Hataway asked for more time to get his property cleaned up. Mr. Carroll handed Mr. Hataway the pictures of his property and asked him if that was his property. Mr. Hataway stated yes. Mrs. Hataway said that they had worked all day to clean up the trash. Mr. Carlsson stated that he knew that the property was to be cleaned up by December 11, 1990. Mr. Hataway stated that he tried but he was trying to hold down a job and clean it too. At this time Tim Davis was sworn in by Deputy Clerk Seaver. Mr. Davis stated that Mr. Hataway was trying to get it cleaned up and that he had been helping himself. Mr. Carlsson made a motion to find the Respondent in non-compliance of the Order imposed on November 27, 1990 and to sign the Order Imposing Fine and Lien to be retroactive to the original Compliance Order imposed as of November 15, 1990. Motion seconded by Mr. Rowe. Mr. Varnes stated that he was unimpressed with the action on the clean up. He would like to give him three more days. Mr. Carroll stated that the Board should stand behind its Code Enforcement Officers. The motion carried with five votes for and one "nay" by Chairman Linebarier. Chairman Linebarier urged Mr. Hataway to clean up the property as soon as possible and to contact Code Enforcement Officer Ross and let him reinspect the property. L Page 2 Code Enforcement Board Meeting December 12, 1990 Case 90-131, Domenic A. Macaione C/O Whitehill Group Ltd. Code Enforcement Officer McDougal stated that there was an error in the proof of service mail from the Post Office, therefor the judgement made on November 27, 1990 would need to be rescinded. Mr. Carlsson made a motion to rescind the judgement made on November 27, 1990 and to rehear Case 90-131. Motion seconded by Mr. Imes and approved unanimously. Code Enforcement Officer McDougal stated that he had spoke with Mr. Macaione and that he was told the property would be cleaned up by November 17, 1990. He had hired someone to clean the property. Mr. Macaione would not be at the meeting. Mr. Carroll made a motion to find the Respondent in non-compliance and to give him until December 18, 1990 to comply or to be fined $150.00 per day thereafter. Motion seconded by Mr. Varnes and approved unanimously. Case 90-130, Lake Lotta Ltd. Mr. Imes made a motion to waive any penalties on Lake Lotta Ltd. for going over the date set by the Compliance Order. Motion seconded by Mr. Varnes and approved unanimously. COMMENTS A.
