Background Summary: The Lakeshore Center Expansion project was designed by Rhodes + Brito, architects, under a continuing services contract with the city. Given the complexity of the project, procurement of a construction firm to build the facility was undertaken using the construction manager at risk method (CM at Risk), as provided in §255.103, Florida Statutes. This relatively new way of hiring a contractor uses the same qualifications-based approach (Request for Qualifications, or RFQ) used for hiring licensed professionals, such as architects and engineers. This selection method was used because it requires the contractor to be involved in the design of the building, which provides two benefits. First, the contractor can provide input to the design process that could lower the difficulty and cost of construction. Second, the extensive interaction with the plans prior to providing the city with a price for the construction work allows the builder to become very familiar with the plans and for the city to avoid issues related to typical low-bid procurements. Failure of the contractor to understand the plans was a source of continuing difficulty with the building's original construction. The City Commission awarded the work to the Collage Design & Construction Group, Inc., d.b.a., The Collage Companies, which has completed the pre-construction portion of their work. In accordance with §255.103(2), Florida Statutes, the CM at Risk provided a guaranteed maximum price (GMP) and a guaranteed completion date. The original GMP was $3,492,279, which was used by the City Commission to establish a construction phase budget of $3.6 million. As noted in the related agenda report, "some design details are still being addressed, including changes requested by the city following completion of the construction documents, and the final precise cost of some finish items is not yet known, particularly those items needed later in the project." Subsequent plan changes, construction method selections, value engineering modifications, and inclusion of items previously excluded from the GMP but necessary for the building to be usable have increased the construction cost GMP to $3,854,718. This number includes coverage of some items that are still to be resolved at a "worse-case" level, plus a contractor's contingency of $95,000. Beyond the capital cost of construction, there is also the need to acquire fixtures, furnishings, and equipment (FF&E) that are outside the scope of the work being performed by the CM at Risk. These items include tables, chairs, portable dance floor, some AV equipment, kitchen equipment, and other items needed to utilize the enlarged banquet space to its full capacity. Construction must begin by May 18 if the project is to meet its deadline for exterior construction to be finish before the area is needed for Founders' Day activities November 1. Issue: Should the City Commission increase the authorized budget allocation for construction services related to the Lakeshore Center Expansion project to $3,900,000 and the total project budget to $4,300,000? Recommendation: Staff recommends that the City Commission increase the total project budget to $4.3 million and the budget allocation for construction to $3.9 million. Attachment: Revised GMP construction phase cost estimate from the CM at Risk, The Collage Cos. Financial Impact: The original 2017 General Fund Capital Budget Bond allocation for the Lakeshore Center Expansion project was $4 million for construction; however, this budget must also cover the cost of design and FF&E needs. At the time the construction phase work was awarded at a level of $3.6 million, the unencumbered balance for the project budget was $3,731,316.80 and the total cost of the project was still under the $4 million budget. Although the cost of construction remains less than $4 million, the cost of design services, construction administration, and FF&E collectively push the total cost beyond the existing project budget allocation. Thus, an additional $300,000 is needed in the project budget in order to proceed. The proposed source of the additional budget is the Recreation Impact Fund, which has sufficient funds for this purpose. The budget addition will raise the total project budget to $4.3 million. This funding level is required in order to make the GMP commitment while also reserving funds for FF&E purchases, but should be more than what may ultimately be needed given the possibility of savings that would put the final cost below the GMP. Accordingly, the City Manager should be empowered to make adjustments within the total project budget up to the limits of his purchasing authority and to return funds to their original source or re-allocate unused budget to meet other needs related to Downtown Redevelopment capital projects.
