BEHRENS, DIRECTOR OF PLANNINGAej DATE: FEBRUARY 14, 1991 SUBJECT: CLARK ROAD LANDSCAPE DESIGN CONTRACT ISSUE: Should the Honorable Mayor and Board of City Commissioners approve the hiring of Glatting, Lopez , Kercher and Anglin as the City's Landscape Architect for Clark Road. BACKGROUND & DISCUSSION: The City Commission authorized the hiring of a landscape architect on October 2 , 1990 (see attached minutes) . The Clark Road Development Committee considered proposals from three firms . One proposal far exceeded the scope of work called for and was beyond what could be considered under the competitive negotiations act without a long bidding process . The two other firms were Canin & Associates and Glatting, Lopez , Kercher and Anglin. These two proposals were within 50 dollars of each other (Canin $5, 900 . 00 and Glatting, Lopez $5, 850 . 00) . But, the Clark Road Development Committee voted unanimously that the proposal from Glatting, Lopez , Kercher and Anglin was superior and more thorough in its scope. RECOMMENDATION: Staff recommends that the firm of Glatting, Lopez , Kercher and Anglin be hired as the landscape architect for Clark Road and that the attached contract be executed by the Honorable Mayor and City Commission. BCB/emk Attachments Page 2 Ocoee City Commission Regular Meeting October 2, 1990 clarify further, asked if this is from the point where the power company connects to the pigtail above the meter box on that will be copper. Mr. Hendrix replied that was correct. Commissioner Foster expressed concern regarding the word "altered" because that would mean that a person would be prohibited from making any correction, addition, change, or alteration to an existing structure without rewiring the whole building. City Manager Shapiro pointed out that is already the case with other building and fire codes if the change involves increasing footage or changing the use of the building, but that this does not mean wiring the whole building, only the main box area. Commissioner Combs requested that applicants for home additions be advised at the time of application regarding this change. Commissioner Woodson, seconded by Commissioner Combs , moved to adopt Ordinance No. 90-22 relating to regulating electrical construction. On roll call Commissioner Combs voted "aye , " Commissioner Foster "aye , " Commissioner Johnson "aye, " Commissioner Woodson "aye , " and Mayor Dabbs "aye. " Motion carried. SELECTION OF DEPOSITORIES FOR CITY FUNDS As Article 6 , Section 10 of the City Charter requires that depositories for City funds be designated at the first regular meeting each fiscal year , staff presented a list of depositories approved by the State Department of Insurance, Office of the Treasurer, and recommended continuing the use of the current depositories , Orange Bank and Barnett Bank. Commissioner Woodson, seconded by Commissioner Combs , moved to approve staff recommendation. Motion carried with 4-0 vote in favor . During this presentation Commissioner Johnson was absent from the table and therefore did not cast a vote. CLARK ROAD DEVELOPMENT COMMITTEE RECOMMENDATIONS The Clark Road Development Committee recommended the following: 1) That Clark Road be renamed Ocoee Boulevard. -� 2) That a landscape architect be hired as part of the design team �— for Clark Road. 3) That the lighting on the Clark Road corridor include more lighting per mile than is currently being used on City streets , and that the possibility of softer light (i .e. , halogen light) be considered by the architect at the direction of the Honorable Mayor and Board of City Commissioners . There was discussion regarding the use of trees , with Commissioner Woodson speaking against trees in the middle of the road, Commissioner Foster speaking for a tree lined boulevard and Mr. Mohnacky objecting to the use of trees in the right-of-way. Commissioner Foster, seconded by Commissioner Combs , moved to approve the Committee ' s recommendation. The CITY desires to retain the PLANNER to assist in establishing design guidelines for this corridor. 1.2 For purposes of bookkeeping and correspondence, the name of this project shall be known as "OCOEE/CLARK ROAD DESIGN GUIDELINES," GLKA Project #8120.00. 2.0 SCOPE OF SERVICES Our firm believes in the design process and using that process to build a consensus for Ocoee s vision of the Clark Road corridor. We believe in an interactive process involving the community that leads to guidelines that have a strong local constituency. Standards that do not have a consensus among the people who will be required to implement and carry out the details will not be effective. PART I - CLARK ROAD CORRIDOR DESIGN GUIDELINES 2.1 Kick-Off Meeting - Upon notice to proceed, the PLANNER will meet with City staff and the Clark Road Development Committee to review the scope of work, define the study area, and agree upon a schedule for the project. Orlando, Florida 32801 (407) 8.11-6552 • FAX (407) 839-1789 aril\ The PLANNER will review previously prepared material including minutes of previous meetings of the Committee, preliminary engineering work, available draft elements of the City of Ocoee Comprehensive Plan, and other available background information. 2.2 Clark Road Corridor Vision - The PLANNER will attend a workshop for the purpose of setting goals for the development standards. The intent will be to discuss various levels of quality that are appropriate and to arrive at a consensus with the participants. There may be some preliminary design ideas presented by the PLANNER in an effort to stimulate discussion. 2.3 Draft Development Standards - The PLANNER will prepare a draft set of development standards for the Clark Road corridor. The standards shall be in an easy to read format, substantially illustrated. The following outline may be modified, but shall serve as the initial list of topics to be included: I. Introduction A. Building and Signage Exterior Lighting 2.4 The PLANNER shall present the draft guidelines to the City staff and Clark Road Corridor Development Committee. Following review and receipt of written comments from City staff the PLANNER will revise the guidelines and prepare them in final form. 2.5 Final Presentation - The PLANNER will present the finalized development guidelines along with an illustrative plan at an Ocoee City Council meeting or workshop. PART II - ADDITIONAL SERVICES 2.6 Additional Services - The PLANNER will provide Additional services as may be agreed upon by the City and the PLANNER. These services may include additional meetings, specific landscape architectural design and construction drawings, etc. 3.0 CLIENT RESPONSIBILITIES 3.1 The CLIENT shall be available to meet with the PLANNER and provide decisions in a timely manner. 3.2 The CLIENT has the responsibility to publicize public meetings, to notify property owners and tenants in the district, and to actively solicit their participation. 3.3 The CLIENT shall provide a scaled color aerial of the study area. 3.4 The CLIENT shall provide available planning and engineering documents necessary for the PLANNER to complete the tasks outlined above. 4.0 PROJECT SCHEDULE 4.1 Schedule - The PLANNER shall begin work on the project immediately upon receipt of this executed Letter of Agreement. 4.2 Time Completion - The PLANNER shall complete work in a timely manner. It is understood that performance shall be required by the City Staff. It is the intent of all parties to assist each other in minimizing the impact of unforeseen delays. 5.0 ASSIGNED PERSONNEL The following personnel from Glatting Lopez Kercher Anglin, Inc. shall be assigned to this project, and shall have the responsibilities described: 5.1 John F. Rinehart - Principal-In-Charge 5.2 Joe Anglin - Design Principal 5.3 Walter Kulash - Senior Transportation Engineer 6.0 COMPENSATION 6.1 Part I - The fee for Part I, Design Guidelines, shall be a lump sum of Five Thousand Eight Hundred Fifty Dollars ($5,850.00). 6.2 Part II - The fee for Part II, Additional Services, shall be on an hourly basis using the rate schedule below or as a negotiated lump sum fee. 6.3 Direct Expenses - All direct expenses incurred in completing the scope of services shall be billed to the CLIENT at a multiple of 1.15 times cost. These costs are in addition to the fees quoted for each Part of the Scope of Services. Direct expenses include costs for reproduction, printing and other miscellaneous expenses. Mileage shall be billed at a rate of $0.24 per mile. Application, filing and permit fees shall be paid by the CLIENT. 6.4 Hourly Rate Schedule - The fee for services provided on an hourly basis shall be calculated using the following schedule: 6.4.1 Principal - $95.00 per hour 6.4.2 Senior Planner - $80.00 per hour 6.4.3 Planner - $60.00 per hour 6.4.4 Planning Technician - $40.00 per hour 6.4.5 Senior Transportation Planner - $90.00 per hour 6.4.6 Transportation Planner - $65.00 per hour 1 6.4.7 Transportation Technician - $50.00 per hour 6.4.8 Senior Landscape Architect - $70.00 per hour 6.4.9 Landscape Architect - $50.00 per hour 6.4.10 Landscape Designer - $40.00 per hour 6.4.11 CADD Operator - $50.00 per hour 6.4.12 Administrative Assistant - s $35.00 per hour 6.4.13 Word Processor , $30.00 per hour 6.4.14 Graphic Artist - $35.00 per hour 6.5 Retainer - No retainer shall be required. 7.0 :TERMS OF AGREEMENT 7.1 The PLANNER shall exercise professional skill in executing our work; however, we cannot guarantee the action of any governmental official or agency insofar as meeting the desired governmental approvals. The CLIENT does hereby agree to reimburse the PLANNER for all invoices submitted within the scope of this Agreement, regardless of the results of governmental actions. 7.2 This Letter of Agreement shall be valid for CLIENT acceptance for a period of fifteen (15) days from the date of execution by the PLANNER. We are prepared to initiate work immediately upon receipt of a signed contract. 7.3 This Letter of Agreement may be terminated by either party with fifteen (15) days written notice. In the event of termination, the PLANNER shall be compensated to the date of termination, including direct expenses then due. 7.4 Invoices for work completed shall be submitted on a four- week basis. Payment shall be due upon receipt. The CLIENT agrees to pay a fee of 1.5% per month of invoice balances outstanding more than thirty (30) days. The PLANNER reserves the right to withhold submittal of work products to the CLIENT, and/or governmental agencies on behalf of the CLIENT, dependent upon payment in full of all invoices outstanding. The PLANNER may also elect to stop work until payment is received. If work is stopped for sixty (60) days or more, the PLANNER shall be compensated for start-up costs when work resumes. 7.5 All rates and fees quoted in this document shall be effective for a period of twelve (12) months, after which time they may be renegotiated with the CLIENT. 7.6 All original documents shall be retained by the PLANNER, and shall remain his property. This information is proprietary and shall not be shared with others without prior written consent. The CLIENT shall be provided with reproducible copies of all original documents at his 1 _ . ar-\. expense. The PLANNER shall retain original documents on his premises for a period of two (2) years following completion of the project. After that time, the PLANNER shall reserve the right to dispose of the documents at his discretion. 7.7 In the unlikely event that the PLANNER, must file suit to collect fees and costs, the CLIENT agrees to pay all attorney's fees and costs incurred for bringing such suit, and that venue for such suit will be in Orlando, Orange County, Florida.
