CITY MANAGER ELLIS SHAPIRO MEMORANDUM TO: THE HONORABLE MAYOR AND BOARD OF CITY COMMISSIONERS FROM: MONTYE BEAMER, DIRECTOR OF ADMINISTRATIVE SERVICES -- DATE: SEPTEMBER 27, 1991 SUBJECT: AGREEMENT FOR ARCHITECTURAL SERVICES - CITY HALL AND POLICE DEPARTMENT Following the various architects' presentations on August 20, 1991, Staff was directed to negotiate with the top-ranked firm PDR Architects, Inc. . During these negotiations, changes to the agreement originally distributed were made; these revisions have been summarized on the attached memo from Susan Swilley, Purchasing Agent. The revised agreement has been reviewed by the City Attorney and found to be acceptable. The cost for architect services is $95,500. The phases and percentage of payment for specific work products are as follows: PHASE PERCENTAGE Plan finalization/Site Plan 9% Development Schematic Design 10% Design/Development 19% Construction Documents 38% Bid/Negotiation 5% Construction Administration 19% 100% Authorization for performance of each of these phases will be in the form of work orders. The proposed budget for the expansion has been detailed and is attached. All fees including architectural, engineering, legal and survey account for 6.8% of the total budget. Staff recommends that the Honorable Mayor and Board of City Commissioners ( 1) approve the Agreement for Architectural Services with PDR Architects, Inc. , and (2) authorize the Honorable Mayor to sign the Agreement. It formers read : "An example of such an expedited- incent .ve schedule , if employed , might be : " . The examples which followed have also been deleted ; 2 ) Section -4 ( a ) : The words. " to be negotiated" were removed from the first sentence a� with the , erbage beginning with T and replaced " reflecting" and ending at sentence completion . Section ( b ) : tcrbag ' added to the last sentence beginning with the word "and" ,, ending at sentence complet ion . Sect ion ( c ) : The first two sentences have been added , the original first sentence fellows then the orig inal second sentence which formerly read, "As applicable , the percentage of total services represented by the four ( 1 ) phases E`;� negotiated� identified in "Scope of Work" i� 2bit "A" shall be for and included in each Project Work Order . " has been deleted . The remainder of Section ( c ) is new verbage . Section ( 'c ) ( 1 ) has an entirely- new sentence which formerly read , "As a rule , the following phases will be used as guidelines by both CITY and ARCHITECT . " Also , percentages have been added . Section ( d ; : The first sentence has been added as well a.s the word "other" in the second sentence ; 3 ) Section 7 ( ,_• ) : This is an entirely new paragraph which formerly read : " If , because of ARCHITECT breach , CITY incurs any expense in enforcienforcingthe terms of this Agreement , whether suit be brought or not , ARCHITECTagrees to pay all such costs and expenses , including , but not limited to , court costs , interest and reasonable attorneys ' fees . " ; 4 ) Section 9 C c ) : Verbage added to the last sentence beginning with the word "however" and ending at sentence completion ; 5 ) Section 15 ( d ) : The entire last sentence has been deleted . ii. formerly read : "In the event CITY so elects , upon written receipt of written notice of assignment by CITY , ARCHITECT shall accept , in writing , an assignment of any such agreement or- contract CITY may have with any separate architect , consulting engineer or design professional , by which ARCHITECT shall assume any and all obligations of CITY thereunder and shall be fully responsible for any such separate architect , consulting engineer or design professional as a Subconsultant ; and 6 ) Section 17 (a) : This Section contains all new verbage after the first sentence .
