CONTRACT - ENGINEERING SERVICES FOR THE MUNICIPAL
COMPLEX
The attached proposal for $15,500 from Professional Engineering
Consultants represents the land surveying, civil engineering and
construction administration services necessary for the expansion of
City Hall and Police Department. As indicated in PDR's proposal,
PEC was to be a part of its team. Since the City of Ocoee currently
has a contract for engineering services with PEC, Staff has elected
to utilize their services directly as opposed to indirectly through
PDR.
Staff recommends that the Honorable Mayor and Board of City
Commissioners ( 1) approve the proposal as submitted by Professional
Engineering Consultants and (2) authorize the Honorable Mayor to
execute the Acceptance of the Proposal and Authorization to
Proceed.

Dear Ms. Beamer:
Professional Engineering Consultants, Inc. (PEC) is pleased to provide this proposal for the
above referenced project.
BASIC SERVICES
Following is a list of Basic Services we believe necessary to accomplish the work required for
the referenced project.
Land Surveying Services
A) Off-site Sewage Force Main Route Survey: Perform necessary field work and
prepare related survey drawings for preparation of final construction drawings.
The survey will include location and topographic information along the proposed
off-site force main alignment to the connection point with the existing force main
from the Tricon Shopping Center lift station.
Civil Engineering Services
A) Schematic Design: Participate in meetings with the City and project Architect to
provide input to the development of the site plan layout; prepare preliminary
design layout for the stormwater drainage system, water distribution and sanitary
sewage collection/transmission system improvements based on the Schematic
Plans (3 plans maximum) prepared by the Architect; prepare preliminary
construction cost estimate for the site improvements; and conduct meet-
ings/conversations with the local and state regulatory agencies to refine design
and permitting criteria for the project; review available soils information for the

project site and prepare recommendations for additional geotechnical investiga-
tions, if necessary.
B) Design Development: Participate in meetings with the City and project Architect
to provide input to finalization of the site plan layout; refine preliminary design
layout for the stormwater drainage system, water distribution and sanitary sewage
collection/transmission system improvements; prepare preliminary grading for the
site and building elevation; prepare preliminary construction cost estimate for site
improvements; and prepare preliminary outline for project technical specifica-
tions.
C) Final Construction Documents: Preparation of final civil engineering calculations
and construction documents consisting of construction drawings and technical
specifications for the site geometry, paving, grading, drainage, sidewalks,
pavement striping and signage, water distribution system (including fire line to
the building based on line size determined by the Architect), and sewage collec-
tion/transmission system improvements; preparation of construction cost estimate
for site improvements; provide coordination as necessary with the project
Architect to facilitate the final civil construction drawings and specifications
compatible with the architectural construction documents.
D) Permitting: The following site-related permits are anticipated to be required prior
to construction of the proposed improvements.
1. Preparation and processing of the Florida Department of Environmental
Regulation (FDER) permit application for construction of sewage collec-
tion/transmission system.
2. Preparation and processing of the Florida Department of Environmental
Regulation (FDER) permit application for construction of the water
distribution system.
3. Preparation and processing of the St. Johns River Water Management
District (SJRWMD) permit application for construction of the stormwater
management system improvements.
4. Preparation and processing of the SCL Railroad utility permit for
construction of the sewage force main within the right-of-way.

5. Preparation and processing of the U.S. Army Corps of Engineers (ACOE)
short form permit application for dredge and fill requirements within the
ditch traversing the site.
Though permit applications are prepared according to applicable regulatory
agency regulations, codes and laws, we cannot guarantee approval of the permits
by the various agencies due to circumstances beyond our control.
Construction Administration Services
The following construction administration services are anticipated as a part of this
proposal.
1. Attend pre-bid meeting, if required, to answer questions concerning the design,
specifications, or other matters related to the project.
2. Review bids with respect to the site improvements. The results of such reviews
will be reported directly to the Owner and Contractor.
3. Attend pre-construction meeting with Owner, Architect, Contractor.
4. Review and processing of shop drawing submittals. The results of such reviews
will be reported directly to the Architect.
5. Provide interpretation and clarification of the construction documents to the
Owner and Contractor.
6. Make site visits at intervals appropriate to the various stages of construction as
necessary to observe the progress and quality of the various aspects of the
Contractor's work, but not less than one site visit per week. Based on observa-
tions and/or information obtained during such visits, reports shall be provided to
the Architect advising of the work progress and whether the work is proceeding
in general conformance with the construction documents. It is estimated that up
to eight (8) site visits will be required through the construction phase of the
Project.
7. Review periodic pay request with regard to the site improvements.
8. Prepare certification to Owner and regulatory agencies as required by permits
obtained for the Project.

Basis of Proposal
This proposal is based on the following conditions and assumptions:
1. The final construction documents will include details of site improvements to five
(5) feet outside the building envelope.
2. Geotechnical investigations and construction testing services for the project shall
be provided by the Owner.
3. Engineering services related to the surveying of any jurisdictional wetland
encroachment are not included in this proposal.
4. Architectural, traffic engineering (e.g., studies, signalization), mechanical
engineering (e.g., fire pumps), geotechnical engineering and testing, construction
layout surveys, landscape and irrigation design and non-utility engineering (e.g.,
power, gas, telephone, cable television, site lighting) services will be provided
by others.
5. Underground utility location information will be provided by the servicing utility.
Any utility investigation required in addition to information made available by the
utility companies may be provided as an additional service performed based on
the attached hourly rate sheet (Exhibit "A"), or in the case where an underground
contractor is required, those costs will be billed directly to the client as they are
incurred.
6. No permit application or negotiation with permitting authorities, other than those
specifically listed hereinbefore, are included; unusual or extensive request for
additional information by regulatory agencies may be provided as an additional
service performed, based on the attached hourly rates (Exhibit "A"), upon
authorization by the Owner.
Additional Engineering Services
Following is a list of Additional Engineering Services that are not included as part of the Basic
Engineering Services. These services, if required, shall be performed upon proper authorization
by the Owner.
1. Services to make measured drawings of or to investigate existing conditions or
facilities, or to verify the accuracy of drawings or other information furnished by
Owner.

2. Services resulting from significant changes in the general scope, extent or
character of the Project or its design including, but not limited to, changes in
size, complexity, Owner's schedule, character of construction; and revising
previously accepted studies, reports, design documents or Contract Documents
when such revisions are required by changes in laws, rules, regulations,
ordinances, codes or orders enacted subsequent to the preparation of such studies,
reports or documents, or are due to any other causes beyond Engineer's control.
3. Services resulting from the award of more than one separate prime contract for
construction of the Project.
4. Prepare for review and approval by Owner or its legal counsel contract agreement
forms, general conditions and supplementary conditions, bid forms, invitations to
bid and instructions to bidders.
5. Further bidding and negotiating services including assistance in connection with
bid protests and rebidding or renegotiating contracts for construction, materials,
equipment or services.
6. Providing any type of property surveys or related engineering services needed for
the transfer of interests in real property and field surveys for design purposes and
engineering surveys and staking to enable Contractor(s) to proceed with their
work, and providing other special field surveys.
7. Preparing to serve or serving as a consultant or witness for Owner in any
litigation, arbitration or other legal or administrative proceeding involving the
Project.
8. Services in connection with work directive changes and change orders to reflect
changes requested by Owner.
9. Services in making revisions to construction documents occasioned by the
acceptance of substitutions proposed by Contractor; and services after the award
of each contract in evaluating and determining the acceptability of mor than three
substitutions proposed by Contractor.
10. Additional or extended services during construction made necessary by a
significant amount of defective or neglected work of the Contractor, acceleration
of the progress schedule involving services beyond normal working hours, and
default by any Contractor.

11. Services required due to conditions different from those itemized under Basis of
Proposal or due to events beyond the control of the Engineer.
12. Services related to construction survey and/or as-built surveys.
Client Responsibilities and General Terms of Agreement
The attached Exhibit "B" defines the Owner Responsibilities and General Terms of Agreement.
Payments to Engineer
1. Basic Engineering Services: Engineering services itemized under the Basic
Engineering Services shall be performed on a lump sum basis as indicated below:
Land Surveying Services
A. Off-site force main route survey $ 2,000.00
Civil Engineering Services
A. Schematic Design 1,500.00
B. Design Development 2,500.00
C. Final Construction Documents 5,000.00
D. Permitting 1,500.00
Construction Administration Services
(See Note 1) 3.000.00
TOTAL $15,500.00
Note 1: The fee for construction administration services includes up to eight site
visits during the construction phase.
2. Additional Engineering Services: Any engineering services authorized by the
Owner and performed as an Additional Engineering Service shall be performed
on a time-and-material basis pursuant to the attached standard hourly rate sheet
(Exhibit "A").
3. Reimbursable Expenses: Reimbursable expenses, such as plotting and printing
of drawings and specifications incurred in connection with all Basic and
Additional Engineering Services shall be paid by the Owner. Reimbursable

expenses shall be billed according to the rates itemized in Exhibit "A" for
interoffice expenses. Outside reimbursable expenses shall be billed at cost.
Reimbursable expenses for the subject project are estimated to not exceed
$350.00.
4. Permit Fees: Permitting fees associated with any required permits for the Project
shall be paid by the Owner.
The terms of this proposal shall be valid for acceptance for a period of sixty (60) days from the
date of execution by PEC.

you on this project. We are prepared to commence work on this assignment as soon as an
agreement for the work is executed.
