NEW BUSINESS — Public Hearings (6:35 pm) City Planner Rumer welcomed the board and announced that Item E, Nicole Boulevard will be continued to the next meeting with new notices sent out and re-advertised. A. Alli Property — 735 Center Street Annexation & Rezoning; Project No(s): AX-06-17-61 & RZ-17-06-02. (Advertised in the West Orange Times on Thursday, June 28, 2018) (Planner I Jones) (6:37 pm) I a. Planner Jones presented a brief overview of this proposed annexation and rezoning, which is located on the south side of Center Street, 450 feet east of Orange Avenue and north of Silver Star Road. The subject parcel is +1- 0.68 acres and has one existing single-family residence. The Applicant is annexing into the City limits as a condition to receive city potable water connection. This property is vacant, but just recently went into construction for a building under Orange County's jurisdiction, which inhibits the City to take this project to the City Commission until the City receives a Certificate of Completion from Orange County. Once the Certificate of Completion is received from Orange County with a recommendation from the P&Z Board, then the project can go forward to the City Commission for final approval. The subject property is considered contiguous to the City of Ocoee since it is bordered by property located within the City limits on the north and south. Upon annexation, this parcel will receive an "R-1A" (Single Family Dwelling) zoning, because it complies with the surrounding areas. The proposed annexation is a logical extension of the City limits, urban services can be provided along with trash services, police and fire assistance. This annexation meets State and local regulations. 2 Planning and Zoning Commission Meeting July 10,2018 Development Review Committee(DRC)Recommendation: On July, 2018, the DRC met to determine if the proposed annexation and rezoning was consistent with the City's regulations and policies. When the discussion was finished, the DRC voted unanimously to recommend approval of the annexation and rezoning for the Alli property. (Advertised in the West Orange Times on Thursday, June 28, 2018) (Planner 1 - Jones) (6:43 pm) qqI Planner Jones presented a brief overview of this proposed rezoning, which is located on the west side of South Bluford Avenue and on the south side of West Columbus 3 Planning and Zoning Commission Meeting July 10,2018 Street. The subject parcel is +1- 4.51 acres and currently vacant. The Applicant is rezoning the property in order to conform to the existing land use designation. The property was historically used as a truck yard for Florida Rock Industries. The parcel is currently zoned "1-2," which conflicts with the existing and future land use designation of Light Industrial. The "1-2" zoning designation is intended for the heavy industrial land use. The City desires to keep heavy industrial away from residential areas which are located nearby. Therefore, the subject property is being rezoned to "I-1," which is in line with the existing land use designation. Development Review Committee(DRC)Recommendation: On June 28, 2018, the DRC met to determine if the proposed rezoning was consistent with the City's regulations and policies. When the discussion was finished, the DRC voted unanimously to recommend approval of the rezoning for the Top Gun Cheer property. Greens at Forest Lake Planned Unit Development (PUD) Large Scale Comprehensive Plan Amendment and Zoning to PUD/Land Use Plan (PUD/LUP); Project No(s): CPA-2018-005 & RZ-18-03-05. (Advertised in the West Orange Times on Thursday,June 28, 2018) (City Planner Rumer) City Planner Rumer presented a brief overview of this proposed Large Scale Comprehensive Plan Amendment from Low-Density Residential to Medium Density Residential and rezoning to Planned Unit Development/ Land Use Plan (PUD/LUP). The subject property is located on the north side of Palm Drive, on the west side of State Road 429 (Western Expressway) and the east side of East Crown Point Road. The Parcel Identification Numbers are 05-22-28-0000-00-016, 05-22-28-0000-00-017 and 05-22-28-0000-00-043 and approximately 29.17 acres of vacant and undeveloped land. The Applicants propose to develop the 29.17 acres as a 200 lot townhome development with a density of 6.89 dwelling units an acre, which exceeds the four (4) units per acre guidelines for low-density residential. Access to the site will be via an extension of Fountains West Boulevard. The West Orange Trail is adjacent on the west, which is a main selling point for this multifamily development. The PUD/LUP will require an extension of the road, which will require communications with the Orange County Trail Department to connect West Road to this site running through the West Orange Trail. A master stormwater system is proposed and contains over six (6) acres of open space. The subject site is located within the Apopka Drainage Basin; and therefore, must meet the requirements of Section 11.7 (a) SJRWMD Management and Storage of Surface Water Handbook and Wekiva Study Area BMP's. City Planner Rumer further explained there are no level-of-service issues pertaining to the surrounding roads. There may be potential operational issues at Fountains West Boulevard and West Road where there is currently not a signal. The proposed PUD accesses Fountains West Boulevard and West Road, which is a County-maintained road. Traffic will also utilize Ocoee Apopka Road. This project did not pass for the level- of-service pertaining to schools and will have to mitigate for the extra capacity of 10.914 elementary school students and 14.972 middle school students. Most proposed developments with Ocoee fail middle school, because there is only one. This applicant is currently working with Orange County Public Schools (OCPS) on this process. This project does meet the level-of-service requirements for police and fire response times. This site is located within Orange County's utility service area and is proposing to connect to Orange County for water and sewer, which Orange County has indicated they have capacity for this proposed development. The Applicant is present. 5 Planning and Zoning Commission Meeting July 10,2018 Development Review Committee(DRC)Recommendation On June 28, 2018, the DRC met to determine if the proposed Large Scale Comprehensive Plan Amendment and rezoning to PUD was consistent with the City's regulations and policies. When the discussion was finished, the DRC voted to recommend approval of the Large Scale Comprehensive Plan Amendment and rezoning to PUD/Land Use Plan for Greens at Forest Lake. Staff Recommendation: Based on the above analysis and the subsequent DRC recommendation, Staff recommends that the Planning&Zoning Commission recommend approval of the Large Scale Comprehensive Plan Amendment from Low-Density Residential to Medium Density Residential and rezoning to PUD/ PUD Land Use Plan(Planned Unit Development). Discussion: e (7:07 pm) Member Wunderlich inquired whether they need to state in their motion the denial of the school capacity enhancement by OCPS. City Planner Rumer answered they do not; and further, the developers will resolve that issue before the final adoption with the City Commission. Vice-Chair Williams asked for clarification on the proposed zoning of PUD. City Planner Rumer explained the proposed medium density allows up to eight (8) dwelling units per acre; and further, the R-3 Multi-Family Dwelling is for apartments/duplexes, but not conducive to a townhome development such as this proposed project. Vice-Chair Williams questioned the developments to the west, which is also a PUD. City Planner Rumer explained the Fountains West PUD and Arbors Apartments PUD, which are located to the west of this proposed development. Chair Keller inquired if there will be enough parking at the amenity center for their meetings. City Planner Rumer expressed that parking is looked at as a whole within the development and not just at the amenity center. He emphasized that the townhomes will have a two-car garage and essentially four vehicles can park at each home; and further, he believes there is an adequate supply of additional parking located throughout the development, not just at the amenity center. Discussion ensued about the fencing along the golf course to which City Planner Rumer indicated most golf courses prefer wrought iron fences, which will be the prime lots within this development. He further expressed that the golf course is fully aware of this proposed development, and they wish to incorporate it into their course somehow. Member Mellen asked if there is a sound barrier type fence along the 429. Tom Daly, Applicant, Daly Design Group, Inc., 913 North Pennsylvania Avenue, Winter Park, said that there is a significant 75-foot buffer that is a part of the PUD. City Planner Rumer followed up and indicated there currently is no sound barrier, which is 6 Planning and Zoning Commission Meeting July 10,2018 installed by FDOT or the Expressway Authority; and further, those agencies will not install sound barriers after a development is approved. Member Bernstein asked the city planner to explain the level-of-service (LOS) distinctions pertaining to traffic studies. Tom Daly described the proposed PUD to be 200 units at approximately 1,700 to 2,000 square feet, double-car garage, fee-simple townhomes built by Meritage Homes. There is proposed an open space or dry pond located in the center of the PUD. The recreational amenity area will be located by the West Orange Trail. The price range will start in the mid two hundreds. Member Mellen asked if this is proposed to be a gated community. Tom Daly indicated it will not be gated, and the streets will be public. Chair Keller expressed whether they would really want the playground and amenity center off of the trail, which may draw people in who are not allowed to be there. Tom Daly said more than likely the park and pool will be gated and locked. ? J (7:31 PM) Chair Keller opened the public hearing and asked if there is anyone present who wishes to speak on this proposed project. Malka lsaak, 5305 Clouds Peak Drive, Lutz, FL, said she is the owner of the five-acre parcel that is adjacent to the south and is not included in this project. She indicated she supports this project and is happy to see something happening in this area; and further, said she spoke with the applicant earlier today about acquiring her property. She explained she did not know about this project until a few days ago. She is concerned about her parcel getting "locked in." She explained she would like the north part of her property to be close to the road connecting this development so that her property has access to a road. She further expressed she spoke to the developers about giving some of the southern part of her property for a connection to West Road. She further indicated her parcel is located within Orange County, not the city. City Planner Rumer further explained that the proposed road will connect on the north side, which will give her site access to a public road. He does not believe the developers would request any land from her parcel, but that could change. Chair Keller closed the public hearing. D. Arya Independent Living Preliminary/Final Large Scale Site Plan; Project No: LS-2018-007. (Advertised in the West Orange Times on,Thursday, June 28, 2018) (City Planner Rumer) (7:40 pm) City Planner Rumer presented a brief overview of this proposed Preliminary/Final Large Scale Site Plan, which is located on the north side of Roberson Road approximately 627 feet east of Tomyn Boulevard (Windermere Road) intersection. The property is approximately 10.47 acres in size of which approximately 2.45 acres are designated as wetlands/flood zones. The subject property consists of a vacant and undeveloped land fronting on Roberson Road. The Applicant will be dedicating 20 feet tract of land to the City of Ocoee for future right-of-way along Roberson Road. Consistent with City policy, the wetlands/flood zones and associated upland buffers will not be developed and will be dedicated to the City. Water, sanitary sewer, reclaimed water (when available), solid waste and police & fire protection will all be provided by the City of Ocoee. The Future Land Use designation for the subject site is "Low-Density Residential" and "Conservation/Floodplains." The requested "Independent Living" use is consistent with the Future Land Use element and zoning (R-1AA) district. 8 Planning and Zoning Commission Meeting July 10,2018 City Planner Rumer explained this preliminary/final site plan consists of a four-story 203,000 square feet, 142-unit Independent Living Facility for residents 55 and older. The facility will have only one main access point at Roberson Road. This main entrance will be aligned with the existing George Bailey Park entrance across the street. In addition, a 220 feet left-turn lane into the site will also be provided for an adjacent ALF/ Memory Care facility. The Applicant has requested one (1) Waiver from the Land Development Code for this project, which requests to permit a maximum height of 53 feet in lieu of the 35 feet by code. The trees in the adjacent wetlands will block the units from the neighboring site. The projected amenities include a pool with an outdoor area, walking/trail area with an open space. City Planner Rumer indicated the City of Winter Garden has partnered with Orange County and came to an agreement to install a roundabout at the intersection of Windermere Road and Stoneybrook West Parkway. He discussed adjacent parcels, such as a dog day care and Legacy Life Styles ALF/Memory Care facility, which is about to break ground. That facility is a three-story 112,269 square feet, 120 bed Memory Care/Assisted Living. The two projects provide for a unique opportunity to age in place or to have a spouse live next to someone needing daily care. Development Review;Committee(DRC)Recommendation: The Development Review Committee (DRC) met on June 28, 2018, and reviewed the Preliminary/Final Site Plan for Arya Independent Living Facility. There were several technical issues to be addressed from the City's Planning Division, Engineering Department and Utilities Department that were identified in written staff comments and/or presented verbally. All of these items were discussed, and changes to the plans were agreed upon. When the discussion was finished, the Committee voted unanimously to recommend approval of the Preliminary/Final Large Scale Site Plan. Staff Recommendation: Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of the Preliminary/Final Large Scale Site Plan for Arya Independent Living Facility. Discussion: (7:49 pm) Vice-Chair Williams inquired how the residents will access their units and whether there is only one main area to go in and out from the facility. City Planner Rumer indicated the building will actually be three separate buildings built together, which will have multiple access points. The required building and fire codes will be satisfied. Member Mellen asked how the FEMA floodplain relates to this development as opposed to the wetlands. City Planner Rumer indicated the City does not allow development within wetlands or floodplains; and further, developments adjacent to wetlands and/or floodplains must install a buffer. In conclusion, there are no wetlands or floodplain impact with this development. 9 Planning and Zoning Commission Meeting July 10,2018 Chair Keller asked if the building is going into the conservation area, because it looks as though it is on the map. City Planner Rumer said the building is not impacting the conservation area as there is a buffer around the building. He further explained the mitigation logistics that would need to take place with St. Johns River Water Management District (SJRWMD) if an impact were to take place. David Stokes, Applicant, Madden Morehead & Stokes, Inc., 431 East Horatio Avenue, #260, Maitland, announced he is the civil engineer on this project. He welcomed the new board and commented that their City staff is exceptional. He asked whether they have any questions and/or comments. City Planner Rumer turned the Board's attention to Page VA-1 to show the distance of the building from the wetlands. David Stokes explained the distance from the Arya building to the single-family homes is roughly 450 feet of dense wetlands, which he stated is their justification for the waiver on the height, the extreme distance. City Planner Rumer further expressed that an ALF is a very low traffic generator. Member Wunderlich asked what type of amenities or features are proposed that would make this project qualify for a 55 plus community. Ian McCook, Representing the Applicant, 451 Boynton Road, Maitland, presented a plan of the amenities and the ground floor space. He further explained there are a lot more amenities than a typical multifamily project with more food services, wellness center with a spa and doctor offices, hair services, club rooms and more. Chair Keller opened the public hearing and asked if there is anyone present who wishes to speak on this proposed project. He further stated this will be re-advertised, the public hearing sign will stay on the property and public notices will be resent to every property within 300 feet. V. MISCELLANEOUS - (7:59 pm) A. Project Status Report City Planner Rumer gave a brief overview of the current circumstances surrounding schools within the city. He explained OCPS owns a parcel on Ingram Road for a middle school in which the City approved a special exception for. There currently is a sign on the parcel indicating a school is coming, but there is no school in the five-year plan. OCPS even considered placing an elementary and middle school on that site, but no plans have come forth. OCPS also has a 15-acre site for an elementary school by Ocoee High School at Crown Point, but that school does not show up in their construction plan. OCPS was required to reserve 15-plus acres for a future school site at Arden Park, which will come to fruition soon. There was a redesign of Spring Lake Elementary, and Hackney Prairie is a newly-constructed school. City Planner Rumer explained the criteria for annexations. A proposed annexation must be adjacent to a parcel that is within the City on one side. A parcel can be adjacent across a lake or a river or a road. Planner Jones indicated if a parcel needs water connection, but is not adjacent and therefore cannot be annexed in, the owner can apply for an initial zoning. Once the property becomes eligible, the property owner can annex into the city. Discussion ensued regarding what is proposed to go where the Colony Plaza once stood and what is transpiring with Ocoee Village. B. July Calendar VI. BACKGROUND: The Nicole Boulevard Subdivision is proposed on a 6.184-acre remnant property that has a zoning designation of R-1. The property is located internal to the Twin Lake Forest Subdivision. Access to the site is from Nicole Boulevard. The property is wooded with no structures. There is a significant elevation change from Nicole Boulevard to the rear of the property. The property adjacent to Nicole Boulevard is at elevation 117 feet. The rear of the property is at 147 feet. The R-1 zoning designation permits single-family lots with a minimum width of 70 feet and an overall lot size of 7,000 square feet. The Future Land Use designation for the subject site is "Low-Density Residential" which allows up to 4 dwelling units per acre. The proposed subdivision consists of 19 lots meeting or exceeding the minimum lot size requirement of the R- 1 zoning district. The road will be constructed to public road standards and will be turned over to the City for maintenance. A stormwater pond which has been reviewed and approved by staff and the St. Johns River Water Management District will be maintained by the City as well. All effort has been made to not require a Home Owners Association to maintain the infrastructure due to the small number of lots. Also, there is no requirement to meet an architectural standard for this area. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) reviewed the Nicole Subdivision Preliminary & Final Subdivision Plan on May 24, 2018. There were several technical issues to be addressed by the Engineering Department regarding the stormwater pond and piping. All of the issues were discussed, and changes to the plans were agreed upon. When the discussion was finished, the Committee voted unanimously to recommend approval of the Preliminary & Final Subdivision Plan. The applicant has made the modifications to the plan and is now ready to be presented to the Planning and Zoning Commission. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff respectfully recommends that the Planning and Zoning Commission recommend approval of the Nicole Subdivision Preliminary & Final Subdivision Plan. BACKGROUND: The City currently regulates the location of storage containers or dumpsters by requiring them to only be located on a parcel within a fully screened masonry enclosure designed for that purpose. The City has also determined that clothes and other recyclable or donation bins are regulated under those same criteria. In order to more clearly define how clothes collection bins and collection trailers are regulated, an amendment to the Aland Development Code defining the terms and regulations are proposed. Staff is proposing to add the following definition to the Land Development Code: Collection bin or Collection trailer: Any stationary or free-standing container, receptacle or similar device that is located outdoors on any property within the City and is used for the collection of donated items, such as clothing, books, shoes or other non-perishable personal property, and which includes a mobile trailer used for the collection of donated items. This term does not include any of the following: (1) a bin used for the collection of donated items associated with a special event, provided the bin is removed when the special event ends, but in no event later than forty-eight (48) hours after being placed at the special event site; and (2) a container for the collection of recyclable materials associated with the City of Ocoee or the Orange County Solid Waste Division. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. Amendment to Section 2-4. Service, delivery, and dumpster areas must be located to minimize visibility from adjacent streets and adjacent properties. i. Service, delivery, and dumpster areas shall be located at the rear or side of the building and substantially screened with masonry walls and opaque landscaping. iii. No long-term storage containers, compactors, collection bins, collection trailers, or dumpsters will be located on a parcel except within fully screened masonry enclosures designed for that purpose. (k) Miscellaneous Site Facilities. i. No shopping cart corrals shall be permitted adjoining a building or within parking areas unless screened with masonry walls, landscaping or other acceptable buffers. ii. No outside freestanding vending machines, video games, propane stations, electric rides, newspaper boxes, collection bins, collection trailers, or similar equipment shall be permitted unless substantially screened from view from adjacent roads or parking areas. iii. No outside display of products of any kind shall be permitted unless substantially screened within an enclosure. iv. No outside work areas shall be permitted unless substantially screened from view. It is the intention of the City Commission of the City that the provisions stated in this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter," "section," "article," or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the Code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
