SUBJECT: Change Order Number 1, Construction of City Hall and Police Department
In reviewing their number of days bid (180 days), Huber Design & Construction Incorporated
has indicated that the original 240 days as shown in the City's contract documents was more
representative of time needed. Change Order Number 1 increases their 180 days to 240 days.
The City Attorney disagrees that there is a legal entitlement to an extension. However, in the
best interest of the City, staff recommends that this extension be granted.
The additional $10,866.00 represents claimed escalation of the electrical subcontractor's cost
since the submittal of bids for labor, material, and services. All other claims for escalation of
costs for labor, material, and services of any nature, whether asserted or unasserted, are thereby
waived and released. The City Attorney disagrees that there is a legal entitlement to any
additional payment. However, in the best interest of the City, staff recommends that the
additional $10,866.00 but only $10,866.00 be added to the contract sum.
The City Attorney agrees with the staff recommendation set forth in this memorandum.
Change Order Number 1 also clarifies products and warranties as requested by the Contractor
in his letter dated August 6, 1993. These were previously cited in the City's correspondence
dated June 25, 1993.
Action Requested •
The Mayor and Board of City Commissioners (1) approve Change Order Number 1 as outlined
and (2) authorize the Mayor and City Clerk to execute.

The Contract is changed as follows:
(1) Article 4, Time of Completion:The Contractor shall commence work to be performed under this Contract within
ten (10) consecutive calendar days after date of written Notice to Proceed and shall fully complete the Contract in Two
Hundred and Forty (240) calendar days after said date of written notice, as may be modified in the Notice to Proceed.
(2) Add $10,866.00 for escalation of electrical subcontractor's cost for labor, materials, and services. All other
claims for escalation of costs for labor, material, and services of any nature, whether asserted or unasserted, are
thereby waived and released.
(3) Clarification on products and warranties are as follows:
(a) Specified #1 Gyperete #2000 has a compressive strength of 2500PS1.
(b) Warranty provision of one year on D or better pine material for side and trim will apply.
(c) The City will be responsible for the cost of successful testing, including that required in Sections 15940
and 15971.
Contractor acknowledges, by its execution and acceptance of this Change Order, that the adjustments in
Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and
modifications of performance time incurred by the Contractor as a result of this Change Order. No other claim for
increased cost of performance or modifications of time will be granted by the Owner for the work covered by this
Change Order or any delay between the submittal of the bid and the execution of the Contract. The Contractor hereby
waives and releases any further claims for cost or time against the Owner, including but not limited to overhead and
profit, arising from or relating to the matters or work set forth or contemplated by this Change Order.
Contractor also acknowledges that there has been no change in its operations which would require a
modification of its sworn statement on Public Entity Crimes submitted with its Bid.
Not valid until signed by the Owner, Architect and Contractor.
