SUBJ: OFFICIAL CITY ZONING MAP UPDATE
ISSUE:
Should the Honorable Mayor and Board of City Commissioners adopt a
new Official City Zoning Map?
BACKGROUND:
The current Official City Zoning Map was adopted over three years
ago. Since that time, numerous boundary changes and rezonings have
occurred which dictate the need for revisions and an update of the
map. Additionally, there have been a number of discrepancies in
the map which have required research and subsequent correction to
ensure that the Official Map accurately reflects prior City
Commission actions .
DISCUSSION:
In 1990 , the City hired Baymont , Inc. to prepare a series of
basemaps for use as the Official Zoning Map. Since that time, City
Staff has periodically updated and added to these maps to reflect
annexed parcels and rezonings that were accomplished during the
intervening period. In cooperation with the Building Department ,
Planning Department staff has painstakingly reviewed each of the 93
map sheets contained in the Official Zoning Map set to ensure that
all information has been updated to the highest accuracy possible
based upon the best obtainable information.
During the updating process of the Official Zoning Map, the
Engineering Department worked cooperatively on an update to the
small scale City Map which is sold to the general public for
informational purposes . This map also required numerous changes to
reflect recent annexations , rezonings , and new subdivisions . As a
result , both the Official City Zoning Map and the informational
City Map are now consistent with each other and may be mutually
relied upon to convey accurate information to the public. Over
time, both of these maps will be combined into one and produced via
the City' s computerized Geographic Information System (GIS) .

Due to the size and number of sheets included in the zoning map
set , it is cost prohibitive to reproduce numerous copies for
distribution. Consequently, if any commissioner wishes to review
the Official City Zoning Map ( identified as Exhibit "A" in
Resolution 94-01) , the original will be available for inspection in
the Planning Department prior to the meeting.
STAFF RECOMMENDATION:
Staff respectfully recommends that the Honorable Mayor and Board of
City Commissioners approve Resolution No. 94-01 adopting the new
Official City Zoning Map as referenced therein.

RESOLUTION NO. 94-01
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA
ADOPTING A NEW OFFICIAL ZONING MAP; REPEALING
ALL PRIOR OFFICIAL ZONING MAPS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the current Official Zoning Map of the City of
Ocoee was adopted by Resolution 90-05 on August 7 , 1990 and has not
been updated subsequent thereto; and
WHEREAS, the Official Zoning Map of the City of Ocoee is
difficult to interpret because of the nature and number of
annexations , zonings and rezonings which have taken place in the
City of Ocoee subsequent to August 7 , 1990 ; and
WHEREAS, it has been determined by the Director of
Planning that the Official Zoning Map of the City of Ocoee contains
various drafting errors or omissions which require correction in
order to be consistent with zoning ordinances adopted by the City
Commission; and
WHEREAS, the City has updated the zoning map to
accurately set forth the existing zonings of all lands located
within the corporate limits of the City as of January 1 , 1994; and
WHEREAS, the City Commission of the City of Ocoee
desires • to adopt a new Official Zoning Map in order to allow for
convenient and easy interpretation of the existing zoning of all
lands located within the corporate limits of the City of Ocoee.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
Section 1. The City Commission of the City of Ocoee has
the authority to adopt this Resolution pursuant to Article VIII of
the Constitution of the State of Florida, Chapters 163 and 166,
Florida Statutes , and Article 5-1(H) of Chapter 180 of the Code of
Ordinances of the City of Ocoee.
Section 2 . The City Commission hereby adopts as the
Official Zoning Map of the City of Ocoee, Florida, that certain
zoning map consisting of ninety-three ( 93) separate map sheets
bearing various dates , said Zoning Map being attached hereto as
Exhibit "A" and by this reference made a part hereof . Said zoning
map shall be referred to as the "Official Zoning Map of the City of
Ocoee . Florida" .
Section 3 . All prior Official Zoning Maps of the City of
Ocoee and all Resolutions of the Ocoee City Commission with respect
thereto are hereby rescinded, repealed, superseded and replaced in
all respects by this Resolution and the Official Zoning Map of the
City of Ocoee, Florida attached hereto as Exhibit "A" .
Section 4. The Mayor and City Clerk are hereby
authorized and directed to affix their signatures and the seal of
the City of Ocoee to the Official Zoning Map of the City of Ocoee,
Florida.

Section 5. If any section, subsection, sentence, clause,
phrase or portion of this Resolution is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion thereto.
Section 6. This Resolution shall become effective
immediately upon passage and adoption.
